  1. If she does that, hopefully CBP will do their job properly and detain her until she's in front of an immigration judge who can decide she abandoned her green card, because that's exactly what she did, and send her on the first plane back.
  2. Pretty sure the DS160 asks for employment, so you already listed it there? From what you have posted, I would be expecting a denial.

  4. He won't be getting a B2 visa for a number of reasons, don't waste your money. One of those cases where it's 99% likely he will be rejected.

  6. B1 is for business, you mean B2 which is for tourism. You don't state what country she is from, but If she has previously visited without issue then it is less likely she will encounter any difficulty with her next attempted entry. Also depends on the length of her previous visits and how long she has been out of the US. Hopefully she still has ties to her home country. Saying that, coming to look after a baby can be considered 'work' which may raise an issue.
  7. 3 months long distance is hard??? No, it's not hard. So you made the (bad) decision to AOS whilst visiting on the VWP, and are now moaning about the consequences? I mean you decided to just stay there, living with your husband, as well as his parents? Like why would you ever decide to do that? Is he 18 or something, that he still lives with his parents? Stop complaining, and accept the consequences of your own bad decisions and deal with it.
  8. No, using a B2 tourist visa with the intention to adjust status to a permanent resident is visa fraud, and not allowed. She will need to apply from her home country.

  10. From what you have posted, I don't see where in the question the word 'specifically' is? Don't try to change the question to fit the applicant's circumstances. She has travelled from another country and is applying for a B2 visa in Canada. The answer is yes as @OldUsersaid.
  11. So you admit to working in the USA whilst visiting on the VWP, which is not allowed, remote or not. Then you say you will directly lie to CBP when asked a question. Wow. Add the fact you are abusing the VWP by using it to de facto live in the US without the appropriate visa (tourists don't have "motorhomes" in places they just visit), you are not a genuine tourist. I would expect a swift entry denial and sent on the first plane back, and banned from using the VWP for life, if CBP do their job properly on your next attempted visit.

  13. Getting married/making the application before she finds a job is a terrible idea. Once she has a job, which really should be both of yours only priority right now, then start the process.

  15. You can blame your fellow countrymen who due to their actions give your country a bad rep, hence more scrutiny. Previous poster was not exactly correct, if your B2 is denied you most certainly can apply for ESTA in the future, but answering 'yes' to the question of ever being denied a visa will almost certainly mean ESTA denial too. You mentioned withdrawing your B2 application, if you do it now then it will be marked as a refusal. Basically forget about your future ESTA plan until this B2 application is sorted one way or another. If you have already talked to people on the same situation and it can take 11 months, not sure what the point of this topic was. This 'uncertain limbo' that you are not OK with... nobody cares, certainly not the US, so there is nothing you can do apart from wait.
  16. There is no sponsoring a tourist visa. He applies online for a B2 visa, filling in the DS160, answering truthfully, and goes to the interview. It has nothing to do with you, he needs to show strong ties to his home country in order to be approved.
  17. Why do you keep talking about your application from over 10 years ago? Just forget about it, it has nothing whatsoever to do with the present day. Fill out the form answering the questions to the best of your knowledge. Done. Very simple.
  18. Since his sister got deported for working, that's another reason to deny his visa, as they will think he will do the same. He was correctly denied.
  19. No idea what 'date of join' means, but in general if answering any question asking for dates then put your best estimate. No they won't be comparing it to what you put 10 years ago. If your wife changed her name then it's pretty obvious what you need to put for that question... Her previous name.
  20. Not sure what's 'urgent' about this. The truth should be written regarding who is paying for the trip, not what answer you think will make the case stronger. Not sure why you think any documents can show strong ties - there's a reason why no documents are required. Most of the information needed to make the decision is on the DS160. Anything else will be ansked at the interview. Without a job her ties to home are automatically weak. Add family in the US to the mix and it does not look good, but as always, nothing to lose by applying apart from $$$.
  21. Seems odd that a 12 year old wants to go to a high school graduation. Also odd that an application has been made for him just because he's unhappy with his grandfather travelling. Even more odd that his parents have no interest in going with him. I think whoever goes with him to the Embassy, the result will be the same: denied.
  22. You didn't state what country is he from? Does he have any family in the US? What happened to the adults that were with him when he was a kid and got caught?
  23. Erm if you did feel like waiting, you would have never created this topic, so yes, you don't feel like waiting. You seem to think getting a visa to visit another country is a right, it's not, it's a privilege. If you feel the wait is unreasonable then apply for a visa for the countries where it only takes 1 month and visit them. Otherwise keep checking for reschedules and stop complaining.
  24. Coming over to take care of your wife/new baby is considered work and is even more reason for the application to be denied.
