  10. You're quoting things related to maintaining continuous residence. What you forget is marital union requirement because you're applying on 3 year rule. Quite a few officers interpret that strictly and if you had a trip for few months without your spouse, they'd deny based on breaking marital union.

Joint insurance policy / policies - car, health, life etc. 5. Flight and hotel reservations showing both names 6. Copies of state IDs or driver licenses with matching address for both spouses Make sure to provide all pages of those documents. Make sure your evidence covers period from date you married until now.

Depending on officer: 1) Living in separate states intially can be a problem 2) Your trip home for 2 months alone can be a problem 3) Another trip under 6 months if without husband can be a problem. Based on this pattern I would not apply until 3 year anniversary of you coming back from longer trip that lasted under 6 months.

What's more important evidence for 3 year rule N-400 is lease agreement or mortgage statements, joint bank account statements, jointly filed tax return transcripts, utility bills showing both spouses live at the same address, insurance showing both names, flight reservations showing both names etc etc
  15. Photos is the least important evidence. Yes, you can include some, maybe 20. Create a Word document. Place 3 photos per page. Capture every photo with date, location, occasion and name of people in the photo. Example: "01/01/2023. Times Square, New York. New Year Celebration. Left to right: John Smith (LPR applicant), Veronica Smith (US citizen spouse), Robert Brown (friend), Samantha Brown (friend)"

  19. Not an issue. But also, it's the foreign spouse who files N-400. I'm a bit confused. Are you talking about yourself in 3rd person? Or is this US citizen? If so, you don't file N-400.
  20. Well, CA DMV following CA laws... That's how it's supposed to be. Other states following their laws. 50 states with their own jurisdictions. Some with more relaxed rules, others with stricter rules. What I'm not 100% sure is whether any state DMV or BMV can accept copy of I-797 to renew / issue DL or ID. I guess only if staff is not trained / doesn't care.
  21. Exactly. When it's not there it means there is an outage of MyProgress. It being there or not isn't related to case progress at all.
  22. About addresses: you don't have to live at address for 5 years to list it. If you lived at address A for 1 year, address B for 2 years and address C for 2 years, you list them all because it was in the last 5 years. Same about current address. List your current address, it doesn't matter you didn't live there long. Part 4. Correct, unless anybody applied for you to come on immigrant visa, the answer is No. K-1 is non-immigrant.
