Usually biometrics. See https://www.uscis.gov/forms/filing-guidance/form-i-797-types-and-functions -
Thanks for sharing your experience. I hope fast I-90 renewals become a trend!

I-751 December 2022 Filers
OldUser replied to KAP2019's topic in Removing Conditions on Residency General Discussion
All depends on your immigration history, submitted evidence and random chance. It is more common NOT to have the interview than to have (unless applying for citizenship with pending ROC). You should always assume you WILL have interview. The consequences for missing the interview are bad. -
U4U appears to be the only option, the alternative is for MIL to wait it out in Canada on CUAET or in the EU (whatever their programs are called). Long term though, yourself, your wife and MIL may want to discuss the option of GC sponsorship once wife naturalizes. It does not look like this conflict will be over any time soon unfortunately. Even if it's over tomorrow the consequences such as damage to critical infrastructure, economy and social services including healthcare system will be felt for decades to come...

@Rastamike808 do yourself a favor, for future petitions use personal checks. Sure, it's ancient, but as long as you maintain the funds in your account - the most reliable method of payment. I would prepare another packet and be ready to ship if your card doesn't get charged by end of next week. Of course, if you're too close to I-94 expiration, follow Mike E's advice.

If you're intending living in the US for many more years, it makes sense naturalizing in most cases. You wouldn't have to deal with ridiculous processing times for GC renewals and USCIS in general.

N-400 Application - Out of Country documentation
OldUser replied to kiwirst's topic in US Citizenship General Discussion
Are you applying under 3 year rule (marriage based) or 5 year rule? If under 3, provide 3 years of travel history. If under 5, yes, dating back 5 years. As of today, 5 years ago is January 13, 2018. So any trips after this date. Be as accurate as you can be. Any inaccuracy may be used against you in N-400 interview. -
Hi, I have seen it somewhere, may need more time to find the links on this forum. Meanwhile, here is a datapoint saying their N-400 interview was conducted before they reached 5 years of being resident (within 90 days window) and denied on that basis: https://forums.immigration.com/threads/n400-passed-interview-then-denied-for-early-interview.303710/ Yes, you're eligible to file N-400 90 days early. But you cannot be approved before 3 years mark as LPR for marriage based case. If I'm not mistaken, I've seen some blazing fast N-400 interviews that come a month or two after filing. If that's the case, USCIS can conduct interview early (say 14 days before 3 year mark) and deny application based on that. What are the chances of that? Small, but I'm only advocating for the safest approach, which is wait 3 full years before applying.

Why not just a quick e-visa for the trip and care about 10 year visa or OCI later? -

Yes, currently WAC is processing cases from November 2021 and earlier. They haven't started December 2021 yet. However, you may have a biometrics appointment. Mine took 5 months to reuse, but you may be called in. You don't want to miss it for sure. -
November 2022 I-751 Filers

November 2021 WAC filer here. Got biometrics reused end of April 2022. And my case is not unique. -
It absolutely can hold up naturalization. N-400 can only be approved after I-751, unless you're in the military. Just read "Decision cannot be made" threads in Citizenship forum. For example, user in this thread waited for 5 months after N-400 interview to get it approved, because of pending I-751. By the looks of it, N-400 was just stalled until I-751 got approved. I-751 took however long it needed to take. Overall, of course it may be faster than waiting for I-751 approval and applying N-400 after it. Though, it's nice to have that 10 year GC in case if N-400 is stuck for whatever reason.

9 more WAC cases in 21XXX range got approved as of 10:50 PT this morning. -
Because I've seen reports of IOs wrongfully denying petitions filed at 2 year 9 months mark. I've also seen reports of online N-400 being denied because of USCIS system not processing dates correctly. E.g. somebody filed on 12/21/2020 getting receipt date of 12/20/2020. That one day can be difference between approval and denial. In the grand scheme of things, submitting application 3 years and week from resident since date VS 2 years 9 months does not make much difference. Think yourself, 20 years later, would it matter you got naturalized in March 2024 or June 2024? It's safer and will make it easier for IO to approve the case instead of borderline decision. Same goes for all other requirements. It's best not file when you had a foreign trip of 180 days exact or if you spent exactly 18 months in the US as oppose to 19-20 months or more.

Yes, the best time to apply would be around April 1st 2024 to be on a safe side. That's given: - He did not spend 180+ days out of the US on any given trip - He lived in the US for at least 18 months in the last 3 years - He was married and physically lived with same US citizen spouse all this time. And the spouse was US citizen all this time.
