    I think you got it right. Just list them and say they won't be appling with you. It's much better to list and explain at the interview VS getting asked at the interview why you haven't listed them. This way you don't appear like you're hiding anything. If I recall correctly, the form asks to list ANY children you may have. This can be interpreted to include step children.

    1. You're not in a process of changing status. You're adjusting status. 2. You need to be in valid status to adjust or change status. 3. What are the lawyers at the sponsoring company saying about this situation? The problem with renewing E2 petition is you'll have to declare whether anybody ever filed an immigrant petition to you. Once you declare it, you may not get a renewal.

    Nobody expects you to have joint banking or lease since you live in different countries. That type of evidence is needed when adjusting status, e.g. if she was in the US already.

    Do everything together. Because I-131 and I-765 depend on pending I-485, it's just easy to have them all together so they can be easily linked.

    I totally get your point about N-400 but please don't discount the positive psychological effect of US citizen spouse being present when naturalizing under 3 year rule. VJ has stories suggesting IO being friendlier when US citizen spouse was around and occasionally more alert when they weren't. N-400 under 3 year rule suggests you still have to be living in bonafide marriage, and spouse taking time off to be at USCIS is a good evidence their relationship is strong.

    Yes, you get visa from the embassy in your passport. CBP then endorses it (stamps it) as you enter the US.

    I'd think the safest thing would be holding off visiting the US until you get CR-1 visa in passport. Travelling on ESTA after interview may confuse CBP and create all sorts of delays / scrutiny at the border. If you already got the CR-1 visa, you don't need ESTA. Just enter with CR-1.

    Where did you get this info from? Of course they do have the biometrics chip. You can even see logo on front cover. Image from wikipedia but I've seen US passports in person many times.

    Just like with many things in life, just because you can doesn't mean you should. As an example, I can technically go and purchase a new car today after getting a loan. But whether I should is another question... If you upload evidence, what confirmation do you get to prove you uploaded it? If later USCIS server lags and erases your upload, how can you prove you replied? If IO decides not to check online uploads since instructions tell you to reply by mail, what whould happen? With mail you can have proof of sending and proof of delivery. Good luck!

    Both normal. If you search threads, there were few reported approvals this week. Some from 2021 and some from 2022. Most of cases approved are either from those years or few lucky ones fron 2024. Hang in there, I'm sure you'll hear about your husband's N-400 soon. When you say "no movement", do you literally mean nothing on the case? If he received receipt and biometrics reuse, that's already a lot of movement for one month.

    What an amazing story, congratulations! I think uploading request for combo as you file N-400 is the best, because it gives a lot of heads up to USCIS. Sounds like a happy end, don't forget to stop by VJ 😃

    If it was up to me, I'd include the fees for I-131 and I-765 in I-485 fees and make them mandatory. There's many stories of people living in misery and financial hardship for few years as well as missing the important events (illnesses or deaths of close ones overseas) because no forms were filed...

    +1 $260 can be earned very quickly by your spouse so EAD will pay itself off. If your spouse receives it in 6 months, they can work for 5-6 months while waiting for GC. And get DL etc

    2. When my lawyer filed AOS, they submitted scans of all passport pages. 3. Submit certified copy, it's easy to order many more. 4. Can submit later if receive RFE. Was the medical completed with all vaccinations? Is it still valid? 5. Read https://www.uscis.gov/forms/filing-guidance/tips-for-filing-forms-by-mail 6. It can take a year or longer to get GC. No plans to work meanwhile? What if somebody gets sick back home, would the spouse be OK not leaving the US? It's not like you can get EAD / AP quickly. It takes months.

    You're correct about this one too. Though it doesn't mean somebody can get spend as much time outside of the US as they wish. Few weeks / months a year is OK. However, LPR is expected to live in the US for majority of time (ideally 9+ months and definitely over 6 months). Otherwise they cannot naturalize and may lose GC.

    You're correct about choice for US citizens. It's not a choice for LPR, as living outside the US puts this status at risk.

    If the Resident Since on your GC is 03/28/2022, you can apply for citizenship under 3 year rule on 03/28/2025 minus 90 days, which is 12/28/2025. Considering it's a Saturday, I'd just apply the first week of January 2025. Make sure you have at least 18 months of presence in the US, never had trips over 6 months and your marriage is strong and bonafide. E.g. you never separated from your US citizen spouse etc. They also need to be a US citizen for at least 3 years when you apply.
