  2. Did husband's sister apply for US passport? How did it go? I explained why your husband is likely not a US citizen. If your husband had a green card and lived with his father in 1990 - he is a citizen, otherwise unlikely.
  3. You can file today. I would not include copy of 2 year GC, this will likely confuse USCIS. They'll think you still have to remove conditions. Include copy of 10 year GC if you happen to have it. It's good that you have 2 year GC though, especially because it has the Alien number on it.
  4. Not saying it's impossible to get ADIT stamp. It all depends on your persistance. USCIS will likely want you to have a pending petition of some sort to request the stamp. The only way you can find out is by trying!

Get H1B For the route 3 though, you cannot plan on coming and staying in the US. This is only a hypothetical scenario, which gives you a chance to get education and work experience in the US. You should also be aware that GC comes with responsibilities, such as (there's more than provided): - Reporting income for tax purposes world wide, even if you moved out of the US. - Selective service in US army for men between 18 and 26 - Living in the US on permanent basis. Trips overseas generally shouldn't exceed 6 months.

  13. Based on what you described, your husband is likely NOT a US citizen. He needs to file N-400 and get his citizenship. If he lived with his father as a minor in the US at the time father became a citizen, he would become a citizen automatically. But what you're saying your husband only came to the US in 1995, whereas his father naturalized in 1987.
  14. Was his mother a US citizen? Was father a naturalized citizen? When did he naturalize? Was your husband living with father when the father naturalized?
  15. Hello, really sorry to hear about the loss of your mother in law. Also congratulations on getting married. You can pick either route. Each has advantages and disadvantages. In a nutshell: Adjustment Of Status (AOS) is more expensive, and you won't be able to work or leave the US for many months. Could be close to 2 years. Then you would also have to go through Removal of Conditions in few years, which takes 2-3 years nowadays. But you would get to be with your husband all this time. CR1 / IR1 visa is cheaper. You would have to wait abroad to get the visa. It may be more difficult to visit the US once you filed I-130. The wait for visa could be 1.5-2 years. But if you receive IR1 visa in the end, you would have a 10 year green card and wouldn't have to remove conditions. Also, with this method, you would be able to work as soon as you enter the US on this visa.
  16. Adjustment of status must be filed in the US and the immigrant cannot leave the US until received Advance Parole. Otherwise, petition will be considered abandoned. If, on the other hand, she decides to go via consular processing route, she may have issues re-entering the US while waiting for her immigrant visa.

  19. Recently came back from a trip to Europe. On the way back, departure was uneventful, as United airline agent was nice and knowledgable. Arrival at SFO wasn't as smooth as in September 2022. The GE kiosks asked to scan docs this time. This was a rollback from purely facial recognition I've experienced in September 2022. The system didn't like the expired GC so had to see the CBP briefly and show extension letter.

  22. What do you mean by that? Redact stuff from statements? People get RFEs for that AFAIK.
  23. While I agree sharing financial info with strangers is not ideal and not comfortable for many, this is exactly what USCIS is looking for. IO wants to see detailed info about how you co-mingle finances. That's probably why RFE was issued. You need to submit everything and overwhelm them with evidence. Otherwise you may get a denial.

  25. Sorry to hear about that. When you filed I-751, did you submit evidence from the start of the marriage or only stuff since becoming LPR? Did you submit all pages of all statements or only some? Did you submit every monthly statement or just select statements from each quarter?
