I disagree, not much benefit of filing I-130 electronically in this case, because I-485 is paper only form. I vote for filing the entire packet together. Here is detailed guide for Adjustment of Status:

I-751 March 2023 Filers
OldUser replied to D. Sala's topic in Removing Conditions on Residency General Discussion
Depends on your comfort level. People did either way and got approved. People did either way and got denied. I submitted everything to follow the instructions. What's the concern about heavy package? Don't worry, USCIS employee won't hurt their back carrying it 😃 If it's the cost of shipping, yes, it may be pricier. But I did it in hope to avoid RFE. Copies of your and spouse's driver licenses with matching address is excellent piece of evidence of you living together. Include it. No, leave blank. Unless you have a special person preparing your forms for you. Use whatever account is active and you have access to. You can also leave it blank. -
I-751 MAY 2022 Filers

Yes, there's two approaches. Either submitting all the evidence since marriage date or only updated information after I-751 filing. You do what's more comfortable for you. -
I-751 MAY 2022 Filers
OldUser replied to Alix64's topic in Removing Conditions on Residency General Discussion
Of course, you need to prove your marriage just like you did for I-751 and AOS / CR-1 when filing under 3 year rule. Not sure if pay stubs are needed though. Just the evidence that has both names on it. -

What's N-499? You mean N-400? Submit as much as possible with initial filing to avoid RFE and bring the rest to the interview. -
The earliest you can apply under 3 year rule is 3 year anniversary of being here, e.g. date in October 2023 minus 90 days. I would not apply 90 days early and wait until past anniversary date to be absolutely safe. E.g. if you came back on October 15, 2020, then it's very safe applying on October 20, 2023 for example. You would need to prove your marriage in the last 3 years. Joint banking statements, bills, taxes, lease or mortgage and many more evidence proving you lived in bonafide marriage. Your spouse may need to attend the USCIS appointment with you, even though he or she may not be allowed to be present at the interview. If you want to skip this evidence, you can apply under 5 year rule in October 2025 (or July 2025 if filing 90 days early). You would not have to prove marriage in this case.

If you didn't break residence or physical presence requirement in the last 5 years, apply under 5 year rule. There's fewer evidence needed, more IOs at USCIS know how to deal with it etc. You need tax return transcripts for the last 5 years. You either need to have 0 balance at IRS or be on payment plan if you owe money. Re-entry permit is not a problem if you lived for 5 years in the US before filing for N-400 and it's been 5 years since you returned to the US after 2 year absence.

Route 1 1. Change the name in passport of origin to match US passport name. 2. Problem solved Route 2 1. If passport of origin has maiden name, carry marriage certificate with you to prove name change if asked any questions by airline Either way, you would have to use both passports for travelling if you need that visa free access. @Mike E gave example below.

If you're going AOS route, file all the forms on paper together. Yes, include I-130A -
US Marriage Certificate/ Last name change?
OldUser replied to ahqs90's topic in US Citizenship General Discussion
After naturalization will cost extra fees to change name. During naturalization can take longer to become a citizen. If it's not important, do not change name. -
N400 interview scheduled while ROC pending
OldUser replied to vivfran's topic in US Citizenship General Discussion
Make sure your US citizen spouse comes with you. Yes, do mention pending I-751 to IO. Bring your passports, GC, spouse's Birth Certificate or Naturalization certificate, marriage certificate, tax returns for past 3 years and all other bonafide marriage evidence. It's OK not to have a lawyer if you don't have a difficult case. -
I-751 March 2023 Filers
OldUser replied to D. Sala's topic in Removing Conditions on Residency General Discussion
No, but if you have less than 3 months left on GC and travelling abroad you really should have a I-551 stamp valid for 6+ months or extension letter for GC. The last thing you want is cancelled flight or get sick or something similar to 2020 when borders where closed. Then you can get stuck abroad with expired GC. -
This is all manipulation, do not let him determine your fate. Only court can decide who will have the custody over the child, if you're going that route. It's hard, but try not to engage in heated discussions with him. This leads to emotional or physical violence sometimes. Stay calm and focused. You deserve better treatment.

Question on lawyer fees for RFEs
OldUser replied to jxn's topic in Adjustment of Status from Work, Student, & Tourist Visas
@jxn looks like you're working with either unexperienced lawyer or somebody who has bad intentions, e.g. making $$$$ on immigrants. Usually, you would discuss these things during initial consult to ensure that you understand whether lawyer be charging for any RFEs or fix them for free if it was their problem. Many good lawyers would charge one fee to get your application approved and respond to RFEs for free if it was their mistake / something minor. Lawyers usually charge fees for attending the interview. Did you check, whether your lawyer is listed on American Bar Association website? Here is the link: https://www.americanbar.org/groups/legal_services/flh-home/flh-bar-directories-and-lawyer-finders/ You first select the state, and then search lawyer by name. If the lawyer cannot be found, ask them which state they passed the bar exam. Of they don't give you their bar number or you can't find them using the website above - that's a bad sign. In this case, ask for copy of your application and everything submitted. Once you get copies, ask for refund since they did a poor job. Look for a good lawyer, listed on that website and transfer your case to them. -

I-751 Cover Letter Feedback
OldUser replied to Samin.'s topic in Removing Conditions on Residency General Discussion
Agreed, unlikely is going to be read. And if read, the ask for waiving interview may have the opposite effect. -
1. Don't even mention to him you have proof. 2. Don't tell him about any plans for divorce etc. 3. Put all of your documents in secure place outside of home, make digital copies of everything prior to this. 4. Secure your phone, social media and email by setting new passwords where applicable and ensuring he doesn't know them. 5. Stop contributing anything towards joint account and build your own savings. 6. Move out of the house to a new place he doesn't know about. 7. Ask for restraining order on him if you're worried about safety 8. File for divorce Immigration wise, you have nothing to worry about, especially if you have 10 year GC. Worry about your safety and future of your child.

I-751 Cover Letter Feedback
OldUser replied to Samin.'s topic in Removing Conditions on Residency General Discussion
People send evidence for time between becoming LPR and removal of conditions. The instructions for I-751 say, the evidence should be from the date of marriage until moment of filing for ROC. You can decide what works for you. 1. Your wife should change address on DL to where she lives, hopefully that's the same address where you live. 2. Include everything that has both names on it. 3. Send both utility statements. You can explain in cover letter, such as "My spouse pays gas bills, and I pay electricity bills etc". But do call the utility companies and request both names to be added. 4. Already explained. At least 4/21, but I included everything from start of marriage. Do what you're comfortable with. -

I wouldn't risk it even if it still is. Things happen like closed borders or change of plans. Right, cannot travel on that -

Good luck! Also try just showing up at local field office if you can. With all the docs (GC, passport, confirmation letters for flights etc). You may get accross some sympathetic employee who will let you get the stamp. -

Original only. Majority of airlines won't even allow you to board the plane to the US with a copy.
