  3. These are questions to a divorce attorney. In my understanding, it becomes difficult proving the money is earned before marriage if it being shifted from one account to the other.
  4. Accounts in both names and in your name or her name can be split. If you had $10000 in you personal account before marriage and never put more money / moved it out while married, then yes, that account is not getting split and you get to keep $10000. $10000 is just an example. If you had a personal account, any money earned or moved there while you're married will be split.

  6. I thought so too, but then the difference between 24XXX and 26XXX range is only few days. That could be, but I find it hard to believe many people in 26XXX and 27XXX range applied for N-400, but folks in 24XXX and 25XXX range did not. I'd assume there's people in every range applying and people in every range who decide to wait for I-751 adjudication. Let's keep observing, that's all I can say 😃

  8. Fun fact for WAC filers: as of today there's more approved cases in 26XXX range than 24XXX and 25XXX range. This just proves USCIS doesn't process cases using First In First Out approach.

  10. Hi @StarChristmas 1. It asks "or submitted your application for permanent resident status" 2. Similar to question 1. If you don't remember details, file FOIA, it's free. It will give you everything USCIS has on you including prior applications. 3. Correct answer is No, since you did AOS. 4. It sucks but best to answer it.
  11. Hi @VJB9 did you file yourself or with a lawyer? If with lawyer, contact them to see if they kept records. If you filed yourself and have a good relationship with ex, ask him or her. That's probably the quickest way. Otherwise, you could file a FOIA request (it's free). You may get something in 6-8 weeks. It's always important to fill the paperwork correctly, so I'd do that not to complicate your future spouse's case. The fact you petitioned for somebody before may draw USCIS' attention to your new I-130.
  12. Yes, you can apply for citizenship if you're still married to the same US citizen and living in marital union. Also, you need to make sure you haven't had any overseas trips over 180 days on any given trip. Also, you needed to spend at least 18 months in the US in the last 3 years. If you don't have convictions and have all of those conditions met, you can apply for N-400 today.
  13. I think he should withdraw N-400 ASAP to avoid denial. It's an unnecessary record in his file, if he gets denied. He would not receive any refunds.
  14. Have you been an LPR for 3 years already? Are you at AOS stage (do not have GC) or removal of conditions stage (have 2 year GC)? If you have your 2 year GC, what is the Resident Since date on it? You need to be Resident Since before June 17th, 2020 to apply for N-400 today.
  15. That's very close. You're getting in the grey area. Some people's AOS and extensions of status failed because they filed too close. Some of their applications were denied even though they sent things before the deadline. Their packets reached right before the deadline, but sometimes it takes USCIS 3-5 business days to actually mark your packet as received. And then USCIS the days they received application to determine whether it was filed late. This contradicts their own manuals, but they're known for making mistakes. Those cases are not related to marriage to US citizen. In your case, it wouldn't be a big issue, since the overstay (if they think your wife overstayed) is forgiven regardless. It's just, in ideal world you would have done it like a week ago at least. Good luck, let us know how it goes.
  16. Agree on this one. Ideally @Freeegg either has savings or ability to borrow money to file ASAP so the packet arrives at USCIS before end of March. If this is impossible, you'd be filing late, which would make your spouse out of status at the moment of adjustment. It will be forgiven if AOS is approved. However it may be another negative factor during AOS interview and it will pose issues if she decides to travel outside of US with Advance Parole. Once she receives Green Card, her out of status wouldn't be a barrier to international travel.
  17. It's time to get prepared! There are no guarantees in this process. Do you have pending N-400 in addition to I-751? Or you haven't filed it?
  18. How do you check it? Have you tried case status page? https://egov.uscis.gov/casestatus/landing.do What error do you get?
  19. If the status is to date, this means the GC hasn't been ordered to be printed yet. It's yet to be printed and then mailed to you.
  20. Examples that will complicate you case: - You paid the school money to get status in the US and didn't really study. - You studied very unrelated fields and jumped from one learning path to the other. Makes USCIS think you were just trying to prolong your stay. At first sight shouldn't be a problem for you, as I assume you got a high school diploma from a US school? What made you switch from big public college in Florida to private and small school before you dropped out? Don't answer here, but these questions may be asked during AOS interview.
