  1. In a matter of weeks or months (can take 6 months easily) you will receive letter about biometrics reuse or appointment. Keep checking status online
  2. Make sure to always keep your attorney up to date. If they don't have full and up to date information, they may be giving you wrong advice based on incomplete picture.
  3. Potentially. Being out of status can raise suspicion. It's one of the possible fraud indicators. It will be forgiven for spouse of US citizen though, if I-485 is approved. Yes
  4. You're legally obliged to file change of address within 10 days of moving. It's good that you can fix it now. It would have been worse if you never filed AR -11 and this became known during interview with USCIS. There would have been a great chance of fraud accusation in that situation.
  5. February 2024 (anniversary of your LPR status) minus 90 days. So somewhere in November 2023. When you are within 90 days of being LPR for 3 years.
  6. Not a smart move. This is a huge fraud indicator that can result in USCIS accusing LPR of misrepresentation and resulting in potential loss of immigration benefits.
  7. Denying employment on these grounds is a real discrimination. Also, it is mitigated by presenting unrestricted social security card and valid driver's license or state ID. LPR can get unrestricted SSN card with conditional GC and or extension letter if needed. Same goes to ID / drivers license. At the time I got my current job, I had less than a month left on conditional GC. I never had to show it to new employer... I'm a professional with a very decent salary. I hope that whoever reads this do not end up in situation your family was. I can only imagine how difficult it was to live on one income. Best of luck, be ready to do combo interview (I-751 and N-400).
  8. Your spouse was likely discriminated against. He should have not declined offers. Life usually doesn't stop for a LPR even when in removal proceedings, let alone pending I-751. Most jobs do not require US citizenship. The ones requiring it are usually jobs in US defense / intelligence and similar. With pending I-751, he had all the rights a 10 year greencard holder would've had and almost all the right a US citizen would've had, with exception of voting and other similar restrictions. Good luck with the interview!
  9. @happymember married filed jointly is evidence of comingling finances and helps the case. Married filed separately may be peceived by some IO as the opposite and may not affect case at all or may hurt it. Why don't you try running numbers in Turbotax or with CPA for both scenarios? If married filed jointly gets you as a family, better return, it would be very silly for your significant other to go other route.
  10. Providing it again would not hurt. Not providing it may hurt if USCIS cannot locate marriage certificate you already submitted, which happens.
  11. Ok, so your plan is to establish child's US citizenship via N-600k and go back to permanent residence ouside of the US? I wasn't sure if your reply was to @Mike E or @SteveInBostonI130.
  12. Form N-600K is filed by a qualifying applicant to establish citizenship through a U.S. citizen parent when the child applicant will be regularly residing outside the United States.
  13. Does she have B2 already? Is she eligible for ESTA?
  14. @Pbl You should get your approval soon, by the looks of things. WAC are looking into November-December cases pretty actively. Fingers crossed they'll keep the focus.
  15. That's not how it works. Your and their income should not be combined in calculations. Each sponsor's income should meet the requirements without combining it.
  16. @Alekezam congratulations on successful interview! Glad it went smoothly. In my opinion, there's no harm or downside for asking for it. It's also free 🙂 I've seen only N-400 being conducted with "decision cannot be made" outcome. This is a recommendation to minimize chance of combo not happening. By law IO could have asked for more documents. It's better be safe than sorry. A lot of the times, those documents are generally good to have for other life situations. Sometimes US citizen loses their certificate of naturalization or birth certificate. They may not be asked during I-751 / N-400 combo, but they can be vital for other things. Either way, good to hear your story, thank you for the details!
  17. It's like going to a car repair shop and they find reasons to replace many things in a car when you only needed an oil change. Oil change would be $100, but "fix everything" is $500. Not every lawyer or car shop is like that, but I just want you to be aware of this. Make sure the lawyer has a good record and a member of American Bar Association - https://www.americanbar.org/
  18. It may be higher, but does it meet the requirements for the household size? https://www.uscis.gov/i-864p
  19. Let us know how it goes. Also remember, there is potential conflict of interest. Depending on a lawyer, they may be incentivized to have some case filed for you.
