    - Have you been a LPR for at least 2 years 9 months and 1 day? - Have you been married to a US citizen for 3+ years and living in marital union? - Were you all of your trips shorter than 6 month in the last 3 year period? - Were you physically present in the US for at least 18 months in the last 3 years? - Did you file all taxes in the last 3 years? - Did you not have any arrests, convictions in the last 3 years? If said Yes to all of the questions above (there may be more I forgot) you can file.

    @GOODCITIZEN The 3 year rule requires more paperwork and evidence for approval. Maybe the lawyer suggests the path of lowest resistance OR the lawyer wasn't aware of all circumstances e.g. marriage to US citizen. How long has the wife been a US citizen for? She needed to be a citizen for at least 3 years, meaning marriage should have been longer than 3 years by then.

    Thanks for input @BugsBurger Regardless of whether OP applies under 3 or 5 year rule, the DUI probation was completed in 2022. And it still may be a problem for good moral character. I think a lawyer should be consulted to understand if that's a problem, and if it is, whether 2 years of probation are "good" years or "bad" years for the purposes of good moral character.

    I suppose you can prove her absense? E.g. show her flight reservation printout, some emails about the trip from her work etc? Maybe the IO will be satisfied with this information.

    Yes, you can upload documents online for N-400, including a cover letter in Word / PDF document asking for combo interview. It may get processed faster or it may not. When you have both I-751 and N-400 and if they're not decided after 120 days after N-400 interview, you can sue USCIS with writ of mandamus to get the decision faster. This is usually prepared and filed by lawyers. But in a lot of cases N-400 helps I-751 even without lawsuit. Some people on this forum waited for 4 years for I-751. And it got approved with N-400 after filing in less than 6 months.

    No worries, I'm glad we came to mutual understanding. When you file N-400, it cannot get approved without I-751, so a lot of the times, USCIS will review and decide on your I-751 before arranging N-400 interview. Other times, they will have a combo interview for I-751 and N-400 and give you decision for both. And in some cases, they'll only interview you for N-400 and you'll keep waiting for I-751 decision to get N-400 approved. There's no way of knowing exactly how it will go. But even in the worst case, you're saving time, because N-400 will be already done. So you naturalize faster because you didn't wait for I-751 to get approved to get started on N-400.     Yes, and I said you can apply / file for N-400 with pending I-751. But you gotta understand, N-400 cannot be approved without approved I-751. Just like "pending" and "approved" are two different things, "approved" and "apply" are two different things. You have to pay the I-751 fees regardless of the wait, which could be 10 days or could be 4 years to get approved. Also, many people don't apply for N-400. But the I-751 is both for those who apply for N-400 and those who don't. These are the rules, no matter how we feel about them.

    Yes, extension is for 48 months. I travelled 3 times on extension letter and expired Green Card. Didn't encounter issues but you need to do research to ensure the airline and country you're travelling to know how to deal with it. Here is thread about travelling on extension letters.     That's scary and probably is a sign of disability, just not a physical one.

    I wouldn't count on this too much. It helps sometimes, yes. Other times it has 0 effect. I think AOS takes over a year on average.

    Ok, I see no point discussing this further. Please spend some time to understand how the process works. Information is readily available on this forum. Immigration benefit is a privilege, not a right.
