  1. She can, but it would be difficult to convince consular officer she doesn't have immigrant intent when I-130 (immigrant petition) is filed.
  2. I'm not sure if you're going to be eligible for N-400 under 3 year rule. You lived separately for some time, and it requires living in marital union from start of marriage until oath. Some officers interpret this very strictly and deny N-400. The safest would be to file under 5 year rule. At that time, hopefully I-751 would be approved and N-400 won't require proving marriage most likely.
  3. Amazing news, wishing you the best guys! Immigration wise, make sure to be honest with USCIS about living arrengements etc. They'd understand if a couple had a rough patch, but won't accept hiding facts or misleading information on forms / during interview.
  4. If they're eligible sponsors, both herself and her parents will fill out I-864. What are you waiting for? You're married since May, should have filed in June or July. Don't let your status expire. I-485 takes forever to process. As to question about appointments... All depends on civil surgeon availavility. My appointment was a day or two away after finding one.
  5. The affidavit is unusual to say the least. I'd suggest consulting with a lawyer before sending something like this.
  6. I don't think this is a typical scenario. USCIS may be confused and suspect marriage fraud. At the same time, if current your marriage is not going to survive: 1) Divorce 2) File I-751 with divorce waiver I wouldn't remarry for some time. Take a break, think about your goals and get to know your new partner.
  7. No travel to the US - no CR1 activation? I guess that's the easiest solution if taxes are important. I don't believe you can have both (taxes advantages and ability to enter the US) at this time.
  8. I updated expiration online but haven't traveled since so don't know if that went OK. I got GE before I became a LPR.
  9. So based on what USCIS says you went to get marriage license with a different woman, few days after meeting the US citizen wife? That seems weird, I can understand why they're confused and suspicious. You and your lawyer have a steep hill ahead. Good luck!

  11. So I think the path of least resistance would be using current (maiden) name everywhere until naturalization. Then update it everywhere.

  14. I'm not aware of expedite requests for I-751s. It's likely USCIS randomly approves newer cases to bring down processing times.

  16. Should have withdrawn N-400 the moment divorce was filed or at least before the interview. You got a nice IO. Some would have get upset / angry you proceeded with N-400 interview when ineligible for citizenship.
  17. Sorry you had to go through abuse. Did you have therapy? How long did it last? It's a tough case, when there are no police reports, multiple pieces of evidence showing it was on continuous basis etc. Not trying to make you worried more, just hoping you have more evidence. Others may also suggest.

  19. That sucks! Yes, the kiosks is hit or miss with expired GC and I-751. Where kiosk operated in facial recognition mode - I was fine. Where it asked for a document - I had to see an agent. Now I got 10 year GC, and updated expiration on GE portal, not sure if this us sufficient or have to see somebody at enrollment center. I did not try updating expiration date based on extension letter before, maybe it was OK or maybe it wasn't. The enrollment center avoids I-751 extension like the plague, I tried twice updating info in their system. Seems like the same is with new enrollment, though at least I could use GE lane with kiosks not working...
  20. If immigration lawyer is involved they can help you with this. Essentially, your spouse (or ex spouse at that time) will sign an affidavit / personal statement. This affidavit can be prepared by a lawyer after having a chat with spouse / ex spouse to confirm the facts. It will contain history of how you guys met, married, how marriage went and potentially reasons why you split. In the statement the US citizen spouse / ex spouse will confirm that the marriage was bonafide and real, just didn't work out. E.g. they don't have objections for you staying in the US and getting 10 year GC. This statement can help approving the case quicker and provide some protection in case if ex spouse later will write a mean letter to USCIS, accusing you of marrying them for green card or something like that. Just make sure you're in good relationship with your spouse. It may be hard during divorce, but it helps if they're supporting you staying. Either way, it's not wise to stay married for papers, as this can be seen as fraud.
