  1. How long have you been married @Murican? If under 2 years upon receiving marriage based GC, she'd have to go through I-751. I'd allow her just to continue on EB2-NIW. That way you also don't have to sponsor your wife (financial liability). Seems like she has a clean, simple path to GC and citizenship. I wouldn't disrupt it.
  2. 4-6 weeks after submitting I-751 is usually the timeframe to receive I-797 (extension letter). Yes, you can re-enter US with valid GC visa even if it has a few days left on it. However, what if your flight gets cancelled? What if you get sick? What if the borders close (remeber COVID?) I strongly suggest leaving with extension letter. You should receive extension letter sometime in November or early December.

If you had a well established business that would be a good tie. If your parents were disabled / elderly and you cared for them, that could be a tie (though how would you travel overseas without them)? The thing is, your chances of getting a tourist visa are small at this stage of life. What if you come to visit boyfriend but instead meet and marry a US citizen? I know it sounds wild, but that's what US officials assume.

Re-entry permit is what you need for short term. For long term, you'll have to pick. Relying on Germany changing laws is a weak plan.

  14. What does the passport say in "Nationality"? Does jt say "British Citizen"? If yes, you're not any different to Brits who never went outside of the UK.
  15. Yes, if you're a UK citizen. Remember, having passport is not a requirement for being a citizen. Many American citizens never had a US passport.

  18. Not an issue at all. Passport is not required for I-751. Just get the passport renewed. Make scans of passport before renewing for your records and ask embassy to keep the old passport. Many countries cut corner of the old passport / punch holes and give it back.
  19. Assuming she knew the guy before meeting you, this really hurts your case, doesn't help. In USCIS's mind her real love was the guy from her school and you were just a source of income. Be very careful how you frame your relationship at the interview. You need your lawyer's help to practice and have a clear story.

  22. This is normal. Nobody gets info about their cases over the phone with exception when Tier 1 officer makes things up to get an immigrant off the phone.
