  1. Did you commit some crime in the past? Typically that's when a petitioner would be requried going through biometrics.
  2. Good luck! I think it's worth investigating how to obtain US citizenship certificate. You never know when you can get asked for that in the future. It's much more solid proof for some things, especially if your mother loses her documentation proving how you are a citizen. Or when she passes away and you won't get all the papers. Technically, any time in the future, like 30 years later you may be asked to reprove how you are a US citizen when renewing passport. At that point you'd have to find the same docs your mother used to get you a passport OR just show the citizenship certificate.
  3. They cannot just board the plane and come without visa unfortunately. What are others doing in the same situation? I cannot advice, it's not a usual case. Maybe their files need to be transferred to an embassy in another country where they can attend the interview. Not sure...
  4. What makes you think it won't work? Did you click the link I provided? When you select: An Adult Original Foreign Born US Citizen It lists all the documents accepted. Among them US passport and foreign birth certificate.
  5. Somebody from Haiti needs to have a valid visa to enter the US on Haitian passport. Depending on visa the length of allowed stay will be different. The maximum stay on visitor visa is 180 days. Work or student visa may allow to stay longer for different purposes.
  6. EAD is another form of ID. Even if the minor cannot work, it would help as EAD would be proof of identity.

  11. I don't know whether it's lack of training or deliberate tactic to get people off the phone - a lot of USCIS tier 1 agents would tell you incorrect information. I'd imagine if you give them any clue such as "should I cancel payment"?, they'd reply "yes". If you asked them whether you should leave the US, they'd advise you to. My theory is they're underpaid, undertrained and have a goal of answering XX number of calls an hour. If they answer lower number they get penalized. I cannot explain otherwise why so many times their advise hurt VJ members.
  12. It happens when USCIS reuses biometrics and doesn't require going to appointment. But it's only my assumption, I'd request missing notice.
  13. Also, if sponsor (I-864) moved to a different address, he or she should file I-865 within 30 days of moving too.
  14. Not sure what I767C is, but I-797C is a copy of an action notice. I'd bet money on biometrics reuse notice. I received one of those. However, it might be something else.   15. Filed both on paper. Also included I-765 and I-131. You should include them too, as they're free if filed before April 1st! I do not see appeal in filing I-130 electronically, when the rest of the forms can only be filed on paper. If it was possible to do everything electronically - that would be a different conversation. USCIS would have to link I-130 to I-485. If filed together that's much easier and all cases would have sequential numbers.

  17. Did you provide copy of I-751 receipt in letter with copy of divorce decree you sent in 2023?
  18. Actively Reviewed typically means nothing is happening, the case is just waiting for its turn.
  19. I don't think having / not having SSN is related to getting EAD / AP / GC faster or slower. I recently went through I-751. My friend filed 2 weeks after me and got approved about 3-4 months earlier than me. We seemed to have identical cases. Sometimes it's pure luck. You could have applied for SSN when you entered the US on K-1. Now SSA unlikely give you SSN until you get EAD / GC.
  20. Are you in removal proceedings? If yes, then lawyer is right, cannot file I-130 and I-485 together. Otherwise, they're wrong and it's OK advisable to file both forms together.
  21. You were advised to leave it alone and let it process... Things are slow with USCIS. Simple things take weeks, months and even years to get processed. I hope you'll get the second one accepted in the next 4-6 weeks.
  22. I would not put too much hope into it. Of course OP is free to try. My point was, this is similar to how to I-485 cannot be adjudicated when no visa is available, even though the person is not seeking visa but GC. In this case there is no cap, but if no visas are issued it pretty much indicates the low probability of it being looked at.
