  3. Hopefully not when his current 10 year expires, but Resident Since Date + 2 years - 90 days. This is when his 90 day for I-751 opens. It should be filed before 2 year anniversary of Resident Since date. Good luck!

  5. Sponsorship as a service is what smells fishy in all of this. USCIS didn't build a marketplace for petitioners to shop for sponsors. The government doesn't need fradulent sponsors who are unable to pay back or aren't there if and when they're required by government to fulfill their obligations. I do not say what OP is describing 100% fraud or illegal. But it has all potentials to trigger fraud investigation by USCIS. If I was OP, I wouldn't want to be answering to immigration official how I knew / found the sponsor. Just imagine that: "I don't know him officer. I just paid $500 to get him sign I-864". I want to see officer's facial expression at that point. There's going to be large chunk of USCIS fraud unit involved in investigating this, especially under new administration.
  6. Your point about petitioner not needing to have relationship with sponsor is valid. However, would you sign paperwork for a random person? I wouldn't. If somebody wants to charge for it, there's just high possibility they're charging several people and committing fraud.   8. I've seen people reporting on VJ 5 year rule filers being approved much sooner while 3 year filers are still waiting... I think a lot of them have I-751 not yet approved though.

  12. You cannot file I-485 online. Only by mail. So since you'll be filing I-485 by mail, file I-130 and all other forms such as I-693 by mail. Send it all together. You must include I-693 with I-485. Your application will be rejected without it. And a little bit of legal detail... The only forms filed by US citizen are I-130 and I-864. All other forms including I-693, I-485 are filed by immigrant beneficiary.

    She's not permitted to enter B2 to help with childcare. It violates the terms of visa. Don't ruin your sister's US immigration history. Whether she will be approved or not depends whether she can convince US consulate she won't overstay in the US.
  15. By the way, why are you and not the spouse is completing the form? N-400 is her petition. She is expected to know in and outs of her case and all answers on the form. She's expected to know English and understand everything since she's seeking to become a US citizen.
  16. You can submit. For marriage based case you're recommended to come to USCIS office for the interview. Most likely, you won't be needed, but occasionally officer needs to talk to US citizen spouse too. For general provision, US citizen isn't required to attend at all. Your spouse may need to answer deeper questions about marriage and you if filing under marriage rule. Overall timeline for case may be longer based on 3 year rule, as it requires officers who know how to conduct it, more evidence needs to be reviewed and more checks into bonafide marriage may be needed.

  18. It depends whether your citizenship allows you to visit the US without visa on ESTA or you have to apply for B1 / B2 visitor's visa. Don't be suprized if ESTA or visa is denied though. You need to disclose US based relatives on application as well as whether anybody sponsored you. Once DOS learns you have US citizen spouse, your chances of approval will reduce.
