The description above is the question on I-130 for the petition for a child, my son, a twelve-year-old boy. He has lived with me and my husband in the U.S. for over 2 years. He did a great job in school, he is a honored student, outgoing, and always would like to help others . We have a loving family now. We believe he has happier life in the U.S. other than my hometown. Unfortunately, I did not get his custody at divorce because there is still Masculism in my hometown. I went back to the hometown in the summer 2019 after the divorce finalized. My son told me that he really missed me and wanted to live with me. His father already had his new life and did not want him. I brought him with me since then. The problem is I did not have my son's custody legitimately. the custody information is showing on the divorce decree that I need to upload to the I-130 application. I worry this would be a problem for us, thank you for all your suggestions and advice.

After we filed the petition for the spouse beneficiary, we are doing the I-130 form petition for the child beneficiary. There is a question : Where was the petition filed? after we selected that we have previously filed a petition for another beneficiary. Since we filed the previous petition online and received the receipt notice immediately after filing, how we can answer this question? Thank you.

His salary is the only source for supporting family. We meet other qualifications to file I-864EZ except item 2. Yes, we are the only person listed on each I-130 form. Can we file two I-864EZ forms or we must file I-864 form? Thank you. Who May Use Form I-864EZ? You may use Form I-864EZ if ALL the following conditions apply: 1. You are the person who filed or is filing Form I-130, Petition for Alien Relative, for a relative being sponsored; 2. The relative you are sponsoring is the only person listed on Form I-130; and 3. The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Internal Revenue Service (IRS) Form W-2s provided by your employers or former employers.

  6. By the way, the child does not file the I-130 form yet. Do you think we should file his form online or put the paper one with I-485 together? What is a better way to make this long application journey easier? Thank you.
  7. Thank you for all suggestions in advance. We feel a little regret to file I-130 form online for the spouse. After submitting, there is PDF form with watermark( Electronic Form Only) you can save to the local computer for your own record. However, the pdf version we saved through the website is not the exactly same thing we filled out online. For example, some ending dates are blank, the information order is different, etc. Next, we need to file the I-485 form by paper with the child together to save a little bit filing fee. Do you think we need to attach a paper I-130 form with the online receipt notice and other supporting documents to this package? We just worry that the new technology does not work really well.

For filling out I-130 online, there is a question called The beneficiary is in the United States and will apply for adjustment of status to that of a lawful permanent resident at the U.S. Citizenship and Immigration Services (USCIS) office in: Do I need to put the USCIS lockbox location allocated to the State I live?   11. Thank you, Chancy and Powerpuff. Yes, he does not have SSN yet. We have applied his ITIN number with 2021 tax return together this year. We did not receive ITIN number from the IRS yet. When he has SSN, the ITIN number would be void? I have no clue about this. Anyway, I will apply SSN for him as you said, thank you again.

He is filing two I-130 forms separately for me and my son, his stepson, a twelve-year-old boy. After submitting I-130 forms, we also need to file I-485 for two. Instruction :The filing fee for Form I-485 is $1,140. If you are 13 years of age or younger and: 1. Are filing with a parent’s Form I-485, the filing fee for Form I-485 is $750; When we put two I-485 forms into the package filling together, can we save some money? Only pay $750 for the boy? We appreciate your help!
