  2. Your ESTA application will get denied, i would be very surprised if it did not. It would be a red flag if your B2 was granted, CBP probably would have asked why you opted for that when you come from an ESTA country. It's best they come to visit you.

  9. I-134 is what you need for the K1 I-864 is what you need for the adjustment of status. You need to research the process and plan accordingly, you dont want any further delays on your case.

  11. You can apply yes…. But i doubt it will be granted. They will look at the spouse visa application and likely assume immigrant intent.
  12. I would apply for a spouse visa, it is a vastly superior option. Reminder for next time to let things cool down and talk about it before making rash decisions. Immigration is no joke and this could come back and hurt your case in the future. I'd get a lawyer at some point, good luck.
  13. You will need to get documentation about your mental health history from your doctor. I dont know how Germany does it, but in the UK we have to provide a summary of our health history and then extra information about any significant health conditions (physical or mental).   14. As others have said, invitation is not required. They will have to show strong ties to their home country and that is going to be more difficult if they are trying to visit for 6 months.
  15. If she were already in the United States then she could adjust status… but she isn’t. What you are proposing here is immigration fraud, you cannot enter the US with the intention of adjusting status. You’re better off getting married and filing spouse visa.
  16. Judging from the information you have given so far, sounds like she overstayed the last time she was here. Even just a 10 minute overstay with have you being denied an ESTA
  17. Hmm it is unfortunate that a K1 denial would end the relationship. No immigration progress is easy and when a K1 is granted… you still have adjustment of status, which is long and expensive. Can you not visit her?

  19. You will be fine as long as you get an ETA to enter Canada, and then you use your K1 visa (one time entry) to enter the United States. Congratulations on your visa
