  1. She has already shown immigrant intent through the immigrant visa…. So I honestly doubt she will get a B2
  2. The CPB officer can give you the 6 months (which is the max amount you can get on the B2) but not always. Or, for example, if you say to them you're visiting for 2 weeks, some might only give you those two weeks on the I-94.
  3. She can stay for an extra amount of time, but only if the date on her I-94 allows her too. It's important she check's the "admitted until" date on that so she doesnt overstay and lose her visa.

  9. I dont think it will be an issue. You have already spent 8 months in the K1 visa process and you are about over half way... i would stick with the K1 in this instance. If you hadnt filed yet, i would have suggested the CR1 visa as it is much better.
  10. If they are in the US currently, they can stay and adjust status. If they are outside the US, they will need to do consular processing. Entering the US with the intent to adjust status is fraud and you do not want to mess with that.
  11. You need to know for sure if she claimed to be US citizen. Because if she did, that will lead to a ban. Good luck with everything and make sure you get a really good lawyer.
  12. You dont really need to worry about the affidavit of support untl you get to the NAO2/NVC stage. However i would still get yourself prepared for when it comes. Remember to provide proof of meeting within the last two years.
  13. I highly suggest you file for a spouse visa, it is way more beneficial and they take almost the same amount of time as a K1, sometimes quicker. Although im surprised you were granted an ESTA with this history (althought i cant remember the exact questions to be honest). I agree with @Rocio0010 about filing for a Freedom of Information Act. You may need a waiver, you may not.... if i were you, i would consult an immigration lawyer at some point.
  14. Did she use someone else's name and SSN? Did she claim to be a USC? I would get a lawyer for this case.
  15. K1 and CR1 visas take about the same amount of time. CR1 is by far the superior option these days, way more benenfits and alot less money.... especially with the filing prices going up soon.
  16. Perfectly legal to adjust status from ESTA as long as you made a lawfull entry/currently in the USA and did not lie to the CBP office when you entered, intent is established at POE.   20. The maximum stay a B2 holder can be granted is 6 months, but it doesn’t mean they will actually get that. They could give you only a month or for example. It’s also risky not going with a return flight, they might believe she is coming to the USA to stay without the correct visa.
  21. Get it done as fast as possible. After the 90 days, she will be out of status and subject to removal proceedings.
