Hi and thanks in advance for any advice or tips. My now wife and I originally filed for the k-1/k-2 visa and were approved. She and my step son came to the US December 2023 after the approval. She loved it here, he HATED it here, did not adjust well and long story short we had to take him back home to live with her family. We explored other options like me taking him back home and leaving her here but there were some concerns about a foriegner traveling alone with him in the philippines, she didnt have a family member here that could travel back with him and we were not going to send him unaccompanied. So she unfortunately had to leave to take him back home. While I'm sure many will say that we should have made him wait and then filed for the parole adjustment but you will just have to trust me, that would not have worked so we made the decision that we did. He just wasnt doing well here in the states. We never broke up, never withdrew anything as we didnt feel there there was any need to. We just planned to get married later than we originally anticipated. She did leave before the k-1 expired so there would be no problems with overstaying her visa, we are now going to have to go back through the long, hard process of filing for the cr-1. We did get married via the Utah online process but I went there to the Philippines for us to be together with her and her family during the ceremony. We could not get married the tradional way in the philippines because I could not get away from work long enough to meet their guidelines to legally marry there. So now we are legally married, filed CR-1, ROM, etc and are concerned about them asking why we are doing this again and didnt just get married when she was here. As simple as it may sound no-one can walk in your shoes when trying to make such a difficult decision. We dont want them to deny us and we cant imagine what kind of RFE we could get since they have all of our previous records on file. In fact I wish (of course not) that it would expedite the case having already been approved and familiar with our file. I searched for a similar case on here but couldnt find one. If anyone can give us a little insight as to what to anticipate or if we should anticipate delays due to the unusual nature of our filing we would appreciate it.

I was just looking at this yesterday and was told that you cannot get married in the philippines on a short trip. One person even used the words illegal. I think you have to go to the counseling, then register then wait 3 weeks to get a date from the judge. You also are supposed to have something called a capacity to marry certificate (I think that is what it is called) but since the US doesnt issue then you have to write an affidavit with the same info BUT you have to get an appointment at the embassy to have it notarized...and the appointments are at least a few weeks out unless you get lucky and someone cancels. One of the experts can jump in and clarify if I am wrong. Good luck -
Hello, After reading the quideline and searchign the forum I unfortunately do not have clarity on this one item and could use some assistance. My fiance camt to the US on the k-1 visa and with her my step son (k-2). In the guideline it states that when filing for them to receive an ssn, the k-2 will need a valid EAD from USCIS. He is 9 years old and will not be working for the forseeable future. To obtain the EAD we would have had to file the form I-765, Application for Employment Authorization along the way but never did or were aware we needed to prior to comign to the US. Is this just an oversight and not intended for minors nor intended to work and the EAD isnt really required?

in retrospect our process went pretty smoothly. I was extremely upset that we didnt get to fly back together because she was truly new to travel but she flew a week after I did and I videoed everything on the way back including the immigration officers lol they laughed because they could hear I was narrating for her and nobody complained. She did fine and arrived without a problem. -

As it turned out it definitely is...my interview was dec 5th and our CFO intervieew was over and done with by dec 20, she was on a plane here on Dec 22. You will be fine my friend Good luck to you both. -

We just finished our appointment and were approved. Children under 14 years do not need to attend. You just need all of their documentation. Good luck to all still waiting. -

Please disregard. Under 14 years old not required to attend per the letter from the embassy. We only need to bring his documents. -
We have our appointment today at the embassy. My fiance son is sick and he is applying as a k2. Does he need to attend the appointment at the embassy? He is 9 years old.

Good morning, I believe you said your appointment was yesterday so I hope you were approved and yensions have been reduced with you and your loved one.

I think this is the choice I would take too. Knowing that we are one step closer does relieve some anxiety and once approved the visa is good for 6 months so plenty of time to get the children tested so they can have their visa approved. I dont think that children are required to have an interview at the embassy (someone can correct me) so it seems that once the tests are available and the children pass they can be issued a visa and you will not need a new embassy interview. Other more experienced members can clarify but that is the choice I would make.

Hi, We were actually not told anything about the test shortage. My fiance just happened to look on the website a day or two before our appointment and happened to see the nitification and that prompted me to make this post. I think they put the notification on the website in anticipation of running out and we were just one of the lucky few that got in before the test were all gone. A courtesy call to each person with a scheduled appointment would be nice but I thik too much to anticipate or expect. This is the Philippines and things dont always go as planned there.

thats so strange because my son went yesterday and completed it all. I am thinking maybe they have a shortage and at some point will run out so they are setting the expectation low to minimize drama when they eventually run out for real.

Also, I was too afraid of some kind of mishap, the tb test results or some other craziness to schedule our medical that close to our interview. My nerves would be a wreck in that 9 day period in between. Good luck.

ok, I dont understand what happened...but when she checked in she was told that there was a shortage on the tests and she would have to bring my son back and they would call to reschedule. Then when she got upstairs they actually did the test. So apparantly there is a shortage but they still have some as of today. I agree with the other poster, I would not reschedule my appointment either.
