  3. A friend of mine waiting for visa under family based F4 category received interview call yesterday July 13, 2023. However the interview date is printed as February 22, 2023 - which is already past. I guess it is a system error. How do you fix this. Calling NVC or the consulate where the interview is scheduled. Anyone been thru similar situation before?
  4. The name “Dual Citizenship” is a misnomer. Once you obtain your US citizenship, it is up to your home country to dictate whether you can still keep the citizenship from that country. For example Government of India do not allow dual citizenship. Once an Indian citizen obtain the citizenship of another country, they lose Indian citizenship. So check with your home country to see if they allow this. US government doesn’t have a problem unless you are from certain countries like North Korea etc.

" No I don't think so. They never schedule interview until a visa number is actually available. So in you case, a visa number was available and since the CO said your visa was approved. So it is just the usual processing delays. Wait for couple more weeks.
  6. Since you are a US citizen with a US passport, your entry into US will not be a problem at all. Whether you have a job here or not. But if your husband is not a US Citizen, you will need to file I-130 and start the immigration process. I don't think that he will be allowed in with you under the exceptional circumstances rule. And since your spouse has an immigration intent, I doubt if he will be issued a visitor's visa!
  7. Although the visa numbers for immediate relatives of US Citizens (Spouses, parents and minor children of US Citizens) are always current (because there no numerical limitation or cap) the actual process takes about two years for most applicants!
  8. The beneficiary is 22 years and 7 months old. Deduct 2 years, 3 months and 13 days from his current age. That is his CSPA age. So if the PD became current today, the beneficiary would qualify for visa. However there has been a change in CSPA age calculations since last February. This allows the beneficiary gets to calculate his age based on chart B of the visa bulletin and age freezes if the date in Chart B is current! Although the change refers to all candidates, it was reported that this calculation is currently limited to AOS applicants. The visas processed by DOS do not allow this. If anyone has firsthand knowledge on this please chime in!
  9. I have used the form and filled my beneficiary’s (principal immigrant) address in India and the PIN code (that is what zip code is called in India) without any issues. My form was accepted and has been deemed documentarily qualified.
  10. No. LPR was not threatened with revocation. They just told the child to be taken to a county hospital and have tested for TB. The parents did as they were told and complied. Testing was completed and was found negative! Was send back home and they have been living happily in the US for the last 18 months! Child is in school and both parents are working full time. One other sibling started college last year! She is pursuing a degree in Pharmacy!
  11. A F4 derivative child from India who was flagged in the Medical check up and later cleared was issued the immigrant visa along with the parents! They arrived here in New Jersey. Local health department contacted the new immigrants and told them that the child has to go for TB testing and if needed medication! I don’t know how the local health department came to know of this! I am assuming that all immigrants who had tested positive for TB at any point of time are referred to the local health departments in the address they provided!
  12. Your PD is current as per the latest visa bulletin. For F4 - the PD is current to 15 December 2007. Since your PD is in February 2007, something is out of ordinary. You should contact the US consulate to find out (in my opinion).
  13. You can pay estimated taxes thru a payment voucher at the end of each quarter. If upon calculation, it is determined that too little taxes were with held, fill out a payment voucher or use their online system (both State and Federal) to remit estimated taxes! I recently remitted my estimated tax dues for 2022 on January 21, 2023. Soon after I filed my tax return for the year 2022. There was a small refund due from federal return. I got it already! Some employers don't like the idea of the employees having a second job! Also there might by conflict of interest issues. For example: I work in the Pharmaceutical industry. If my employer, ever finds that I have a second job at another Pharmaceutical company, I will be terminated! So the OP should also find if he ever signed an agreement involving conflict of interest with Employer A!
  14. Based on the last time there was any movement for F2B (Visa bulletin July 2021 it moved from. 22nd August 2015 - 22 September 2015) there is probably going to be a 3 to 5 year wait before your PD becomes current! So hang on! That is all I can predict!
  15. I filed my 2022 taxes three weeks ago and got the Federal refund credited to my bank account yesterday! From NY State, I got the refund two weeks ago!
  16. What is your Priority Date? Then look up the Visa Bulletin Chart A and see if your PD is current. If the PD is not current, no haste on your part is going to move the process any further. There are people with current PD and DQ dates earlier than yours who are patiently waiting!
  17. No transit visa required. They (your parents) cannot go out of the airport terminal. The three hour layover is very common in International flights! There is enough restaurants, shopping area (even for window shopping) and rest rooms just to kill the three hours. It is not even three hours. You have to be at the departing gate at least 30 minutes before the flight!

  19. While on the subject, the USCIS web site says the I864 submitted do not expire. I submitted the I864 in 2020 with the tax return and W2 from 2019. In the I864, submitted in 2020, I reported the adjusted gross income for 2019, 2018 and 2017 in Part 6 (24a, 24b and 24c). It is over three years now! Looks like my sister's F4 priority date might become current soon and she may be called for interview. Is it a good idea to upload the tax return and W2 from 2022 and report the income from 2021 and 2020? I do not need a joint sponsor. I just want to ensure that the process goes smooth and she doesn't have to go back to the consulate a second time!
  20. Here is the copy of an email received by one of the families. I have redacted the name for privacy. "We reviewed this petition for eligibility under the Child Status Protection Act CSPA and we determined XXXXXX is not eligible. If you believe we made a mistake in our CSPA determination, please notify us at https://nvc.state.gov/inquiry. Please note that the NVC's CSPA determination is not final. A final determination will be made by the Consular Officer at the time of the applicant's interview". If what you say is true, the last statement "A final determination will be made by the Consular Officer at the time of the applicant's interview" need not be there. This derivative applicant's name was not in the original welcome letter. The request was made to add his name and the fee was paid. Then the above email was received. When the interview call was received, the derivative beneficiary's name was not there either. When the parents went for the interview, yet another written request/appeal was given to the interviewing CO. He read the request and asked the parents to wait. After about 15-20 minutes (he went inside and discussed this with someone, I am guessing), he came out and informed the parents that he would allow the derivative applicant's visa and gave him a date for interview. The derivative applicant finally got his interview in October, 2022. He is now in the US. I calculated the CSPA age for this beneficiary multiple times and found that the beneficiary had aged out by about 8 months. So I believe that it is not cut &dry as it sounds. There is some leeway that the CO can apply to cases like this! I am not sure if this had anything to do with Covid shut downs. The consulate was down for almost a year in 2020.
  21. The CO has some discretion! I know this for a fact. Two families who recently immigrated had children who aged out! Their names were not on the original interview calls. But after their appeal during their (parents) interview they were all allowed visas.
  22. If the sibling who is 24 now gets the benefit of CSPA, his current CSPA age is 19. If the PD becomes current in the next two years, he might get it too! Also I recently learned that some derivative beneficiaries were given some consideration due to the pandemic! It will really depend on the CO at that time!
  23. So the derivative beneficiary will get a 5 year advantage. F4 priority date is current to 22 March 2007 for Pakistan. As of now, it takes about 16 years for the PD to become current. Your PD is July 2010. Add to it 16 years and your PD may become current in 2026. At that time your derivative beneficiary will be 21 years old (current age plus 3 years). Subtract the 5 years CSPA allowance and his CSPA age will be 16 years. He is well within eligibility to receive the visa - provided that the F4 progresses the way it is progressing now!
  24. What is the country of chargeability of the principal applicant? (Place of Birth). This makes a big difference. In F4 category it will be many years for the priority date to become current! Some countries like Mexico it will take over 25 years for the PD to become current.
