Hello, my in-laws entered the USA on an IR-5 visa yesterday. At their POE they had one sealed envelope and another unsealed envelope which contained their birth cert, marriage cert, name change, police cert...etc - basically all the paperwork that was submitted to NVC. The immigration officer kept both envelopes after going thru them. Is this standard operating procedure? I believe they keep the sealed one but was wondering why they took the unsealed one. Will they get that envelope back?
The unsealed envelope is definitely not a thing, I wonder why they brought that? I hope they weren’t originals. If so, you can sometimes find a number to a POE, maybe give them a call and ask if someone put it aside.

You should get MTL’s input on this, personally it’s cutting it close, but who knows, they may cooperate with your schedule.

Usually 6-8 weeks for the missing document to be reviewed by a CO.

Judges don’t sign off to proceed with filing. I think you mean, did judges rule favorably on a WoM? The vast majority of WoM don’t proceed to a hearing as the lawsuits are dropped when the visas are issued.

All I can say is I'm very frustrated between the lack of communication between the departments of the consulate because had they told me they also needed the facility to confirm my employment along with my police record in the initial email, I could've been approved back in December. Anyways I'm happy I don't have to go through this hell again and I feel sorry for anyone who's still waiting to be approved despite waiting months.
Gotta love bureaucracy

A simple (estimate) should suffice. They just copy paste the data into whatever portal they’re using to submit it.

No, I wouldn’t. In my opinion the form should be true on the day you submit it - anything after that is 🤷 because 1) They don’t mention this 2) I have a feeling it will delay clearance further

Today I received email notification via DOS visa system that passport is being returned.
case status date was updated today, Feb 23 but still showing refused. Is this just them simply returning passport on my request? 10 days later of replying to my last email without referencing passport to be sent? Why would they have not sent it back the day they responded to email?
glimmer of hope or fat chance? Interviewed in Nov and placed in AP DS5355.

They only send out on certain days, and it takes a while for it to go from the consulate to the third party mailing site, so it’s completely reasonable that it’s just your passport as you requested.

I received an email from the consulate today! It was in response to an email I had sent to Montreal-IV-DV@state.gov inquiring about what supplemental info they needed - email was sent 14 days ago.
I'm not sure when I would have received these questions had I not reached out to the consulate directly, so I would advise anyone else in a similar situation to reach out directly to the consulate if you are awaiting next steps after your 221(g) was issued. I was kind and respectful in my initial email, and included all of my pertinent information.
The email asked me to supply a variety of info including:
- My passport and travel history
- Info about my relatives
- My address history
- Contact details history/social media history
- Employment history
A few questions:
- It mentions an OMB number and the expiry is a date in the past (Feb 28, 2021) - is this a mistake on their end/something I should be addressing? It also says the estimated burden is 60 minutes. This is going to take me a lot longer than 60 minutes - I've been to over 20 countries in the past 15 years and have held numerous different jobs too. What do they mean by burden?
- I already submitted a lot of this information on my initial application - is it better for me to just put it all in again? I would hate to omit anything and face even more delays
- There was no mention that this was DS-5535 - is this email considered DS-5535?
- For anyone who does have extensive travel history, are there any tips for ensuring you get the dates/length of stay correct for places you've visited? I unfortunately do not have all of my receipts for flights, etc. over last 15 years and don't want to make any mistakes!
1. Ignore that OMB stuff, it’s equivalent to “Office Use Only”
2. Check the email carefully again - unless they’ve changed it, there’s wording that says:
“Aside from your name, date of birth, and visa classification, please only provide information not included in your current visa application. For example, if all of your children are listed in your current visa application (Form DS-160 or DS-260), you do not need to list them again. “
3. Yes.
4. Check all your former passports, the entry stamps will help. For US visits, you can look at your I-94 online.

under your refused status, the text say:

That longer refused text usually means you’re still in 221g AP (background checks, etc;)
Final denials have a different text, much shorter.
Try the IVDV email - you may get someone over there to forward it to the right person.

How do you know you’re approved? They could be returning it because they can’t issue yet due to AP. Unless your case status is Issued, you’re not yet issued.

This is pretty bad actually. You are chargeable to Uzbekistan, and claiming a different country (even within the same region) makes it appear as if you are trying to cheat the Uzbekistan limitation.

Results were announced May 2020, so you waited 10 months before you submitted your DS260. If you ever win again, you need to submit your DS260 much earlier than that.

you as I also filed a restraining order. Standard WoM timelines are 2-4 months from filing to visa, if the WoM is effective, and assuming you are in fact eligible for the visa.

1. They don’t want anything of that for 5535
2. If your passport expires before clearance it will be returned to you (if not already) and they will ask for a renewed one before they can issue your visa.
