I have been assuming that in order to judge how someone would support themselves in the US (or if at risk of becoming public charge) the officer would look at the totality of factors such as work history and government benefit receipt while in the home country…of course, in addition to medical & criminal history and whether the spouse/joint sponsor could also financially support this person. Good to know that is not the case.

I agree and think you have a high probability of being in NY for Xmas this year! And NY is the best at Christmas time. Although, I do really love Manchester and the Christmas markets, too! From the pattern I’ve noticed, you will more than likely get your interview for end of November 😊

Np! Yes, he has completed ds-260 and it was accepted at NVC. They ask things about work and education history, family info, address history, etc., but nothing at all about having used public benefits outside of the US. Will your husband earn enough financially to sponsor you, or will you need a joint sponsor? Luckily, I earn enough and we did not need a joint sponsor, so I am hoping that will be the main thing they want to see for public charge, along with a clean bill of health and no criminal history.

Thank you for asking this. I have been wondering this myself, as my husband (UK citizen) receives universal credit in the UK. Our petition was approved and subsequently DQ’d at NVC. His medical is Oct 2 and our interview is Oct 25 —so if you can send me a reminder after the 25th (I’ll try to remember on my own!) I can let you know how everything goes and if it was even brought up at the interview.

Nice! My husband scheduled his today. I know it’s before the interview, but I completely forgot to ask which day. He was on the phone with them for 50 min, though, so just be prepared in case you guys have a long call too

I hope so! I did read in this thread that some got the IL in the beginning of the month. So maybe it’ll be right after Labor Day!

I read a post on here recently where someone had to do random testing for alcohol for one year before they’d pass them on the medical. I believe it was due to some criminal charges involving alcohol, but I can’t remember the exact circumstances—I’ll try to find the post and will link if I do. Of course, these could be totally different circumstances, but just be prepared that this is a possibility.

I think I know the answer here, but have been searching for confirmation and cannot seem to find anything..so hopefully someone here will know. We are DQ’d and now just waiting for our IL. After DQ we found out I am pregnant (petitioner-US citizen). Of course, all of our forms were filled out for a household of 2. Is this any concern? Do we need to change household size to 3 in anticipation of the birth? Since UK wait times are not long, the birth should happen well after the interview, and even well after the beneficiary would enter the US. I am assuming the household will stay 2, unless the baby is born before the interview.

It took 9 days for us to get DQ. I just checked the NVC timeframes and it says as of 08/28, they’re reviewing documents submitted 08/17. -

We got DQ’d on 08/17! Patiently (not really lol) awaiting the IL. I am hoping we get that any day. Ceac still shows the case is at NVC, though. But not sure if that only changes to the embassy once you receive IL? -
Some things we did: Wills naming each other as beneficiary, Life Insurance policies (I did this through my work since we have guaranteed issue policies, so no medicals needed), a few chat logs, Apple Family Share (we have that set up), social media history from FB, which luckily we had going back quite a few years (you can display just your activity with each other in there, so I printed that), postage and customs slips of packages we sent to each other over the years, receipts for gifts that we sent directly to the other’s home address (that way delivery address was on the invoice), cards with the envelopes they were mailed in, so postage dates could be seen. You can add a joint account holder to a Wells Fargo ( no ITIN or SSN, can just use foreign birth certificate and foreign passport). I also added him as an authorized user on my credit card (Apple’s Goldman Sachs card doesn’t require a SSN for authorized users). I just want to add, for bank, credit cards, basically all the legal paperwork—-we did all of this about a year before petitioning..I think doing it last minute, right before submitting, would look almost forced and for show. With the exception of Life Insurance, I added this about 5 months prior to submitting the petition. We intentionally delayed our petition a bit because we wanted to make sure we had good, solid evidence, and lots of trips to see each other after marriage.

I-130 and I-130a questions

1. Put them all. Add them in the section at the end if you can’t fit 2. You choose the consulate on I-130, so fill out accurately. 3. Visits do not mean you ever lived together 4. I don’t remember the wording for this question. But if it doesn’t say put ‘student’ as occupation, then don’t. You can put unemployed and then in the ‘additional info’ section, you can mention she’s a student, if it makes you more comfortable 5. I put ‘not applicable’ 6. again, you choose the consulate on 130, so I don’t think there is any need to emphasize this. -

You need to contact NVC via the public inquiry form. I think that’s all you can do - it’s what it says on their timeframe page. You definitely should’ve gotten it by now - their timeframe page shows on Aug 14 they were working on cases from July 11. edit: I just checked and it says public inquiries from Aug 8 were being reviewed as of Aug 14. So if you just reached out, it will probably take a week for a response. -
We have never had any issues during the process. My husband has visited at least 5 times during the process and never even got asked a question about it, just the usual. Before we started the 130 process, he did visit me in the US about 4 times, so had a short history of US travel. He has come through both JFK and preclearance at Dublin. If you check some of my comments, I have gone into details of our experience in one of the mega threads. edit: I just wanted to add, even though he never got questioned, he always does bring some things with him to show proof of ties to the UK. So something like your kids school reg, lease, letter from work, paystub, etc. would be great to bring along.

You probably confused them if you worded it the way you wrote it: “want to adjust status continue with our journey out of the Sydney consulate”. It sounds like you’re saying you both want to adjust status in the US and also want to move it OUT of Sydney consulate —I know you didn’t mean it like that, but a customer service agent could easily interpret it like that on a phone call. You are not adjusting status and you want to stay at Sydney consulate. You would chose 1d. My suggestion is to read every question slowly and carefully, as they are almost always worded very clearly and are literal in what they’re asking. Also, read the instructions before and while you are filling out forms, as that clarifies a ton, too. Start studying for the NVC stage now so you can be prepared! -

Your best bet is to check China embassy reviews on visajourney. I only read London reviews, but it seems like most people without issues receive their passports with visa stamp in a couple of days. But, that’s London. China may be totally different, I’m not sure. -
I know the applicant has to bring their original/certified copies of documents to the interview. My husband left his marriage and birth certificates with me in the US accidentally, so rather than wait for his new certificates he ordered to arrive, I just uploaded the ones I had here to CEAC. Just to clarify, the document/registration numbers on the ones we uploaded on Ceac and his new ones are, of course, different. So let’s say: marriage cert uploaded to Ceac: A birth cert uploaded to Ceac: B marriage cert physically with husband: A1 birth cert physically with husband: B1 So my question is, can he bring the newly ordered birth certificate (B1) and marriage certificate (A1), or does he need the ones uploaded to CEAC (A & B)? If anyone has any first hand experiences at London Embassy where people have brought originals, but not the same exact ones uploaded, that would be great! Thanks!

When you say you click to open them, do you mean once you’ve already uploaded them to the 130? If that’s the case, my first suggestion when something like this happens (with any website) is to try using a different browser. My second one would to remove and upload them again. It won’t let you upload if you aren’t using the correct file type or size.

Check out the UK embassy review page here. People post their experience during the interview and lots share the questions they were asked. It seems like most of the time it’s: how did you meet, what does the petitioner do for work, how did the proposal happen. It sounds like it’s generally just a few, basic questions.

If I were you, I’d wait until I hear back from them. Since they told you not to do anything but wait and also kept your passport, I would follow instruction and do just that. It sounds like they need to review/investigate something —and if they need anything further, they’ll contact you. I know it sucks waiting, but we have all been doing it forever now, so at least we are patient!
