Hey guys, Got another quick question- do you think it’s possible with my history to get a Tourist visa to attend my fiancees graduation in may? The K1 will already be filed by then.

It was a refused admission, no removal or anything. you sure I can ignore the whole section? I saw a YouTube video guiding through the I129 says to fill out regardless.. So I leave it completely blank and don’t even put the I-94 record number or my passport number ? Ok, so 38a. - 38h. stays blank?

This is what my I-95 says. Shouldn’t I put that exact information into the I129 form as well then ?

Makes sense. I just don’t know if I should include my last actual visit where I stayed for a semester aboard in 2021, or where I was refused admission at POE while traveling with ESTA. I should go with the most recent entry on the I-95 probably, which would be the refused admission one?

Hey, i collected some questions regarding the K1 process as information differs in some ways across the internet. Proof of relationship: Is it appropriate to include booking conf., boarding passes, 1-3 photos and maybe screenshot of a text message for each occasion where my fiancée visited me in Germany ? She visited 4 times in the past 2 years and we also had two vacations. So that would already be quite a lot documentation I feel like, maybe too much? Title Page proof of evidence: In the K1 Guide it says to include a single page that has a brief description of the last meeting (same text as in Form I129f) and a list with all the evidence provided. On the website of a law firm it says to include a declaration letter that goes more into a detailed description of the relationship, the sample there is about 1 page long. Does someone have an opinion on that ? Documents to include - I-95 travel record: Is just this one page that you can download, or is there more to it ? - My last attempt to enter the U.S. was refused (ESTA), hence my I-95 says “UNKNOWN” for “Stay permitted until”. Should I put this in the box on the I129f? -Should I include my passport (beneficiary)? So far we included the front page and my US visa page with the stamps -Should I include sth like a transcript from the school I went to as an exchange student in the US? If someone takes the time to reply to this, I would be really happy :)) thank you! Michael

Okay, great. Yeah there was none, they just didn’t believe me that I wasn’t going to overstay or just use an F1/J1 to stay with my girlfriend

* I know K1 is still non immigrant, however I would obviously confirm immigration intent

Btw, I am the beneficiary here and she’s the US citizen. I had visa refusals in the past (J1 & F1) after my entry with ESTA was denied at POE in 2022. They assumed that I had immigration intent due to my girlfriend. The denials came based on that as well basically (214b). I only had the right intentions and really wanted to get my masters or some practical experience from the States, however assuming immigration intent isn’t far fetched when a girlfriend from the U.S. is in the picture. Do you think this harms my chances for an immigration visa now ? I heard it actually strengthens my case (?)

Okay. I just saw that the initial filing fee increases to 675$ starting April 1st. I didn’t see any info on the AOS costs. We considered the spousal visa, however still prefer the K1. The financial aspects shouldn’t be an issue. Thank you

Okay, thank you I am very passionate about gaining more experience (Professional/academic) in the States after my successful semester abroad, it is my goal so I want to explore what might be possible. Sorry, but what do I have to do with Argentina? I did not have the intention to stay when I came on ESTA. I had my returning flight to Germany booked already and overstaying was never on my mind. There is even proof for that in the conversations with my girlfriend on WhatsApp, which did not get acknowledged back then. They managed to get misleading statements from me when asking about my future. I mentioned a potential future internship or a masters degree in the US. That's when it went downhill. I could have never imagined back then that my statements were leading to a refused admission as it was just so obvious for me, that for working, studying or whatever I would need to have the according visa. In hindsight you're always smarter.

I don't really know what is wrong with having the desire to come to the U.S. on a non-immigrant visa. I did nothing wrong on my previous J-1 stay and I do not have any wrong intentions. I also would be adding to your country's economy with an internship or with the masters program I got denied for..

Thank you for your replies so far! No, I was not. last year in July. I had a good time during my semester abroad and already decided back then that I want to come back for studies or some professional experience. No, I do not have my girlfriend anymore. I truly believe my ties to Germany have to be strong enough anyways. I have been living here for over 24 years now. All of my close family lives within 10 minutes from me. All my social life is here. I am playing soccer in a clubs team since I am 4 years old. Now for over a year I am working a job here in strategic marketing. However, I want to get more international experience (right now preferably with an internship) in the U.S., not somewhere in Europe. Currently my question here is only this one: Do you guys think a J1 visa for a paid internship is a better chance than the F-1 visa where I had my denials? Hi, I am from Germany and had two F-1 visa denials (214b) in the past. The reason for that was a refused admission, trying to enter the U.S. as a tourist on ESTA. I gave the officer at the airport misleading answers. Hence, they refused my admission. Some time has passed. Now I am ready to pursue another attempt. I have been working for a global company here in Germany and besides applied for internships in the U.S. I got accepted for one internship so far. However, it is an unpaid position. I am still trying to find a paid one (if anyone has some advice on where to search as an international, feel free to comment on that). In general, I want to know if you think an J-1 Internship has a higher likelihood of approval for a visa in my specific case, compared to a F-1 student visa. I am looking forward to your insights!
