    No, only citizens are qualified . I got one, too a while back.on the note i got Was a webpage where you can say that you're not qualified due to bot being us citizen

    That's exactly your situation, as I see it- be honest to the officer about when he moved out and that you can't file for divorce now, plus that this is not your goal but rather want to work it out.     Ok....no timeline, so it was a bit confusing...at least. But again, the fact that you are a naturalized citizen, unfortunately has no impact on the 10 year ban that happened because he overstayed his visa🤷‍♀️ those are the rules and they get enforced. Sorry for the situation, it's really unfortunate 😕

    Updating your timeline would clarify things- your previous posts only mentioned you're a LPR🤷‍♀️but anyways, even as a citizen, you won't be able to shorten the ban for your dad who overstayed and due to that got a 10 year ban, unfortunately.

    Just file I-751 the day your 90 day window opens- you'll get the NOA / extension within a couple of weeks and are safe.

    I did add joint credit card account statement, proof of adding my wife to benefits ( life insurance, vision, FSA) in addition to the stuff they got already for the I-751.
