  1. Hello I am wondering if there are any time based exemptions of the 5 years for the mentally and physically disabled to file the N400.

From US embassy website in South Korea Consular officers at U.S. Embassy Seoul may accept filing of the Form I-130, Petition for Alien Relatives, filed by a U.S. citizen who is a U.S. government or military employee assigned to the U.S. Embassy Seoul, U.S. Consulate Busan, or a military service member stationed in Korea, for any immediate relative.

  4. This is what I found also but I was looking for where the embassy found this rule. I would like to have something to show in the instance we have another over zealous CBP officer. But I will also pass the advice of asking for a supervisor.
  5. I am concerned about abandonment of my families LPR status. I am retired US Army and currently working for the Department of the Army in South Korea on official orders. All of my family are listed on my official orders to reside with me. My family migrated from Colombia to South Korea directly in May 2021 and has never lived in the US for any amount of time. I filled I-130 forms in May 2022 and we interviewed at the US Korean embassy in July 2023. In August 2023 we visited Guam from Korea to activate the visas to obtain the I-551s. The I-551s were delivered to my military address here in Korea in Sep 2023. My family has been living with me here since that time with no extended stays more than a week in continental US. I have already filled for naturalization for my spouse under the 319B program. From a few things I have been told and read that living with a "sponsor" while working overseas in an official capacity is viewed as the same as residing in the US. Upon a visit the US recently my wife was informed she needs a re-entry permit due to her extended absence. She notified the agent that I worked for the US government and showed her the relevant paperwork. The agent wanted to fine her and noted her account of her extended absence. What I need help with is what are the rules governing US government employee families about LPR abandonment? Which codes in the CFR or other manuals I can use to educate myself and the agents in case we need it for our next visit to the US.
  6. Hello everyone. Applied for the N-400 today for my wife today. Applying under 319b since currently working for US company in South Korea. Swearing in location is Dallas, TX because she wants to change / shorten her name. Received my Notice of Receipt almost immediately but no reuse of biometrics :(. Time to approval is estimated at 9 months.
  7. 8 CFR § 211.1 (6) A Form I–551, whether or not expired, presented by a civilian or military employee of the United States Government who was outside the United States pursuant to official orders, or by the spouse or child of such employee who resided abroad while the employee or serviceperson was on overseas duty and who is preceding, accompanying or following to join within 4 months the employee, returning to the United States; or
  8. Thanks for the clarification and I guess we will be taking a small vacation to “activate” the visa’s. I don’t believe I need to do reentry permits due to my employment status of US entity. Yes I am aware of this and that is my next step as soon as she has her green card.
  9. The visas expire in Dec 2023. From what I have been reading if I am working overseas for an US entity then requirement that states a green card holder cannot leave the US for more than 1 year doesn’t apply. I am very interested in what starts the process. Are they required to enter? I am thinking of sending an inquiry to USCIS and the embassy and await an response.
  10. Hi, I am currently working as a US Gov employee in South Korea. My wife and step children were recently issued the I551 temp visa’s in their passports. I understand most of the implications that affect her green card status while residing with me here but I am confused if they are required to enter the US to start the green card issue process. I have already payed the immigration fee and the interviewer at the consulate was fully aware of my status here and that I would not depart for a few years. Should I contact USCIS to make sure they are aware of my current situation and not to expect the family members to enter the US till the end of my tour here? Will any of this delay the issuance of green cards? TIA Elliott&Dora

I have similar questions but upon a little research I learned that you have to use this website (USCIS case status https://egov.uscis.gov/casestatus/landing.do) with your receipt number when you paid the USCIS Immigrant Fee. It will change the status on the green card is printed, issues, etc. There is a large discussion about this in the forum below. Hope this helps.
  12. I did file a separate I-130 for each person but the I-864 applied to all once I submitted on the NVC site since the applications are linked to each other. For the evidence I just submitted it the same for each person. My first attempt resulted in RFI's which caused me to submit more than enough evidence and I just mirrored all the applications the same for evidence which resulted in DQ's.
  13. My case is similar to yours but even more complex, My family and I live in Seoul, South Korea and my wife and step children are Colombian. The CR1, IR2 x2 all DQ'd on different dates. Two of the cases requested RFI's but in the end was DQ'. All the interview dates was scheduled at the same time. I will say it took two weeks after DQ till I got the interview notification in my email. Good luck
