    I just wanted to add that something similar happened to my husband and myself. We had hired a lawyer for his previous divorce (also in Nigeria). When we gave the documents to our lawyer in the US, he told us we basically didn’t have the right documents and that we needed the divorce absolute (I think that’s the name) and then we would have to get remarried for it to count. We luckily did all of that before filing. 
     
    I say that to say that not everybody is fraudulently obtaining divorce decrees on purpose, unfortunately the lawyers are greedy and cutting corners there. 
     
    Anyway, good luck to yall on this long journey!

    I wish we did our due diligence. I was so eager to file the case that we didn't get to talk to any lawyer. lesson learned.

    Ok, we've looked over the link you sent, and that makes a lot of sense. We were wanting to start the process of the waiver but were told by our attorney and a different attorney that we can't file a waiver until we are told that a waiver is needed. 
    Also so prior to him getting arrested he hadn't been in any trouble. He got arrested for driving with a fake license and once they realized he was out of status he was moved to the immigration holding facility

    There is no set time for a response; depends on the complexity of the case, the number of other advisory opinions they are working on, whether they ned more information, etc.  You cannot reach out to them directly.
     
    I believe the overstay will include all of the time from when he started the overstay until he departed — there is no way they could speculate that “but for being arrested” he would have left any earlier than he did.

    Hello All,
     
    We got our Sydney CR1 interview emailed letter today so I wanted to share for those of us who have been obsessively waiting on a timeline update 🙃.
     
    Our interview date is October 18, 2023
    Our DQ date was April 7, 2023
    That makes it 4 months 7 days before our date is set, with an additional 2 months 3 days from reciept of the letter- so just over 6 months total from DQ to interview date. Hope this helps someone.

    The attorney is correct.  Your husband may or may not have a bar to entry.  The Consulate Officer will inform him of any inadmissibility and waivers at his spousal visa interview.
