The attorneys who advised you not to withdraw the moment your divorce was finalized, gave you the advice you wanted to hear . Strategic…I understand. Because I assume you did not have a new wife on the back burner ready to file for you . Hope you also clearly understand the Timeline of your new romance will be VERY scrutinized ..and they will try to use it to discredit bonafides of first marriage

Draft one Letter of Withdrawal and reference the I-130 and I-485 case numbers on it . Spend a bit of time on that letter and show your marriage was in good faith plus ADD any additional evidence not previously submitted. If ex is on decent terms ask her to do an Affidavit stating the same . Have her notarize it with a Jurat ( not acknowledgement).. If any other family/friends, priests, rabbi or imams ..that knew you as a couple are willing, have them do the same.

Yea I have tons of evidence from my first marriage as well . I never had issues with my first marriage. I assume the issue was with my joint sponsor . We had interview twice and was separated on both occasions. ALL our answers were the same on both occasions. The second interview was for almost an hour and it was based ENTIRELY on how well we both know our joint sponsor and how we met him . ALL our answers were the same . You will need all that evidence . Also need to be prepared to defend your actions ( failure to notify of divorce and EAD renewal) when they try slapping misrepresentation/fraud in obtaining EAD . Be prepared that they will either go or have already gone to old neighbors/jobs to investigate your first marriage. Did you have an attorney for the two Stokes interviews?

Your I-485 and its EAD is no longer valid since the day of divorce from Wife Ones I-130. The only reason it was renewed was because you failed to inform USCIS the basis for “ pending “ I-485 no longer existed. So clean it up now by immediately sending in a copy of the divorce and letter of withdrawal ASAP. File your new I-484 without waiting for confirmation of any kind

Your brother can try to get to a POE and ask CBP for Humanitarian Parole for a limited duration . Link below will give contact number for the POE. At times this is granted and it’s worth the effort. He puts together the Doctors letter that describes child’s grave condition and short life expectancy, birth certificate for the child, if he has a non antecedentes penale clearance . Understand that this is not to expedite his ongoing immigrant visa case ( that the attorneys are representing him on) , it is a way for him to ask to be near child for a short period. I will assume here, he was deported , has spent 10 years outside and has a US Citizen wife who has filed an I-130 spousal plus hardship waivers .. The Petitioner wife ( am guessing here) can get on the phone w USCIS and request expedite based on these circumstances WITHOUT waiting for the Lawyers to get to it. She can also contact her Congressman and ask for help with expediting his case. https://helpspanish.cbp.gov/s/article/Article-1639?language=en_US U.S. Customs and Border Protection (CBP) can also issue humanitarian parole (at the discretion of the Port Director) if the requesting foreign national is at a U.S. Port of Entry. Permission to misquote @Boiler , but it’s always an issue of presentation . And in OPs case as in any disability income , proving the source is permanent/lifetime and showing the actual bank statement for the direct deposit evidence was/is OPs burden of proof. ..not USCIS failure. I appreciate @Mike E ‘s most encouraging words and hopefully OP doesn’t give up.

You can respond to the RFE by stating: 1. the annual $$ is Tax Exempt and shows up on line xx of 1040 Tax Return 2. include at least 3 months bank statements to show monthly direct deposit 3. MUST include a copy of the VA Disability Award/ Determination that shows it is a LIFETIME benefit ‘**and spell out these three points in your response letter to RFE’*****

Your suggestion is a good attempt to satisfy RFE and point out the RFE did not contain clear instructions of where to file I-601 nor do online instructions spell out where SRC cases are to file it. ..Field Office won’t cash your new check. Of course I would have filed it from the get go w Chicago..because they route it to Field Office -

Why did he send it to Texas? It should have gone to Chicago, per these instructions. Make 2 complete copies of the waiver , include the rejection notice from VSC , proof of mailing to Texas and send a short letter explaining attorney address errors . 1. How long I was gone 2. the reason why I’m gone that long 3. Why I didn’t renew my GC right away 4. they asked all the purpose of travel for each trips I had in the PHIL 5. They asked why I want to return to the usa 6. do I have family here, who are they 7. what I did in the PHIL for all those years I was gone 8. what are my ties to the usa They kept asking some of the questions over and over again I was in secondary for 6 hours. The room was crowded. They looked at all the documents and records I brought. They inspected my luggages and hand carry. They told me that they will deport me right away and that I should start looking for flight back since my GC is no longer valid even with the i 797. Then I was told I will face the immigration judge. They were really scary. I have never been arrested in my life and during that time I felt like I committed a crime. After all the interrogation I waited for another 45 mins and they made me sign the i 193. Did they ask for or take your phone at anytime? Was there one Officer asking you questions or more than one? Did you think anyone in the room was in a worse situation than you?

You did it!!! Congratulations . When you say you were “ given” I-193 w fee waiver…are you saying they gave you a blank form to fill out and send out? I lean to they issued and approved an I-193 on the spot and all you need to do is the biometrics for the I-90 renewal .or they gave you a separate paper .please clarify. Biometrics will be at ASC ! They will not touch your green card !
