File same forms for child as for you: I-130, I-485, I-765, I-131 , I-864 and do medicals ( I-693). There is no extra filing fee for the I-765/I-131 at this time and it is advantageous. You sign your name on all forms for child / applicant . Example Crabby Patti, mother Use the same supporting documentation for both packets , make sure each packet has its own complete copy of documentation, then you keep a copy of each set as filed. You seal each packet in its own envelope, then place both envelopes in one flat rate priority mail / medium box . On box write Attn Mailroom Supervisor: Family of Two DO NOT SEPARATE.

Welcome home. 1. You will have no problems w I-90 down the road. File it 6 months before expiration 2. Hold your horses…no N-400 til 5 years from 4/5/23..,anything sooner and they will be looking at that gap 3. Wait a bit before you travel..unless you enjoy trapeze acts without a net.

NVC asking for w2/1099 forms (merged thrice)
Family replied to mgul's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
This was definitely suggested to OP a few times in the thread. ..perhaps this time it will become clearer. WRITE a short Letter stating Joint Sponsor does NOT get 1099s or W-2s and upload it. NOW that it’s April , you will also need to upload 2022 tax returns for both Sponsor and Joint Sponsor along with same Letter of NO 1099/W-2. -

If you have created an online account and they have linked the I-129 F , you should also try uploading the letter as well as sending a paper copy . -
K1 visa application correction by new application

I will humbly dismiss the many creative responses that tier 1 agents come up with and suggest you don’t worry . If you already did an e request , then include copy of it along with the above mentioned paper mailing of the letter /supplemental filing to update record. Do not wait for any response , case will be worked only they get to it. As for the e request , it is indeed for errors noted on generated receipts..,but as it is an effective way to generate a digital effort, always worth doing..until they go all digital. -
Marijuana use in the past - medical exam
Family replied to Inc's topic in K-1 Fiance(e) Visa Process & Procedures
An admission of past use ( be it months or years ago) will result in a one year ban…not at the discretion of panel physician. The 12 month clock will then start , require a few clean tests and new medical when one year ban is over. -

Submit an e request to correct typos. Print it out and also do a paper mailing to the address on your filing receipt. One of the two will definitely make it to the file . Do a simple letter Supplemental Filing Request for Record Update due to typographical error. Include copy of Receipt Notice . Your case will not be denied, at most an RFE …do NOT refile. https://egov.uscis.gov/e-request/displayTypoForm.do?entryPoint=init&sroPageType=typoError -
Annulment due to marriage fraud needs not be in US..and would establish fraud at inception/ unclean hands ( beyond mere allegations) …at some point , if fellow did not really Fly Off ( abandon LPR)..I trust CBP/ICE will get creative https://www.uscis.gov/policy-manual/volume-12-part-g-chapter-2 the legal validity of a marriage is determined by the law of the place where the marriage was celebrated (“place-of-celebration rule”). Under this rule, a marriage is valid for immigration purposes in cases where the marriage is valid under the law of the jurisdiction in which it is performed. [1]

Dowry complaints…example https://www.reuters.com/article/us-india-women-crime-trfn/young-brides-deaths-trigger-dowry-crackdown-in-southern-india-idUSKCN2E417V Police, who said they had yet to establish whether Nair died by suicide or was murdered, are investigating a dowry harassment complaint filed by her family against her in-laws.

The fact that his previous wife filed a “ dowry” complaint against him means there was considerable domestic violence , encouraging and supported by his own family against the ex wife and her parents. The statistics of reported deaths and “ suicides” is less than realistic.,since many many are never reported. Without growing awareness and advocacy..and societal pressure, change is very slow. ..as complaints do not result in arrests and only a small fraction result in conviction…, Hopefully your sister pursues her annulment in India and as she heals , perhaps thank her lucky starts the fellow ran off with tail between his legs. Am sure part of that is the fact that she has her own family support system here. Securing an annulment will also ensure she is not responsible for I-864 obligations…in case he was less than honest when he texted” am going back to India”. So if you want to help your sister, then spearhead her annulment….it’s usually more difficult for the involved party to take swift action during emotional times. “ Good riddance to bad rubbish “… https://theowp.org/indias-dowry-scare/ Predominant among them are cruelty (mental and physical torture and harassment), domestic violence (including physical, emotional, and sexual assault), and abetment to suicide and dowry death (including bride burning and murder

Agree, could be an issue with his command of English language At times, readers do miss info . Issue of financial stressors were repeated from the start and serve as reason for immediate transfer…even though $$ tuition and all conditions were certified at grant and certainly no surprise. I am sorry for the loss of your father .,reach out for support to your school mates as you prepare to board flight back. They can walk you through most recent CBP encounters. .I expect there are sympathetic agents everywhere . -

Are you referring to the Global Pathways program for graduate studies…with allowed 4 credits transfer toward masters ? First link A bit of school accreditation guidance , Second link. But as you know from friends who have done it before , it has been successfully navigated , so wishing you best of luck . Hopefully you will update your post once you enter the US. https://international.northeastern.edu/global-pathways/ After successful completion of Global Pathways and its progression requirements, you can transfer up to 4 credits toward your master’s degree in the area of your interest https://studyinthestates.dhs.gov/students/instructions-for-transferring-to-another-school-as-an-f-1-student This means all pathway programs must contain credit-bearing coursework that is transferrable to the curricular requirements of a certified degree program at the school. -
Definitely fraud, Hire an Indian attorney and get an annulment for fraud ( not divorce ) from India courts. Assuming here they married in India. As per link , fraud claim needs to be filed within one of of its discovery, not marriage date. If you can pull off annulment pretty quickly ( less than 5 years) chances are his LPR journey will be very bumpy https://www.kaanoon.com/187674/marriage-annulment-via-fraud You can file petition for annulment of marriage on the ground of fraud or you can file divorce petition on the grounds mentioned in section 13 of HM act. If you prepare section 13 there must be one year seperation period before filing the petition. If you prepare section 12, you have to prove the fraud committed by him. As per section 12(1)(c) Hindu marriages act, no such petition for annulling a marriage on the ground specified in HM act i.e., on the ground of consent by fraud, shall be entertained if the petition is presented more than one year after the fraud had been discovered. Therefore, if your consent to the marriage is obtained by fraud, you have to file petition for annulment of marriage within one year from the time when the fraud is discovered. Asif no petition shall lie before the Court, if you continued to live with him as a wife even after the fraud was discovered

As other poster noted, conditions vary by schools. In this instance , school A , lists them as such : https://admissions.neiu.edu/international-applicants/conditional-admission Conditional Admission in Conjunction with SAELL International applicants who do not meet the English language proficiency minimum scores for graduate admission, but who meet all other academic requirements, may be considered for conditional admission in conjunction with School for the Advancement of English Language and Learning (SAELL). SAELL provides training for international students to meet the English language proficiency requirement. -

In this scenario, school A conditional acceptance to master program , low scores and all proficiency conditions were part and parcel of F-1 grant…thus no surprises or forced conditions. There was never any attendances or performance at school A , since he transferred out within one week of arrival in the US.
