You can file a WOM without worry that a decision on WOM will affect your VAWA immigrant visa. Worst case scenario, DOS manages to dismiss WOM in court…but you will know in about 60 days from filing. Run your own FBI prints. It’s easy , fast and cheap, just google places near you. It will show dates of all arrests. Then contact court and do as @Edward and Jaycel advised -
@Nutcracker, you won’t get a non-immigrant visa because they will presume immigrant intent. .which has been correctly picked up on by everyone engaging in your post. The ‘‘presumption “ is an automatic , given the record : visa violation on the F-1 , still married to a USC ..so even if there were no other issues/inadmissibilities , these factors can neither be waived nor explained away…no matter the argument. ..which seems to be : ” I am a wealthy man, with job, ties, kids in UK ..just want to visit my ill estranged wife” As for tossing about the immigrant visa option…well that would only be possible if the “marital union” part of the relationship gets rekindled. So maybe , fly her in to the UK , log in some ( provable) time together and decide IF you TWO want to go down that rabbit hole. Your temporary bigamy …won’t be a huge hurdle, but I have a BIG spidey tingle that tells me you did not manage to prove up the bonafides to this American marriage during removal proceedings.

Am impressed, you are a man of action. Good call. Those N-400 fees will get ‘eyes” on the case, especially the those dedicated to our military. You can also respond directly to that card production email and send them … 1. Copy of your unstamped docs /forms 2. Copy of your email to consulate for assistance/re upload 3. Copy of email to or from Congressman And now get her prints done , at embassy ,see link . Start the I-130 now. Financial docs and I-864 won’t be needed for a while . After USCIS approves and sends case to NVC ( at least a year) , USC Petitioner files an I-864 and Joint Sponsor also files I-864. No worries , it’s ok for Petitioner to earn little or nothing as long as he has a rich auntie😂

Tough one, as any and all DV history is scrutinized for K-1 and even I-130. ‘You can can try to filing with ; 1. ‘Letter from court stating case sealed 2. Copy of your FBI report ( go do your prints and show that was only contact w law enforcement) 3. Any records of charges , sentencing, disposition that your attorney ( assuming here you paid someone to seal it) may still have. ..and cite the misdemeanor statute of your conviction. 4. A short ( very very short) explanation of incident. ..am assuming here it was not a serious crime and that you are a good human . 5. Some character Affidavits from family/friends/community or professional. ..that say you are salt of the earth . With above evidence at filing, you will know if you can get past USCIS without unsealing. ..they will RFE if they want to push back. But ( even if you easily get past USCIS ) there remains the All Powerful Consular Officer at end of the road and some uncertainty.

For clarity, OP (original poster) @Traciusa, you seem to be the beneficiary ( no criminal record) . You are asking for info on your US Citizen Petitioner ‘s old case… As everyone correctly pointed out , the I-129 F application asks questions only about the criminal history of the USC Petitioner. He needs to : 1. Run his own FBI prints . Easy and inexpensive just google in his local area. This will show all arrests /dates and locations 2. Request certified copies of sentencing minutes/disposition from the court .. he can show the FBI report to narrow search( they have a form he submits). The court will send him back an official letter ( as custodian of records) that will say No Records exist ..usually because they are destroyed after some specific time. Send copy of FBI and copy of Court Letter of No Record with your application. -

At time of N-400 application and from here on 😂..please present your story in shortcut “ Here is her I-551 proof of status” “ they have not sent produced card yet, some internal delay , Congressman helping out” And clarify to Congressional Liason that you expect them to get the Embassy/DOS to talk directly to card production unit who sent you email. Apply online for N-400 , you will get case number , after that ask military helpline to “ check” on and make sure it moves along- 21 replies

With all that info in hand , time for action : 1. Her I-551 stamp ( plus copy of IV visa ) is good enough to apply for N-400. ..it’s OK she is a conditional resident , living overseas and still has not received the plastic card. See the link in prev post 2. She does NOT need the plastic card to prove her legal LPR status , travel ..etc. She is an LPR 3. Sounds like her IV packet was “digital “ as you were told , and she SUCCESSFULLY entered the US . ..( so glad you came w her!)..so relax things will work out. 4. Seems very silly , they sent you that email asking consulate to re upload IV packet…when THEY could have easily done sent a request to DOS…nonetheless, no reason to worry. Congressional Liason should figure it out in the end . ..and get the departments talking to each other. ..just keep emailing them for status updates. 5. Military ‘expeditious naturalization “ is the immediate solution and she can apply ( and get about life) without the plastic card ! She may get it done before needing to fly home and get a new stamp. 6. Don’t do I-90…since her case would require ROC..and likely add confusion- 21 replies

Last detail , do a free online FOIA , request complete A# file from USCIS and EOIR. I totally sure you will be a US citizen without any issue in 4 years…but it is a good idea to have a complete record til then….because you do have two I-485 case numbers 😂… I did not clearly express myself…but THE current approval is rock solid and you have nothing to worry about…since they did NOT mess with taking away status, they can pretty much do anything. Because USCIS chose to correct their error, they accepted the new I-485 as the most expedient option . ..without getting delayed into admin and rarely used procedures to fix 1st. The 1st I-485 is somehow admin closed ( you will likely see in FOIA) The 2nd I-485 is fine and flawless. -

I am still unsure of what the immediate “problem “ /question is..so lots of guessing on my part. Initially, on another post, I understood question was simply if N-400 can be filed without the physical plastic card. Simple answer YES. …even for expeditious naturalizations. BUT, then OP says, she has a stamp , her status does not “show” and someone is asking for a missing IV packet… ‘You are right about Get On The Plane and Go https://www.state.gov/global-community-liaison-office/naturalization-of-foreign-born-spouses/guidelines-for-expeditious-naturalization/ A foreign-born spouse must have entered the U.S. legally and have Lawful Permanent Resident (LPR) status in the U.S. (The LPR status may be conditional and if a “green card” has not been issued yet, an “A” number in the passport with the annotation “processed for I-551” is sufficient.) Filing the 2nd I-485 w USCIS was a strategic/tactical move. ..thought this in earlier post clarified it. USCIS can’t take away LPR status…therefore they can’t give another status…a supervisory review caught the mistaken response you initially got that claimed you agreed to all allegations and that they have some form to work on. Either way, you got in on the last days where anything will move that fast…take the win and enjoy. I just got access to forum, after a long involuntary VJ holiday 😂…so with a precarious future, I hereby designate you as the LPR rescission guru! Keep posting and give advice based on your very expert /hands on qualified win. Asylees will need help, cause legal fees will surely skyrocket soon -

Until Allegations are proven, they are not “facts”…even country of origin can be denied ( if need be ) as a timing strategy. Denial of allegations determines who has the burden of proof…and gaines the legal advantage. And you only go to court IF they refuse to correct themselves. …and you had a slam dunk win in court. Treat yourself to a $$$ celebration. 😂. Am laughing at the response you got that said they will work “ on new form”…since although I told you to send a new I-485 form “copy”..they could NOT accept a new filing under any circumstances. Did you send another I-485 as I told you? -

Often, terms specific to immigration “lingo” can make it difficult . ..and I will assume your duties and different time zones account for the time delays. So will talk through a few suggestions, and presume some facts: 1. If after I-130 ( DCF ) was approved and visa issued in March 2024, YOU and wife traveled to the US , she was stamped w I-551 at POE and allowed to enter. She then left US to join you . ‘If you paid the card production fee, then heard nothing…then print those receipts /emails and file online an I-90 ..for USCIS error ( no fee). Use a relative/friend MAILING address in the US. Watch out online for an ASC fingerprint notice and have her fly in for appointment. If application is accepted online and you get a receipt/case number, then additional eyes on the file will get you resolution. I doubt they will RFE for you to re create “IV file “ ..but in case.. 2. You should immediately do a DOS and CBP online FOIA for her complete A# file. It will have the DS-260 3. If she never entered the US ( on that visa issued March 2024) ..then she needs Embassy to extend IV validity . Will require you to make some Noise as USC ..try in person appointment…even if via emergency services for USC , in the hope that department can reach out to the IV unit. The FOIA will have DS-260, I-130, I-864 and she will do new medical.- 21 replies
