I think you have received a lot of good information, to the point of your timeline for her to be able to come to the US with the visa, you are looking at least 2 years before that happens. It will take at least one year for USCIS to review your application for the Marriage Visa and then if they approve your application, it will go to the State Department and once you satisfy all their requirements, wait for an interview at the US Embassy in Brazil. If you were to submit your application in July 2023, you are looking at July 2025 to possibly have her come to the US.

I could not afford an attorney, so I used a service that helps you fill out the application and also reviews all you do to assure that you are not making any mistakes. I have used them for my K1 Visa, and my application was approved all the way and I have used them for the application for the Spousal Visa and they have been very helpful. Well, my experience for my K1 visa and for my Spousal Visa, (both of which were approved by USCIS,) is that I hired a company that basically reviews the contents of all your applications and they send to USCIS with guaranteed delivery. I did not have the money to hire a lawyer, (in excess of $5,000.00 for a spousal visa,) so I went that route. I was very pleased within the scope of clearly understanding what service they provide and nothing more. They help you every step of the way to assure you that your paper work is flawless.

No, we filed married and I received my refunds just fine and both my transcripts are in the IRS website showing as such. I tried to get an ITIN for my husband but that led no where, so I just filed and waited to see what happened and nothing happened they processed my returns like normal both times. -

For the last two tax years, 2021 and 2022, I have filed my taxes using TurboTax, filling out my spouse social as all 999's, as he is in Indonesia, and mailing paper returns. Both times my taxes have been accepted and processed and I can get copies of them in the transcript page of the IRS when I need copies to fill out the affidavit of support. Never been told to do otherwise. -
You have received so much good advice, however, I think far better is to marry her in her country and then apply for a spousal visa, it far cheaper and when she arrives she will have her green card. If you go the K1 route, you have to pay all the expense for the K1 then once in the US have to pay for AOS.

If his children are US citizens over 21, then they can petition their parents regardless how they came in, with or without documents. The US Catholic Charities has helped thousands upon thousands of US citizen children bring their parents to legal status in the US. And Catholic Charities does it for free, all they have to pay is their Immigration fees.

Looking for comments. So my spouse interview at the Jakarta Embassy was scheduled by National Visa Center for July 18th, 2023. Yesterday, my spouse attended the medical exam and because of prior TB infection they always make him do a sputum test which takes three months in Indonesia for the results. Rather than canceling the interview and then reschedule, I am leaning towards having him go to the interview and just have the embassy hold the decision until the Medical results are delivered and then if all is well they can send him the passport to the pick up location after. Thoughts? Thanks

When my spouse entered the US on June 2021, he was given an alien number, (well maybe it was given at the embassy when the visa was approved.) In any case, now he is about to go to his interview at the Embassy in Indonesia the CR 1 visa and I see the confirmation has a different alien number that what he got the first time he entered. Is that the way they do it?

Update. So I sent two emails to the US Embassy in Jakarta and explained how the document delivery receipt shows the K1 Visa Application Number on the receipt and both times they tell me it has been updated but when I print the confirmation it still shows the wrong Visa Application number. So I give up. I will just print the email exchange along with the confirmation of where to deliver the passport and give it to my spouse to bring to the interview. i give up. lol -

Hello, so I did get a new password from the site and was able to update the information, (from the K1 visa to the CR1 visa,) and register for the passport delivery, however, the only thing is that the receipt still shows the DS160 number and not the DS260 number, so I will write to the embassy to let them know. -
Question, we received my spouse's interview date in Jakarta, however, as part of the process it requests that you register to have the passport delivery location identified. Tried to register but kept on saying error for one thing or another. In any case, my spouse had already registered before when he had the interview for a K1 visa in 2021. So does the fact that he had an account means that account is still active and only need to request a new password to log back in? Much appreciate any insights. thanks

Unfortunately we did not have a choice and had to go the K1 route but as it turned out, my spouse had to return to their country before the AOS was completed and we had to do the CR1, but, I still believe the CR1 is far better because the process these days for AOS tales for ever and having to stay home bored and nothing to do is quite a challenge. With the CR1 once they arrive in the USA in a matter of a few weeks they have their green card and life is much easier.

Well if you already paid the visa fee, then it can take up to 3 months to receive the green card. As to the originals that you mailed USCIS, highly unlikely they will return anything to you. -
I am 70 years old US citizen and my husband is 30 years old from Indonesia. same sex couple. Our K1 was approved without issue, ( I did visit him 8 times in 4 years, so the in person meeting was most certainly not an issue.) At the time of the interview he was unemployed over 3 years. In any case if you are able to prove you are in love, you will be just fine. Good luck.

I will share my experience. In Feb 2022, I filed my taxes,(did them on TurboTax but printed the forms,) because I mailed the together with the ITIN application for my spouse to the Austin Texas address. I will shorten my experience, but during the year I had over 4 exchanges with the ITIN Office for a whole bunch of questions and one exchange with the IRS about not using an ITIN. I replied back to the IRS my ordeal with the ITIN office and on December 31st, 2022, my refund was received at my bank. I then went to the IRS website to obtain a copy of my 2021 Tax Transcript as I will need it for the Affidavit of Support and it shows they processed my return with all 9's in my spouse ss as I did it when i sent it in. Fast forward to filing my 2022 Taxes and I did them exactly the same way and in 6 weeks I received my refund, and I also got a copy of my transcript from the IRS website and it is the same, married filing together and with all 9's in the SS field. To this day i am still in the process of getting an ITIN and still working with the ITIN office in Austin to that effect. For your information, filing married but separate is not a good thing to do either because you pay higher taxes and thus it cost you to do that.

When my husband went to the interview in Jakarta, while we provided copies of the chats, (copies of one two lines chats per month,) we provided more pictures of my 8 trips to Indonesia and many pictures of me visiting his family. i spend over 150 days in Indonesia on all my trips there. I think the pictures and the proof of my trips there were of more use that the chats.
