If you are able to get married then just go ahead and get married and it will be cheaper for sure and most likely due to the timing if your spouse enters the USA after two years of marriage automatically gets the 10 year green card. That unfortunately happened to me, my spouse came in on a K1 and we paid for adjustment of status, work permit and advance parole, but due to an emergency at his home country he had to leave and then we had to apply for a CR1 visa which was finally approved and he will come next month. If you can, just get married and apply for the Spousal Visa.

My divorce was final on June 6th 2017 and I filed for my K-1 Visa, July 1 2017 and was approved without issue.

If you both are in Mexico, marry there. Once you file for the spousal visa, the US government just want to see the marriage certificate, (if it is in Spanish you have to have it translated by an approved US Embassy translator or approved translation service.) Don't open yourself up for additional possible inquiries about travel to the US on a tourist visa and then getting married, eventually not a huge to do but could delay your process with additional questions that will not happen if you marry in Mexico.

Ours sat without any information for 12 months and 29 days and then it was approved in 2 days. So nothing out of the ordinary, just be patient.

You need to apply for an ITIN so that you can file married on your taxes. The IRS in the USA is quite the trip too, I file my 2021 taxes on Feb 2022, married and sent them along with an ITIN application, to make a long story short somehow my taxes and ITIN application separated, eventually in December 2022, the IRS gave me my refund and actually accepted my taxes with the all 9 number I used for my spouse social. In Feb 2023 I again filed my taxes using all 9's for my spouse social and the IRS processed it in 30 days and gave me my refund. My tax transcripts all show my spouse SS as I entered it. Finally after quite a journey, the IRS issued my spouse an ITIN two weeks ago, (from the original filing in Feb 2022,) but my spouse will be arriving on Oct 9th so we will wait until the official social is issued to update the IRS.

Better safe than sorry, it cost nothing to just email a copy to your beneficiary and have them print it in their country and a bring to the interview. My spouse brought the originals and or copies of all the documents we submitted. At the end they looked at none but if they were to ask, they were handy.

I honestly do not think they will ask about income, but if they do, best to tell them what they already know which is the amount on your taxes that you submitted. As to the questions asked of my spouse - why did you return to Indonesia after you were in the US and got married, did you meet your husbands family, how many times did your spouse visit you in Indonesia, (8 times,) and then told him that the visa was approved and this time to stay in the US until his green card is delivered. I think his interview was less than 10 minutes.

Well at the end of the day, whatever you submitted to them to show proof of income, was not enough and you have to be able to satisfy the government in their request to make sure that the beneficiary will not become a public charge. Since it seems that your prior year taxes are not sufficient to provide that proof, then you need to do more research on the USCIS website, where you can find out what is sufficient evidence to supply the government of your income that satisfies the requirement. I certainly can appreciate your frustration but all the advice in the world here will not change their request. In order to move to documentarily qualified so that they can move to schedule the interview, they have to approve your application of the income requirements. Good Luck.

That is NOT recommended, no even if after the interview you are told that you passed..... it is recommended that you do not purchase the tickets until after you actually receive the visa and are able to review it for accuracy to make sure that there are no mistakes, (it happens that there are mistakes and you have to return the visa to the Embassy for them to fix it.) It would be a costly mistake if you buy a non refundable ticket and then cannot use it.

Since I knew they had my copies of the tax transcrips I told my spouse to say what it showed in the total income on the tax records if they asked but they never asked about that.

I think that you should make sure you are aware of how your Embassy is timing interviews, there are some U.S. Embassies overseas that have their interview appointments not scheduled for months and months, so depending where your spouse if located the process may take care of the delay without you doing anything out of the ordinary. So, my spouse will be coming to the US in October and in anticipation I paid the $220.00 immigrant fee and have the receipt. I understand that nothing starts moving on the issuance of the green card after the person enters the USA, however, once that happens is there a place you can track the progress of the Green Card issuance? So just within the last 30 minutes my spouse visa was approved in the US Embassy in Indonesia, however they gave him a paper that explained how to register for passport delivery, which we already done when we scheduled the interview. In other postings here I have read that when they approve your visa they give you a paper that tells you how to pay for the green card prior to coming to the US, but that was not given to hum. Will that come with the passport when its delivered? Thanks

I have a 40 year difference with my spouse and my K 1 visa was approved without issue. We made sure all our paper work was correct and I am sure the fact that I visited 8 times for a total of over 150 days helped to show our relationship is real. I have heard that age difference is always a concern but I honestly believe that if you are in love it will not be an issue. Certainly different Embassies may deal with that differently, so I can only speak for our experience and the US Embassy in Indonesia.

When my spouse went to the medical exam, he had no vaccination records whatsover, (Indonesia,) they just proceeded to give him a whole bunch of vaccines required by the US and that was the end of that. His K 1 Visa was approved without issue.

Mine took 13 months to be approved. Patience all will be ok.

Once your divorce is final, write to USCIS and withdraw the application. That way you have a clean record with USCIS just in case you need their services again.

I share this information as it may be useful to others in Indonesia. My spouse did go to the scheduled interview yesterday, (knowing that the medical results were to sent to the Embassy yet,) so in the pre check process once you enter the Embassy and speak to the attendant in regards to all the paper that you bring, eventually, they realized that they have not received the medical exam from the official hospital and told him to leave and that once they receive the medical exams results they will reschedule the interview. Thus, in Indonesia if you do not have your medical test in the Embassy, at least for a CR1 visa, they will not interview you.

My spouse will have the Embassy interview tomorrow in Jakarta, however, we already know he will most likely get administrative processing because his medical is not finished at the assigned hospital, (awaiting results of a sputum test.) We think results are expected at the end of August at which time the hospital submits the final completed medical to the embassy, (that is how it's done in Indonesia.) Question, will the embassy hold the passport pending the medical results and if all ok then approve the visa and send to the delivery address already given to them? or will they return the passport and request a new interview after the results are delivered? From what I have learned they are pretty accommodating with the appointments. I found out too late that my spouse could have gone to the biometrics appointment at any time after receiving the letter. We actually canceled our vacation to go on the date the letter said. Good luck.

On my K 1 the Embassy asked for the last 3 years IRS Transcripts, this was in Indonesia.

I have filed my 2021 and 2022 married and using all 9's for my spouse social security number and both returns were accepted and they are loaded in the IRS website to obtain as transcripts without issue. I did try to apply for an iTIN for my spouse and the application which I submitted in February 2022 it's still being worked on my the IRS in Austin and still not issued. Call it crazy but I no longer need the ITIN.

You cannot guess and all those numbers about the processing centers themselves are not reliable. I say plan on at least 2 years if all goes well before your fiancee arrives in the US.

In April 2023 when I uploaded my Affidavit of Support for my Spousal Visa to the NVC, I uploaded my 2021 Tax transcript and a copy of my 1040 for 2022 as the transcript was not yet available and they approved it without issue.
