I honestly think that you can do it yourself, in the process of filling out the applications if you have questions this would be the place to come and get answers, While I did not use a lawyer, I did use the services of a company that reviews and assists in the filling out of the forms and for me the piece of mind that it was all correct was worth the expense, (far less than a lawyer.) Do understand if you use one of these services there are no guarantees, just that the paper work is filled out correctly. In any case, I think you can save all that money and just use this site for guidance. Good luck.
  3. Your whole process would be so much different and cheaper if you would have married in the UK and then have the religious ceremony with your family in the US once you were there...but you are almost there with your K1 so you may as well move on.
  4. All the questions in the USCIS forms pertain to the US unless clearly specified in the question that is otherwise.
  5. My spouse is 40 years younger than me and we never had any issues getting the K1 visa approved and then two years later the CR1 visa approved, the age is the least of your worries.
  6. Is not a problem but you are paying higher taxes when you do not have to. If you are married and your spouse is not in the US, then you can file married filing jointly and also send an application for an ITIN, form W-7. you can download from the IRS website for free and it is pretty much self explanatory. When you do the first filing enter your spouse social security as all 9's. That is what I did for 2 years until the ITIN was approved, then, I did amended returns when the ITIN arrive and once he entered the US and received his social security number, I did amended returns again. DO NOT FILE MARRIED FILING SEPARATE!
  7. As others have stated, she should be the one posting here for advice. You bring no benefit to the situation if you are not married to her, and you say marriage will happen many years from now.) If that is the case, she has very little changes of getting a green card anytime soon.

When I got married in 2021 with a K1 visa for my spouse, (who returned to his country before the AOS was completed and we filed for a CR1 visa,) I filed my taxes as married filing jointly and the first time I filed I entered all 9's for the SS number for my spouse along with the application for an ITIN in the interim. It took a long time to get the ITIN so when I filed for 2022 I did the same thing and my return was handled fine. When finally the ITIN was approved then I filed amended returns to include the ITIN and once he received his SS after coming back with his CR1 visa, I did amended returns again with his SS.

Well, when my Fiance went to his interview in Jakarta in 2021 and he was told the K1 visa was approved, they kept his passport and he stayed in Jakarta, ( he lives in another city in Sumatera,) and they did not give a receipt. He was not concerned. Five days later he received the notice that the package was delivered to the pick up courier and he picked it up. In 2023, as my spouse, the same thing happened, he went to the interview in Jakarta, his visa was approved, they kept his passport, no receipt given, and 5 days later he picked it up at the courier. He stayed in Jakarta in a hotel for the time waiting and had no concerns.
  11. Given that my husband had checked off the box to have the Social Security card issued once he entered the US, his card arrived in 6 weeks and his green card in 2 months. I think if you had checked the box for them to issue a social security number upon your arrival, you are still ok time wise.
  12. Wow some of these increases are way out of line vs inflation, seems that they are discouraging immigration or at least making very difficult for the common US citizen to participate in the process of K1 or CR1. Very sad.
  13. Actually in other posts I saw that once you receive your biometrics appointment, a process that takes less than 10 minutes, you just go to the place with the letter and they will do the biometrics and you are on your way. You do not have to go on the date on the letter.
  14. As stated by others the entry date tot he US determines the 2 year vs the 10 year visa. I have to believe that if they decided to wait to approve your visa at a much later day than the interview, then they have to place it on administrative review which then generates the refused tag on your visa application. If the person you interview with is true to their word, and I have no clue why they would not, all will be ok.
  15. Throw it in the trash, as simple as that. Once you are a US Citizen then register to vote.
  16. In all my previous dealings with USCIS I always paid by personal check and it worked best for me.

For the 2021 Tax year, when I filed my taxes I just entered all 9's in the social security number of my spouse, (filing married filing separate was going to cost me money,) and I sent it just like that along with the ITIN application and it took forever to get my ITIN number and had to file my 2022 taxes the same way, using all 9's for my spouse social security number and the IRS processed my taxes as normal. Once I received the ITIN number I then submitted corrected 1040's with the ITIN number and then when my spouse received the social security number, I submitted corrected 1040's again.
  18. These days the wait for either is almost the same and the benefit of the CR1 is that upon entering you have your green card vs a K1 additional wait to adjust status once you come into the country.
  19. Employers do not have to give W-2 before January 31st, though some do. If you are filing now then you have to submit what you can get and the most efficient is the IRS Tax transcripts that you get online, if you can wait, then file your 2023 taxes and send a copy of your 1040 for 2023 along with the data from the prior years.
  20. She can travel with you anywhere inside the USA, her visa does not expire for 90 days after she is admitted in the US. If you are flying, when she travels TSA only looks at the passport page with the picture and moves on.

If I were you, I would go back and get married and not deal with the K-1 Visa, the CR1, spousal visa, while it takes about the same time as a K-1, once she enters the US immediately will receive her green card and Social Security to be able to work. You avoid the adjustment of status process and the expense that goes along with it.
  22. If you are able to get married in your country, then get married and file for a CR1 and surely by the time you enter the US you immediately get your SS and Green Card.
  23. It looks like standard operating procedure for USCIS in this type of event. In the end you know that they received your request and just want until they actually contact you with meaningful and actionable information.
