While I have no details about Pakistan, my now husband was approved for a K-1 Visa in Indonesia, the largest Muslim country in the world, (though as stated whatever prevailing laws in the country are irrelevant to obtain a K-1 Visa for same sex couples in the U.S.) For reasons not important here, he had to leave the U.S. after marriage and before adjustment, so I had to apply for a CR1 visa and that was also approved without issue. Once he arrived in the US we had been married over 2 years so he got the 10 year green card. Good luck.

Well, that places you in a much higher tax bracket and I was not willing to pay higher taxes just because he did not have a social security number, I took the gamble of just doing the taxes and entering all 9's for the social security number for 2 years consecutively and never had a problem. Once the ITIN arrived I amended my returns to include the ITIN number and once the social security arrived I amended the returns once again. Having worked as an IRS Volunteer for over 20 years did help because I did it all myself.
  3. This is my experience. I got married in July 2021, 9 days after my spouse arrived in the US and unfortunately for reasons he had to go back to Indonesia and then I had to apply for a spousal visa. When I filed my 2021 taxes I filed married filing jointly and just entered all 9's in the place where his social security needed to go, ( he did not have a social security number.) I did proceed to apply for an ITIN in the interim but that took almost two years to accomplish. So when 2022 came around, I once again filed married filing jointly and filled it all 9's in for his social security number. On both times the IRS processed my return, gave me my refund and uploaded the return so I could get a copy to use when doing the paper work for the spousal visa. The money you send is NOT income for your spouse, her income is 0 in the US. He eventually entered in October 2023 with the spousal visa and in one month after arrival he received his social security number. It would be good to have the ITIN but that process takes a long time and they are very slow in handling it. What I would NOT do is file single.

  5. I had travelled to visit my Fiance 2 times before the interview, and that is how we presented the photos, taped to 81/2 by 11 white pages with description typed at the bottom of each picture. About 12 pictures in all and to be very honest, we really do not know fi they even looked at them. This was at the Jakarta, Indonesia U.S. Embassy and they did not give us any issues in how they were presented.
  6. The K1 is only good for 90 days during which she is supposed to get married to the petitioner, obviously she will not so after 90 days she will be out of status and subject to deportation. The concern is that your brother is on the hook to support her as he submitted the affidavif of support, so if I was him, I would be sending USCIS a letter spelling all this out and making them aware she committed fraud.
  7. So seems like he really does not care about his wife and care even less if she is deported. In the present environment there is a much higher chance his wife will be sent back to her country. How sad.
  8. There are no ways around it. It will be denied, do not waste your time and money applying. Move to Colombia.

I never obtained health insurance for my spouse until AFTER arrival in the US and that topic was never brought up in either interview at the US Embassy in Jakarta, in the K1 Visa or the Spousal visa interview. Once the person is in the US it is best to have health insurance but it is not part of the approval process for the visa.
  10. I actually sent all the documents to my fiancee via email and they were printed in his country before the interview. There were no issues whatsoever with any of them including the 260 application.
  11. Our experience was that the questions on that topic never came up, however, my spouse was well aware that I had been married for over 30 years and was divorced. The divorce decree was in all the papers that had been submitted with the application. I think that while I do not believe that they need to know the details, they do need to know that you were married and divorced. Good luck.
  12. It is very sad to read your story. I honestly believe you already know what is going on. Your best solution is to get divorced and stop spending your money on something you already know is not for your benefit.
  13. At this stage the worst is over, you passed your interview. Once they issue your visa they will email you as to how they are making provisions for you to pick it up or receive it via courier.

  15. I think you should just get married and file for a spousal visa using a sponsor. Its way cheaper.
  16. If you were married that whole time then she should have filed married, all she needs to do is apply for you to have an ITIN and the amend the filings.
  17. Given a choice the CR1 is far cheaper than the K1, if money is not an issue then it's up to you.

My husband just arrived here about one year ago and has his 10 year VISA and honestly we are not worried about any of that.....I honestly believe that they have many other battles to fight in the undocumented immigrant front to worry about anyone who entered the US legally and also has status.

Please understand that the the very experienced people here giving you advice, they are doing it based on their vast years of experience, and they honestly want the best for you and your experience in whatever VISA you eventually apply for. It may not be what you want to hear but believe me that their advice is money in the bank for a successful VISA Journey. Their advice is invaluable.

Whatever your experience was with Chicago to arrive at the Agent , (where you present your visa and package) was in your prior visits, it will be the same, then add at least one more hour when they take you to their offices, open the package and give you a brief interview, so your 4 hour window seems good.
  21. She will be teaching 18 weeks, you will be lucky if you get your application approved in 52 weeks, I think you do not have to worry about the timeline vs her teaching responsibilities.

I agree with the comments, my fiance brought all kinds of pics and other items to his interview, when he entered the interview area the person there asked for very specific items/forms and said all else they did not need to see it. Once he was actually interviewed by the agent, outside of questions that were asked, no further evidence was requested. Two years later when we went through the process again for the spousal visa, we only brought what was requested and not a single page more. Good luck.
  23. i am a neat freak as well, and when it came time for my spouse K-1 interview, I prepared all the evidence in clear plastic folders and sent it via Fedex at a cost of over $300.00 for the package. Once at the interview they asked for only 3 sheets of what he brought. The next time for the US Embassy interview, for the spousal visa, whatever I needed to send from the US I just sent via an email, including pictures, which were printed in his country. Total cost of printing $10.00. All the documentation was in one single envelope and once again of all he brought they only took and reviewed 3 pieces and the rest they never looked at it. My comments that if you want to do binders for your own piece of mind, go ahead but once at the Embassy they will ask and take only what they want to see.
  24. That is unfortunate but concentrate of your life and make it happy with the one you have chosen. If they come around much the better but if they do not, move on.
