We crossed at the Ambassador Bridge POE on Dec 27th, 2007, and they put the EAD stamp in the passport. We didn't even have to ask. However, the guy doing it was a little confused and had to ask the others "do we still do these, oh well, I'll just do it anyway."

I apologize if this is not a new thread, but I am relatively new to the site and I just felt that this information may be useful to others and I am unsure where to post.

Our K-1 interview at the Montreal Embassy is four days away and the USCIS says the I-129f is still pending, a.k.a. NOT APPROVED, and we never recieved an NOA2.

This is how we resolved the problem, hopefully it may help others.

Our 129-F petition was sent out in march 2007.

NOA1 received in April 2007.

We got our National Visa Center letter indicating that they had received our APPROVED I-129 petition July 4th, 2007.

Montreal sends us packet three within the month.

We send off checklist.

Interview date given of November 9th, 2007.

Everything is going great at this point, but according the the USCIS our case is not approved and still pending! WE NEVER RECEIVED THE NOA2. When we check online, the case is pending. When we call the customer service center, the case is pending. I explain that it is not pending and that it is approved, they transfer me to the supervisor and she tells me that I am lying and trying to trick her. She then "terminates my call" after I try to calmly re-explain the problem. I called the NVC, everything is fine with them and they find my story humorous but they say they can't help, very nice people though. This goes on and on...... But I still need the darn NOA2 for the adjustment of status to come.

The moral of the story: Use the RFE trick. After searching VJ I found that if you follow the prompts on the USCIS Customer Non-Service automated phone system and pretend that you need help with a request for evidence, even though you don't, you get to talk with an actual officer rather than and just an operator. The Officers are much more helpful. The one I spoke with told me that the California Service Center approved my I-129F and then sent it off without entering it into the system, and thus the NOA2 was never generated and sent to me. She says that they will need the approved form back from the NVC so that they can enter it into the system, and get me my NOA2. At this point the interview is FOUR DAYS AWAY. They need the files at the embassy so they can give us the visa, she actually understands this and then talks to her supervisor, who then says a fax from the NVC will work just fine and it won't stop our interview from happening.
