K1 Denied. Applying for B1 Tourist Visa instead?

The fact you said "in order to get her here quickly" makes me think you might be thinking of AOS on a tourist visa. This is fraud. There is no loophole if you already have immigrant intent. But let's say I misinterpreted you, and you only want to get her a visitor visa in order to just visit you in US. You said she never left the country, so I'm thinking she never had a US visa, correct? So that would be her first time ever applying for an American visa. Right now, waiting times for a visitor visa in Brazil are at 400 days or more. And it's 2 days of interviews now from accounts I heard. You can try speeding it up by constantly checking the website to see if earlier dates opened, but it's luck. Some despachantes (visa agents) promise you to get it quickly but I can't attest to that. Just another perspective. I am on day 436 waiting for my K1 petition to be approved, only planning on being in US by October now. My US tourist visa expired a few months before I applied for K1. I won't even risk renewing it because I am pretty sure it will be a waste of time and $160 (it's almost R$900 here) because I have immigrant intent and have weak ties to my country. I'm young, have an American fiancé, work from home and live with my parents. I have travelled abroad a couple of times and have a tourist visa/work permit from Canada, and I am 99% sure they will deny my renewal (note that there isn't an interview in my case for renewals, I still won't risk it). Her being young, recently graduated, with an American fiancé and living with her parents is a bad sign. When I first got my visitor visa I was also young and going through university, I was also going to travel with my parents, we went to Disney World. The officer gave me a hard time but in the end approved my visa. I don't think this will happen nowadays. The letter you intend to have her present won't mean much to the officer, same as her having crochet business or you being a soldier. You say you intend to get marry in Brazil. Can't get married in Brazil on a K1. But if you do it, apply for a spouse visa. And wait. And wait. And in-between, visit in other countries or come visit her in Brazil, forget about her in US before the spousal visa is in hands. I met my fiancé 2 times in Mexico, but your fiancé will need a visa to enter Mexico though if she doesn't have a US/Canada one. Maybe think of other countries you both can go and is easier for her to enter. We don't need a visa to enter many countries in Europe. Just my two cents being from Brazil, but do listen to all experienced users here on this thread. -
This is so useful, thank you!!! I will need to check on Tetanus because it might be over 10 years when I finally get to the medical exam haha And I was really confused about the Varicella one but I had chickenpox when I was 3 years old, so that's why I never needed to take it. The list with no age categories really seems like it's a huge amount of vaccines required but it isn't for adults.

Wow, that age table is super helpful. I feel I may need to have less vaccines than what I was expecting – my childhood records are a bit messy and sometimes the vaccine name translations can be confusing. I also heard that they don't really care about the annual influenza one if your medical exam is on a period where the vaccine isn't available in your country, but I am not super sure about it. Need to research about it. Oh wow. They did include results after the scans then or maybe after the outage. The custom script scanner also got the same 3 approvals yesterday. Great news!!! I can't wait to scan it again today and see more numbers than I was expecting. Thank you for letting me know!! -

It wasn't the tool outage. The tool outage happened way after I scanned. Other scanners got to the same result, only 3 approved. They just moved on from February. I know. I just feel defeated. But we'll get there. Wishing you have good news soon, you and the 6 people in your range also waiting ❤️ -

Today's numbers [May 3rd, 2023] Terrible day for us, just hitting a new low. Hoping it was just a delay in the system and we'll see others tomorrow, but no hope. Just some notes: I don't really count RFER (received) in the ranges below since it's not an active action from USCIS. Many ranges, including mine, only had RFERs. I also changed the percentage column on the spreadsheet because it was also counting RFEs, which is fine, but I just wanted to see the pending cases with no real action, and that does not include RFEs. Thank you, I keep wishing today is the day every single day but seeing April approvals is making me a bit (just a tiny bit, huh?) frustrated. Appreciate it though ❤️ It is super random! And I am also biased being from the 22nd, range 53500, but looking at the numbers every day since they started February, I noticed they started with the first weeks, then when finally the bulk of activity went to the last two weeks, they slowed down to focus on March. If you look at pending numbers on the spreadsheet, there are more pending on the last two weeks, and I know the number of cases in each range differs, but the percentage of pending is also higher on those that filed later. I think you can also see that many early weeks' cases got their approval first, in March, while some later ranges only got more attention in April. But there's no way to predict it. I know people from the 47000s that are still waiting, and ones from the later ranges that got their approvals in the heat of activity. It's a slight, tiiiiny, probability if we want to get too technical about it. As a forgotten later filer, I do obsess about what I could've done differently, unfortunately. -

Yep, nothing ever is set on stone with USCIS it seems! haha I feel it's even more random on NVC phase when it comes to USCIS sending the case to them. I wish I had not filed late in the month so I had a lower probability of being left behind, but then again I see people from the early weeks still waiting and I could've been one of them. It's a matter of luck. And I never won anything at all even in simple giveaways, so being left behind checks out in my case 😂

I noticed this in February but because I keep a spreadsheet with ranges so it's easy to see it. I wish I had to see those from other months so we can notice a pattern, but I remember seeing this in December too from @mw & rg k1's custom script. Seems those on the last weeks of the month have a higher probability of waiting more time. It's just a higher probability, doesn't mean you can't get an approval when they are actively working on a month or that if you file early you won't be left behind. It also depends on the number of cases in each range, I'm comparing it in percentages though.

Oh, can I just ask you one more thing just to reassure me a bit more? haha when you got to your interview, your European country certificate was already issued more than a 1 year ago or was still inside the 1 year (or 2 year) expiration date?

Oh, perfect! Thank you also for letting me know about your case, I couldn't find much information on a case that was like mine, with the certificate being issued on a trip before leaving. And yes, if I do have to go back, I will get another one while there. Thank you for your answer!

No, I'm not planning on it, but I understand I will need another certificate if I do (in case work demands me to go back for some reason). Would the exception for the expiration then apply in my case, even after staying in the Canada for a month after getting the police certificate?

I'm back to my home country, Brazil. I will go through the K1 here, at the Rio embassy. I got the Canadian police certificate while in Canada on a work trip last year. Received it in the mail in August while still in Canada, left Canada in September. Haven't been back.

Like others said here, you are free to try, but it would probably be a waste of time and resources because you are going through K1. Mine expired a few months before filing for K1, I wish I had thought about it and renewed it before filing, but also my country has a huge waiting time for tourist visas. But then again, even if I got my tourist visa approved, I could be denied entry at the border (a lot of people are successful when it comes to enter the country to visit while on a K1, but I would not risk the money, time and frustration). We just meet in my country/a 3rd country. -

Thank you for your kind words. I understand that the NVC wait is also hard, especially because you are left in the dark and trying to make inquiries until they finally assign you a number. However, I think I will wait until I go through it so I can have my final verdict, since right now, having a NOA2 and dealing with NVC sounds extremely better than seeing cases that files 2 months after you get a NOA2 and reset their waiting clocks while an approval for me to move on seems further and further away. I hope you get a NVC number soon! -

Hi! I wanted to clear a doubt I have when it comes to police certificates validity. I searched on the forum and online and I still am not too certain if it's 1 year, 2 years, or in my case it doesn't expire. Let me explain. I am waiting still for NOA2 for a K1 visa, and since it's starting to linger a bit, I am getting worried I got my police certificate too soon and it might be expired once I get to the interview stage. I am Brazilian and I have lived in the UK and Canada. Police certificates from Brazil are easy to get and issued instantly online (federal and state), I got my UK done this month and I am waiting for it to arrive but the copy I sent to my fiancé in the US already arrived. The Canadian one is worrying me though. Getting a Canadian police certificate from Brazil is honestly complicated, long and costly for me. Since I still work for Canada and went to visit the country for work last year, I decided to do my police certificate from inside Canada (note I presented my passport and expired provincial ID for that). It was easy, got my fingerprints, submitted the application, got it back in the mail in 5 weeks while I was still in the country. It is the correct police certificate asked for US immigration as I've checked before. The date on my certificate is August 10, 2022. State Department website tells me police certificates are valid for 2 years (my understanding is that this was extended due to the pandemic, not sure?). The Brazilian US embassy website tells me the police certificates are only valid for a year, but I think it could be that their website isn't really updated often. Here's what they say: "Police certificates for K visa applicants expire after one year, unless the certificate was issued from your country of previous residence, and you have not returned there since the certificate was issued." While State Department has the same info but says two years: "Police certificates expire after two years, unless the certificate was issued from your country of previous residence and you have not returned there since the police certificate was issued." And then there is also the part about "unless issued from your country of previous of residence and you have not returned there since the police certificate was issued". What does that mean? That the certificate doesn't expire if that's the case? And do you think that my case of issuing it from inside of Canada would fit that so my certificate doesn't really have an expiring date? To be specific, I received the certificate dated August 10th, but only left Canada on September 22nd, 2022. Would I had need to receive it outside of Canada? That part makes me confused. Anyway, what I want to know is what's the validity of my Canadian police certificate. 2 years? 1 year? No expiring date? Just so I know if I will need to get another one before my interview comes (considering my interview might probably be after August 10th, 2023 – hoping it isn't!). Thank you in advance!

Police clearance certificate question- UK ACRO Police Clearance

Not sure if it helps, I was also a student in the UK and I am going through K1. I applied for my UK police certificate on March 18th. They give you a confirmation email after you apply. Then, on March 31st, I got an email saying the certificate was mailed. I am in Brazil. I didn't pay for premium international courier. Our post service is horrible. So to be safe, I sent a copy to my fiancé in US too for 6 pounds. He received it on April 12th. I am still waiting for mine to arrive. Could be a safer bet to send a copy to your spouse/some third party in the US. Also note that there was no cyber threat when I applied, but there was a note about Royal Mail strikes, therefore the process was taking longer than needed. I also added to my ACRO application my police registration (that you have to do once you arrive in the UK as a student). Not sure if it helped being processed faster but no harm in trying. -

Officially, 16.5 months. This is based on 80% of the cases in the past 6 months. But things are speeding up, though there is no precise order so cases take longer to get processed (I'm on day 430, saw a March filer yesterday get an approval on day 398, there are January filers almost on 480 days still waiting). I'm so sorry you're also going through this. I take comfort in knowing there are 80+ untouched cases in my range even though it doesn't mean anything, but I see numbers go down there while I still remain untouched and it hurts. I lost hope for April (I know today is the last say, but still...) with approvals slowing down each day. I keep thinking there are still 600 cases pending! My time will come! But then January has 150 cases untouched and there's at least 3 people that chimed in here that are in that group too just waiting. Ugh! Stay strong, we'll get there, just will take us longer -
