  1. Yes. And I even received a written response from USCIS stating they made an error and will correct it once they finally get to my application. But now 28 days later in the RFER stage; nothing.
  2. I'm an RFER with a NOA1 in December. I'm at day 28 since the RFER, but I still haven't heard back for my approval.
  3. Congrats! That gives me some hope. I am at day 25 since they received our RFE. Hoping this is the week for us as well.
  4. It''s crazy how many RFE's are pending in December. Unfortunately they appear to be slow to approve RFE responses because they moved the majority of their volume to Jan. So it can take a while if you are unlucky like me. My RFE response was acknowledged by USCIS on Feb. 22. As of today I'm still waiting for them to approve it.
  5. They fixed it own there own. And because I replied to the RFE my status now says response to RFE received. Which happened after the letter saying to ignore the RFE request.
  6. For those that were following my request for initial evidence error. It's confirmed an error. I reported it to USCIS over the phone last week. Today I received a letter from USCIS stating the request for evidence of a I-130 was indeed an error on their part.
  7. The other option I am now looking at is expediting the case and selecting clear USCIS error. That's an option the other person who has this issue told me about. Otherwise I'm losing many weeks of time for something that should have been approved last week when they looked at my application.
  8. Someone in my other thread got the exact same RFIE as me asking for an I-130. And they have the same NOA1 date as me. I bet the same agent made this mistake on more than one application.
  9. We have the same NOA1 date. I bet the same agent was working on both our applications. Luckily someone is getting back to you. When I called USCIS yesterday and explained this, the person went silent. Then said they could not provide me any advice and that I needed to contact a professional. Pretty sure they knew they someone messed up and didn't want to say it.
  10. I'm in discussions with two immigration lawyers. The first one went over all my documentation and facts and said the same. This RFE was requested in error. I should respond with a cover letter reminding them I am not married, pointing to my application being for K1, and showing that K1 does not require a form I-130. If the second lawyer says the same I will go with that. Hopefully this helps anyone else who randomly gets this specific issue like I did.
  11. Confirmed on my photo copy that: Submitted form I-129F Box 4.a. is checked boxes 4.b. and 5 have no checks Thank you for your guidance. That seems simple enough. Just so scared of sending an incorrect response since I only have one shot at this. Didn't think they could request evidence in error.
  12. Hi. I received a Request for Initial Evidence today for my Fiance Visa application (see screenshot below). Original NOA1 was from December 15. They are requesting evidence of a submitted form I-130. I don't understand how to respond. I requested petition for Fiance (checked box 4.a.). I did not request Spouse (did not check box 4.b.). I confirmed by checking my copy of the initial application. I answered no to both questions related to myself or my fiancee having children. I don't understand why they are requesting proof of submitting a form I-130. Nor do I know how to respond.
  13. I have box 4.a. Checked. Not box 4.b. I just checked. I'm going to end up paying an immigration lawyer for help. I have no clue what to do.
  14. I just went back and checked my application. I checked No for both questions related to myself or my fiancee having any children. So I can't imagine why they think I'm petitioning for a child.
  15. I received the letter for my request for Initial Evidence. It makes no sense. The first page lists all the info about my I-129F request. Then the second page is asking for evidence to show my I-130 form. I have never submitted an I-130 form. Not sure why they need evidence of a I-130 for a fiance visa. I can only assume this is an error request. I can't even think how to respond to this since there is no option for responding without an I-130. So stressful.

  17. I realized something interesting about my RFE. It's says "Request for Initial Evidence Was Sent". That initial word is very different than most RFEs I've seen. It sounds like they just need me to update one of the initial documents I submitted. I will confirm once I have the letter.
  18. I can't think of anything. I have multiple different types of proof of meeting in the last 2 years (still in the time frame as of today), two separate letters of intent to marry, passport pictures, all required forms, etc. Nothing complicated about my application either (no divorce, no criminal history, etc). I'm just hoping it's something really small and simple. I feel like most current people stop posting updates once they get RFEs so we never know what random reasons to expect. I'm surprised we rarely get posts for such high RFE rates in the lat few months. I'll for sure keep you updated on what they asked for.
  19. I just received an RFE today. I'm thankful my case was acted on, but now I'm so nervous about the RFE. I really thought I had my application rock solid. Waited so long for this moment and now I'm worried about what could happen. I just have to wait and hope it was some small simple thing they are asking for.
