  1. Hi guys, can someone please clarify part of I-130. I really need help. for part 4, it states: If the beneficiary’s native written language does not use Roman letters, type or print his or her name and use foreign address in their native written language. I am applying for my wife who is from China and using Mandarin. Although usually the language is written in characters but everything can be spelled in PinYin. Can I use PinYin for part 4? Or do I need to use Chinese characters? Does any section would require Chinese characters? With the exception of proof of marriage and documents, I know I would need both original documents AND translation. For question 62 where it asks for City/Province/Country where my spouse would need to apply for visa, the City/Province is where the US Consulate is located right? Since the petitioner(myself) is preparing the paperwork, do I need to fill out the interpreter or preparer section?
  2. Thanks for the reply. I have read others who have tried to delay the interview is a bad idea(eventually canceled). So I will apply I-130s together and if issues pop up during that phase, I will go from there. I think I am able to handle the kid differently as I have for past year.

I just want to clear some information up, maybe someone can help me with the right path for this situation. so basically, I’m worried that my stepdaughter might purposely say stuff at the interview phase to prevent both my wife and her getting visas. She has long history of being toxic to everyone but her mom. But not knowing that this is serious and will completely prevent her from coming to US. She might regret it later. She is a middle school dropout which is not common in China, when I met her mom she was already not going to school. I thought it would have been best to go back(I told my wife I would pay for her private school) since I thought US school would be great for her, I went through it. She hates school and found out I was the advocate for her to go back. Because of this, she dislikes me and has attempted to cause problems at family gathering etc, but rest of extended family knows her too well and nothing came out of it. All of my wife’s family loves me. My wife won’t leave the country without her daughter because she knows family from both sides does not want to deal with my stepdaughter. So I am worried that if my stepdaughter might cause problems at the interview. Does her interview affect my wife getting visa or just hers? Is it possible for me to file separately and then if say my wife gets everything done and is ready to go, can she wait for my stepdaughters case to come around and leave together? Please help, this is so hard for me to decide. I know it is not common to file separately.
  4. @powerpuffI apologize for not knowing. Does anyone know that if an interview doesn’t go well or if let’s say my stepchild says wrong things at the interview, does that prevent her from moving forward to get a visa stamp?
  5. Thanks again. After reading the post. I want to file online. Do you think if I follow physical paperwork, that will prevent mistakes that might happen? After reading I-130 PDF, it doesn’t seem too bad. I’ve always been a good citizen with clean record and followed the law. I feel like some times people make accidental mistakes that could make them look really bad in the eyes of Government.
  6. Interview abroad means going to a USCIS building in a foreign country right? What does adjust status mean? All this feels so stressful I’ve always been a good citizen and never got issues with the government. I feel like if I make a mistake, it can create a wave of nightmare.

  8. Thank you for the info. The child did ask her dad to come to prepare legal paper’s tomorrow morning. We’ll see how it goes. From my experience, even tho the bio dad has power to hold her, I think he rather not live with the child at all. It’s as simple as leaving her at her dads will convince him to give us the paperwork. They cannot stand each other. I’m sorry for previous post but I did leave out a little bit info about the kid’s personality. It’s complicated.
  9. She said whatever the kid decides for herself is fine with her. The main thing is bio dad is holding the custody. Does filing separately mean that shes leaving her kid behind?
  10. If I file separately, does the interview become separate too? The older child and bio dad absolutely hate each other so if she didn’t come with my wife and I. That’s who she has to live with.

  14. I was able to find my Certificate from USCIS for becoming a citizen. Do I need any sort of proof that child is under my wife’s custody to file for I-130? Or doe’s custody part only required during leaving the other country.
  15. 4. Bio father has custody right now. But she lives with my wife. Also, there’s a book in China where the child is registered under her name. Do I need proof of custody of child under my wife too? I was told that both parents had to sign for kid to leave the country. PS. There’s a poverty line if I need to make at least 23,000$ per year or have 69,000$ in savings. I do make more than 23,000$ but I owe some debt, does that debt matter?
  16. 3. I had my green card for over 10 years and it expired so I took the test and received citizenship. I was 28 or so when I became a citizen and this was back in 2018. 4. wife doesn’t have custody, we just found this out. Can that be transfer right now? We got married in 2021, October 12th. And the kids are under 18.
  17. Hi guys. I am trying to file IR-1 for spouse and stepdaughter in China. I am a US Citizen. Marriage is less than 2 years old. I have been reading the guide for I-130 but unsure of some things. 1. I saw that there’s option to file online? What is the difference between filing online and sending everything in? 2. Cover letter. Is an explanation of what I am petitioning including all the important names as well as table of contents for everything enough? Do I need to number the pages? 3. I have a passport which can be copied for proof of citizenship but I don’t remember if I was given a naturalization document back in 2018. What can I do? 4. Right now I have our marriage translated and in the process of trying to get birth certificate translated and sent to me. Also translation of previous divorce for my wife. What else do I need from her end? Do I have to send any document in original form in or can they all be copies? With the exception of my Check of course.   19. Can you please confirm that a translation of birth certificate AND our marriage certificate is enough? Those 2 documents can proof that she is my step daughter? My wife is trying to get this right now. Sorry for asking for reassurance.
  20. Hi guys, so my wife and I got married in China. I've got the marriage certificate translated and stamped. Where do I report that in the US? Or do I just directly start with USCIS IR-1/CR-1? Here's the info I found in my State: Can I register my marriage in Pennsylvania if it takes place in another State or foreign country? No. Your marriage can never be registered in the Commonwealth of Pennsylvania or in this County. You should be certain to get a certified copy of your marriage license from the State or foreign country where the marriage took place.

  22. Thank you guys for the replies, yes I am in China so I do need the father's permission to migrate the child. Is it enough just to get a document stating that she's the daughter of my wife? Since wife and I have marriage certificate.
  23. So I have a marriage certificate with my wife. Do I need direct proof of relationship to child? She's under her dad's name. To submit to USCIS, is it enough just to have two documents of one proving that she's the child of my wife and our marriage certificate? Or Do I need something directly saying that I am the step father of the child?
