    Im sorry for what happened to you, and yes your case shows red flags, BUT good thing, you waited 4 years to marry again.   That is a bit of a plus for you.  
    Have you checked your case on line?  You may want to make a info pass appointment, maybe get answers there.
     
    You can overcome this,  I married to soon after my Ex- Egyptian husband divorced me, but my current  ( and last Husband) and I managed to get through the process, and we had LOTS of red flags.  Finally after nearly 3 years ,  He was granted a 10 year green card back in 2019
    He now is awiting processing of his citizenship.  ♥

    Absolutely the dodgy circumstances of your first immigrant marriage are and will cause extended delays and processing for this case.   There is no way to predict how long it will take.

    There's no way to really know for certain, why your case is taking longer, but it does make sense that they are looking into your previous case.  It's possible that once they got the files together, it was kicked into another queue for a more senior officer to evaluate.

    The decision will be made based on all the facts they have.  We don't have those facts.  We don't know what other red flags there may be.  Red flags are things like marrying on the first visit, and in that region, the woman being significantly older than the man is a red flag.  The bigger the age difference, the bigger the flag.

    you need to do 1040 x to amend the 2022 as you are married /not single
    if u want to do MFJ and claim spouse follow the IRS site for nonresident alien spouse filing the W7 and providing needed documents
    and go for the $ 25,900  giving u a bigger rebate check

    otherwise ,  lose the extra $12,950 deduction and file MFS (that  is separate not single)

    How many have you filed a K1 and did it cause a red flag? I am thinking your answer will be I have never file 2 or more K1's, this is what I think
     
    I can tell you from reality it caused no red flags and maybe could possibly  speed up the process since the petitioner has already been vetted by USCIS once.  Nothing mentioned at Embassy Interview regarding past K1's applications, only about a 3 minute interview consisting of maybe 7 questions and boom you are approved.

    They probably look at it but you’ll have to submit a current / updated one after the petition is approved.  It isn’t needed at the petition stage.

    No, you should not send it as it is not on the list of documents to submit with I-130. You submit it after your petition gets to NVC

    The I-864 is not needed or even looked at until the NVC stage of the process.

    Good evening every one. I hope someone with more knowledge than me can help me out with the following question, and thank you in advance.
    In the application I-130  (page 8 of 12 Part5. other information).....is asking if I have ever filed a petition for this or any beneficiary or any other alien.... The story is,,, that I was previously married and did filed a K-1 Visa, which petition was approved..... therefore, I am CONFUSED whether I am being asked if I have previously filed/petition a I-130 visa (the answer would be NO) or if I have filed/petition any other type of visa (then the answer would be YES)...
    Can someone help me answer this question the right way please?  Thank you

    You forgot to read the word “UNLESS”. This change all the meaning.
     
    5. A spouse, if you gained lawful permanent resident status through a prior marriage to a U.S. citizen or lawful permanent resident, unless:
    A. You are now a naturalized U.S. citizen;
     
    So, yes, you can file for your spouse
