Petition for Step Son
Devarj replied to Devarj's topic in Bringing Family Members of US Citizens to America
I finally got to the NVC stage after a two year wait. I'm a USC and my stepson is under 16 and lives in Vietnam. Which form I864 do I file? Only the I864W? Or do I need to file an additional 864 form to complete the Affidavit of Support. The instructions are a bit confusing. I'm aware that I also have to upload Tax Transcript, but how many years of transcripts are required. My NVC notice does not provide specifics. Thanks in advance. -
Checking my I130 petition today on the USCIS site. Case Status page says 4 weeks until completion. Then checked the Documents tab and found the I130 approval letter. Point: Always check the document tab when checking the status.

Filed our I130 in March 2022 for stepson to join us in USA. Few months ago said processing time 3 months. Two months later said 1 month. Then 4 weeks, 3 weeks, to 1 week. After one week, the processing time projections dissapared. Now back to saying actively working on your case. That was three weeks ago and still no status. I would disregard that timeline. It's meaningless.

How do I expedite CR1 Visa process?
Devarj replied to C2024's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
I filed I130 in March 2022 for Step son to join his mother and family in US. Still waiting. Three weeks ago USCIS website said one week for decision. Just have to wait. -
Sad news. Hang in there; it will all work out. Sorry, I'm not familar with Counsulate in Thailand. In Vietnam, HCMC, you can interview without the medical exam completed. I would email the office handling your case to be sure you cannot interview without the medical exam completed. On a side note, my wife and I lived in BKK in 2019-2020; We had a wonder time there.

Got my spouse visa in a short time in HCMC. Submitted about 30 pages of documents. If in doubt; submit it. -

Devarj replied to Penguin_DE's topic in IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports
Next it will say 3 months vice 2. 6 months later it will say 2. I pay absolutely no attention to their estimates. -
Best method to apply for CS1
Devarj replied to Jeff06098's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
DIY. Essentially, you're doing everything anyway. Gathering all the edvidence, documents, etc. The lawyer compiles, fill out the form, and file. Having done this twice (for spouse and step son), it's not complicated. As said above, meticulously follow the instructions. A friend had an attourney file, but the attourney forgot to get the petitioner to sign the form. After waiting 8 months, it was kicked back for signature and the waiting restarts. Lesson Learned: check, check, and double check to ensure all is correct before submitting. -

Ah! I did not know that. But makes sense. Had I known, I would have loaded up documentation from the start. Thanks -

Petition to Remove Conditions on Residence - I751 -
After 22 months since filing the I130 petition to bring my stepson (under 18) to the US from Vietnam, I got an RFE from USCIS. My spouse was awarded her visa CR1 in 2021 and we moved to the US in Dec 2021 (already filed for Change of Status). We are both living in US since 221 with our biological son (Born in Vietnam but holds a US passport via CRBA). First of all, it is a bit odd that the RFE requests proof of Bona Fide Marital Status (essentially asking fo all the proof we submitted for my spouse to get her visa such as potos, correspondances joint account, leases etc.). On the I130 (for stepson) I submitted our marriage certificate with translation. They also requested Proof of Legal Termination of Marrige (again all was submitted in order for my spouse to get her visa). Again redundant resubmitting. Question 1: Isthis a normal to re-request all this iformation? Question 2: Can someone please explain this statement (page 1 of the RFE) IMPORTANT: THIS NOTICE CONTAINS YOUR UNIQUE NUMBER. THE ORIGINAL NOTICE MUST BE SUBMITTED WITH THE REQUESTED EVIDENCE. You are receiving this notice because U.S. Citizenship and Immigration Services (USCIS) requires additional evidence to process your form. Please provide the evidence requested below. Include duplicate copies if you are requesting consular notification. In particular, is the ORIGINAL NOTICE the RFE and does that have to be submitted with the responses? Also, since my stepson resides in Vietnam do I need to send duplicate copies for consular notification? Question 3: Page 5 of the RFE states COVERSHEET SCANNING REQUIRED PLEASE RETURN THE REQUESTED INFORMATION AND ALL SUPPORTING DOCUMENTS WITH THIS PAGE ON TOP TO: USCIS/TSC ATTN: RFE/NOID/NOIR/NOIT 6046 N BELT LINE RD STE 108 IRVING, TX 75038-001. Silly question, but I can submit all the required documents online. Do I still need to mail to this address. If not, which method is preferred, online or mail? Thanks in advance.

Filed an I130 petition on March 2022. No status update other than the normal As of March 30, 2022, we are actively reviewing your Form I-130, Petition for Alien Relative, Receipt Number XXX. Our records show nothing is outstanding at this time. We will let you know if we need anything from you. When I look at the For USCIS Use Only section of the I130 (attached), there are some adminstrative action annotated. Can anyone shed some light on what this might mean as it pertains to the current status? For example, Initial Receipt, Resubmitted, Relocated etc.

NVC approved the expedite. Now what?
Devarj replied to PAbshir's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
I was also in Vietnam with the same circumstance. Embassy contacted me with email letting me know what was needed for the interview and how to schedule an appointment if I couldn't make the one that was given. Email came about 10 days after NVC approval. Yours may be sooner pending on your circumstance. -
DCF file and request expedite due to job and finicial losses. I did the same in Vietnam. Requested expedite via DCF due to a job offer in the US. I stated that I would incur finicial hardship if I were not able to accept the offer and did not want to leave my wife in country. Expedite was approved and got the visa @ three months later. Would have been sooner but the consulate was closed due to COVID lockdown.

Same issue in Vietnam. Locked out for 24- 48 hours. There was a community group in Vietnam that posted immeadiately on FB when (time and date) folks logged on a got an interview date. Based on that information I logged in daily at 0830. Got a date after two weeks. Not sure if there is such a FB group in your area. Would be nice to find such information and look for trends in the best time to check.

Visa Gantt Chart & Benchmarks (Japan Data)
Devarj replied to cmeeks's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
Impressive work. I did a DCF in Ho Chi Minh City. With an exemption letter, the entire process took 6 months. Would have been 4 months but the counsulate was closed due to Covid restrictions. The Exemption Letter indicated that any visa delays would result in financial hardship due to job opportunity in USA. Just saying that there is always another set of outlying data to skew your results 😉 -
Thanks Return is August 20th
