My buddy's I-130 is at NFC for his wife but not her 8 year old child. Got the message 'The petition you have filed does not allow derivative status for family members. This means that any spouse, unmarried child under age 21, or parent will require their own petition to immigrate." So I assume this would requires a new I-130 for the child with the same processing timeline as for the wife. (Roughly six months). The child's US tourist visa expires in 2026. Should she just enter on the tourist visa and then do an adjustment of status?

Jenny is still in transit. When she gets to her mom, she will send a picture of her passport stamps. I suspect she has neither her visa along her green card with her. Based on Mike E's comments, she will have the picture of her green card and me waiting at the airport with the green card. PDX MAY be relaxed about these things. It is recovering from a terrible reputation, years ago for international travelers, lost its CBP presence and worked hard to to get it back. When I returned to the area, I was pleasantly surprised by the number of international connections. Some have commented that shipping to a war zone is risky. I agree. My thought was to ship to a hotel at the airport in Warsaw - not a war zone. But I will go with Mike E's suggestion: relax and pay the fee if it is assessed. Not a huge deal. Thanks for the comments. I think I will UPS it to her at a hotel near the airport. About $225. I recommended that she staple it into her passport (like I did my COVID docs) - she declined. Is that a good or bad idea?

Do I need to mail it to her in Ukraine? We have two weeks or so before her return.

They are seeking an immigration visa. She is leaving to stay with family in Ireland before her current I94 expires. Her base of operations has been with her husband ever since they married. In addition to competing internationally in her sport, she was finishing her PhD in Kyiv.

My buddy, after years of prodding, is finally about to hit send on the I-130 for his globetrotting wife. A couple of loose ends I assume it is OK that her address is his address because, well, that is where her stuff is. And I assume it is OK for him to submit while she is still in the USA. TIA

To review. My wife is in the country with her 2 year GC. Per my profile. For a variety of reasons, my friends have not completed the GC process. She competes internationally. He was pretty hot in his sport in his prime. As mentioned, it is a complicated relationship. They asked me to help them through the I-130 process. She does not want to stay in the USA for the entire period on an AOS. This group has been very helpful helping me to understand that they should work the I-130 through to its normal completion. And that is what they will do (I hope). Sorry that I was less than totally clear through this thread. Now can we put a lid on it?

Hey mod, you can close this thread. I am very grateful that I don't have to deal with the I-485 until my wife is ready to adjust. And the lightbulb goes off for me. We will have the I-130/I-485 combination when that time comes. DUH!

Not true. What I learned today from this group is that in her case, the I-485 does not apply. There are complicated relationships and then there are COMPLICATED relationships. This couple has the latter. And yes, I am helping them.

I see a lot of discussion about an I-485 filed after an I-130. She can certainly stay outside of the USA until the I-130 is approved. I wonder why the I-130 then I-485 shows up so often in the forums.

My friends (USC/Ukrainian) have been married for 4ish years but never got around getting her a green card. Now they are 100% ready to go - they promise. She obviously has a tourist visa. Can he initiate the AOS whilst she pops over to see her father in Ireland for a bit? She is closing in on 180 days on her current I91 Will there be a problem with her re-entering while an AOS is in process? TIA

Will people entering the USA under the Ukrainian Humanitarian Parole program have special restrictions? My assumption is that if they want to leave for a time, they only must request advanced parole. How long does it typically take for advanced parole to be approved? How long does it typically take to get an authorization to work?
