Hi,
I am currently in the NVC stage of my IR1 visa process. We’re about to submit my husband’s AOS.
However, we’re not sure about the number of our household size.
I have a child with my American ex-fiance whom I had a relationship with while I was working in the US. We never got married. And I gave birth in the Philippines. Our son became a US citizen through CRBA.
After a couple of years, I met my husband and we got married. We have 2 kids together of our own. He has 2 kids from his ex in the US. My husband never got married to his ex.
Now, we’re trying to migrate to the US. My kids (2 with my husband and my son with my ex) and I. My husband is already there working and waiting for us.
How should we calculate our household size?
Should I include my firstborn son (with my ex) if my ex supports him financially? My son is going to live with us when we’re in the US. I don’t know if that matters. If we include him, the total will be 7.
Or should I just count the children I have with my husband, plus his other 2 kids (my stepchildren; since he supports them financially) plus of course my husband and I? Total of 6.
We’re really confused about this and I don’t want to get an RFE because of this.
