Our DQ date was October 19 2022, so we are not really missing out much. We attempted to expedite our case as Physicians but were rejected unfortunately so went with this other route. Our last straw was when we saw that Montreal did not move their EB at all this past month. Canada has continued to disappoint us time and again. This other country has a significantly shorter wait time and hence we wanted to try our luck. Our last resort is to AOS. -

I want to share that we were able to transfer our IV case to another consulate given that we no longer reside in Canada. Happy to share back when we receive IL. I will remove my name from the tracking sheet. -

From my understanding, Montreal is the one who decides whether a case is interviewed, not NVC. From expedited request perspective, it is also Montreal that decides whether a case can be expedited or not. NVC has no power to expedite a case. -

As of December 9, 2022, most Immediate Relative and fiancé(e) visa cases being scheduled for interview in Montreal were documentarily complete at the National Visa Center in September 2022; most Family Preference cases with visa numbers available that are being scheduled for interview were documentarily qualified in July 2022; and most Employment cases scheduled for interview were documentarily complete in October 2020. "As of November 3, 2022, most Immediate Relative and fiancé(e) visa cases being scheduled for interview in Montreal were documentarily complete at the National Visa Center in August 2022; most Family Preference cases with visa numbers available that are being scheduled for interview were documentarily qualified in May 2022; and most Employment cases scheduled for interview were documentarily complete in October 2020." This is actually not true. An approved I-140 in itself is not grounds for denial of TN. If you apply for Consular Processing, it shows that your intentions are to adhere to the non-immigrant intent of TN, since you will actually physically be leaving the country prior to applying/receiving your green card. At least this is what was explained to me by my lawyers. -

Highly doubt they will waive the interview. EB2 isn't anymore special than the other groups. -

I don't think the split will ever be equal based on past trends. The number of EB3s approved is significantly higher than EB1 + EB2 combined. EB1 average = 15/month EB2 average = 20/month EB3 average = 70/month -

We will see how many months FB petitions jumped on December 3rd by clearing 230 cases in Oct. Base on this current trend, 1 month advancement = 100 IR/CR cases, ~87 EB cases, 53 FB cases If they increased capacity on EB cases to match FB (i.e, ~250 cases/mo), they will clear 3 months at a time. It would require 8 months of this increased capacity for EB to catch up with the other categories at minimum, while not letting the other categories fall behind again. -

Yeah we are already planning to apply for AOS and now gathering documents to do so.
