I hope everyone is doing well, I recently received an RFE, and just wanted to what is the opinion of all the experienced members. Is it doable?
I am supposed to get my automatic fourth Prima facie as my current one expired on 07/17/2023. I asked my lawyer to see why uscis didn't send the 4th pf and they said they will send a letter requesting one. Completed 25.5 months of waiting with case status fees was waived on I-360. The wait is excruciating
Thanks @balo101, So asylum can only be claimed when you enter via a land border. Is there no way you can file some uscis or dos form asking for asylum? After it has been approved you can come via airline showing them the same.
I am sorry to hear your situation. I am not a lawyer and not sure if this is the right advice but what I am thinking is since you said your life is in danger and you will not go back to home country, maybe you should board the plane to USA and tell the carrier that you are going to claim asylum in USA based on the hardship and at the cbp you will definitely be referred to secondary. There you can explain your situation to cbp officer to let you enter the country. As Unlawful Presence and Inadmissibility exception is provided for asylum seeker and vawa people. Just a thought.
Thank you @Pinkrlion but why would NBC request for medical to be send to them.. Wouldn't it be more efficient to send the medical directly to Field office?
I agree this process to be correct for I-130+I-485 but since I-360 have been approved. Wouldn't it be more efficient if there is no need an only medical is needed and if the file is complete they can directly approve I-485 and dispatch the green card?
