Hello Everyone, thank you for your support on this issue, I wanted to give an update on the case I received an email from the embassy. since I was told to contact them when the visa is ready. does that mean I might be going in for another in person interview? Will I be asked to reupload my documents ? should I request for the case be transferred to the country where I am since I’m no longer in Canada?

  3. Below is what I was given at the embassy after my interview. i never received an official email that it was expired it was when I logged into the CEAC tracking that it showed expired. That’s how I knew. can you please direct me on how my mom can get in touch with a congress man in ohio thank you so much for your help
  4. 1. Reason for denial was because I was out of status although my student visa expired during the process of filling my application and as soon as my adjustment of status was denied I left the country. 2. I emailed them a few times each year, the first time I tried arguing that the NVC approved my CSPA but they refused to acknowledge it. As a matter of fact I updated my passport with Montreal last December/ November. 3. I logged in every year and last year the CEAC opened to re update my DS260 which I did.

  7. I had one at some point but she got sick and was unable to represent me at that time I got denied I tried writing to the consulate but they just told me there wasn’t a visa available for my category

No nigerian filed my 797 form July 31st 2019 Priority date 09/ February/2017 ds 260 submitted A visa became available to me on July 11, 2019 when the I-130 was approved, because at that time the F2A visa category was "current.". Initially the NVC closed my application because according to them I had aged out of my visa category and transferred me to F24 after I had cleared my documents so in order to qualify so that my case could be reopened and forwarded to the embassy for the interview under the Child Status Protection Act I did the calculation and forwarded an email to the NVC about it which was approved. It appears that the consulate may have determined that I did not meet this 1 year requirement. I was 20 years, 4 months, 17 days old when my I-130 was approved and a visa was available as of that date. My I-130 had been pending for 2 years 5 months, and 2 days. i did this when I filed the I-485 Application to Register Permanent Residence or Adjust Status (which was July 24, 2019). I also sent an e-mail to NVC in July 2019 notifying NVC of My plan to file the I-485.   9. I submitted in January 2021 i was already in the US when the filing started after my 130 was approved I filed for adjustment of status because I was in the US instead of continuing with the NVC
  10. Now that it says expired what do you think I should do because on the CEAC document upload page it still states that my case is still with the consulate

Okay so when my I-130 was approved I was in the US filing for adjustment of status but it was denied so I left the US after leaving I was sent an email by the NVC requesting that they wanted to reinstate my visa application I had no idea about anyways they reinstated fast forward to a year after went for my interview it was then refused and told to wait till my visa becomes available for the category that I was transferred to
  12. About 2 years 5 months ish I tried going for the CSPA the NVC agreed so they reopened the case then the consulate denied it
  13. the priority date is there 09/February/2017 country: Canada-montreal i went for the interview when it was current but I was told to come back since I had outgrown the category and wait till it was available for adult child of green card. i was told by the consular to resend my passport when the visa becomes available its not available yet cause according to the visa bulletin 01/ January/ 2017 my mom filed for me she’s still a permanent resident

    At the interview, I was told that I didn’t have a current visa available for my category since I had outgrown it from child of a permanent resident to adult child of a permanent residence and I was told that another option for me was that I must have "sought to acquire lawful permanent resident status within 1 year of a visa becoming available to Me." According to the Consular officer I was then told the only option was to wait till a visa is available for that category and gave me a paper.
    I checked the visa availability on the visa bulletin it’s just on January 2017 and my priority date is 09/feburary/2017 
     
    I tried tracking my visa application and and I noticed it wrote expired when initially it used to refused and that it was undergoing administrative processing and now when I check it says “ you have been notified your immigrant visa has been cancelled, and any petition approved on your behalf was also cancelled. We informed you that your application might be reinstated within one year if you could establish that your failure to pursue your immigrant visa application was due to circumstances beyond your control” I was never informed of this I didn’t even get an email.

    “Since you have failed to do so, the record of your registration and any petition approved on your behalf and all supporting documents have been destroyed.  Any Department of labour certification has been returned to your prospective employer.

     

    I literally logged into my CEAC.state.iv and it showed that my case was still at the US consulate in Montreal with all of my documents that was initially submitted.

     

    does that means it’s truly expired or what do I do in this situation

  16. Thank you, I’m from Nigeria… do we have any estimates for the dates? And will I have to submit documents all over again when it becomes current? sorry one more question does table B which is the dates for filing apply to those outside of US that are just about to start their application with NVC ?
  17. So I have to wait till the priority date becomes current? I have siblings that haven’t started their process yet does the dates for filing apply to them? They are back home in my home country

No I didn’t I left before 180 days was up and while I was at the interview I wasn’t asked anything about that neither did the consular mark a waiver on my 221g I was looking at the visa bulletin and noticed there’s a final action date and a date for filing I thought the final action date which is year 2015 is for the final stage while the Date for filing is for the beginning of the process like submitting documents etc is with the NVC.

Hello everyone, I started my immigration journey back in 2017 February as a student in the United States then my mum filed for me, fast toward a couple of years my adjustment of status was denied due to me being out of status and I had to leave the United States to Canada then I continued my application with the NVC after submitting all documents a couple of month before I was due for interview they transferred my visa category from F2A to F2B and close the CEAC I was confused then I wrote to them using the CPSA calculation process for my case then it was re opened because I was a minor when my application started… couple of months after I went for my interview and was denied because I had outgrown my visa category and I was now permanently transferred to F2B even though the NVC initially approved it, I was told by the consulate officer that I have to wait until there is a visa current for that category then I could send in my documents….my question is looking at the visa bulletin the filling dates are in Jan 2017 and my priority date is Feb 9 2017 so I wait until the fiscal year before I email the embassy or the NVC because the last time I emailed the nvc they told me it case was now with the embassy there was nothing they can do…. Or am I going to start all over and wait till the final action date is in 2017? please help I’m starting to get frustrated and depressed
  20. Hello guys, so I went to the consulate today and was denied because according to the consular officer. I aged out of my visa type which is f2A now f2b An unmarried child of a LPR the thing is I filed for the cspa law a year ago and I was approved but for them to deny it at the embassy is confusing. What do I do?
