Old March 2021, I-129F filer here. July 2022, AOS filed. No EAD or AOS interview yet. Our local field office is Atlanta which has a 32.5 months wait for AOS. One unknown for us is if our AOS does take 32.5 months or longer, will USCIS give us a 10-year GC or a 2-year GC since we will have been married about 3 years by that time? If we do get the 10-year GC, then do we still need to file for the I-751 Removal of Condition? Or can we just wait for the 5-year rule and file for the N-400 Application for Naturalization? In addition with the current wait time, there are a lot of unknowns for our case that are maybe related to your case? -

Do you mean you filed AOS in December 2022? I've heard of some cases taking 6 weeks to get NOA1. Did you send by FedEx, UPS, DHL or US postal? With signed receipt? Did you check if your payment has been cashed? -

The overseas medical exam form is DS-3025, which was supposedly submitted from the doctor directly to the consulate for the K1 interview. My K1 beneficiary did get a copy of the DS-3025 and the CD of the x-rays from the overseas doctor. We specifically made sure she got a copy of the DS-3025 and even offered to pay for a copy if necessary. And we did include a copy of the DS-3025 with the I-485 AOS filing. A sealed copy of the DS-3025 was supposed to be part of the "brown package" that the K1 beneficiary brings to the POE. https://www.visajourney.com/guides/k1-fiance-visa/ https://www.visajourney.com/guides/adjustment-of-status-k1-k3-visas/ The CBP was supposed to forward the "brown package" to USCIS. For whatever reason, USCIS gave you an RFE for the I-693 because they think the DS-3025 that you have is not sufficient? https://www.visajourney.com/forums/topic/551080-immunizations-ds-3025-or-i-693/ Your only option is to find civil surgeon and do whatever medical exam is necessary to complete the I-693. https://www.uscis.gov/tools/find-a-civil-surgeon For what it's worth, getting an RFE for I-693 at least shows some movement in your case, and that the USCIS has at least seen your case, as opposed to just stuck on "actively reviewing". https://www.visajourney.com/forums/topic/793286-courtesy-notice/?tab=comments#comment-10770859 So I would just follow thru with the RFE for the I-693 with the civil surgeon, and pay whatever the cost to get your case moving again. -
Greetings all, We are K1-to-AOS filers, and currently waiting for EAD and AOS. My former K1 beneficiary worked overseas till about May 2022. She came to the US on a K1 visa in June 2022. Then soon after we filed for her SSN, got married, and filed for AOS/EAD/AP. Since we are still waiting for her EAD and AOS, she has not worked and has no earned income, but she does have unearned income from bank interests as a non-resident alien since June 2022, along with her foreign earnings up till May 2022. I am currently working on filing joint tax return for us that is due in April 2023. My question is do I report my spouse's foreign earnings in our joint tax return, even though that was before she got her SSN? Also is there any special form(s) or process designation or special rules that I need to adhere to since the joint filing is between a US citizen (myself) and a non-resident alien (my spouse)? Any special guidelines? Thanks in advanced for any response.

What the NVC provided in the past was the phone call-in to request your case number (which is different from the USCIS receipt number) and the invoice number (which is like the password for the case number to input to the CEAC tracker) after it was assigned by the NVC, which allows you to use the CEAC tracker for the status update of the case. https://ceac.state.gov/CEACStatTracker/Status.aspx And NVC may even mail or email (to the email address provided in the I-129F) the case number notifying that the case is transferred to the consulate. The case number is then used for the DS-160 and UStravelDocs. In the absence of the NVC providing the case number, the Packet 3 notification would have the case number from the consulate sent theoretically to the K1 beneficiary (either with the email from I-129F or the beneficiary mailing address). Keep in mind that after the NVC stage, theoretically all the steps remaining in the K1 process at the consulate stage are to be completed by the beneficiary (medical exam, MRV fee, interview, etc.), and the only task that the petitioner needs to complete is to send the beneficiary the I-134 affidavit of support, which the beneficiary takes to the interview. All these steps may be specific to the embassy/consulate. So for example, the steps in Packet 3 from Manila Packet 3 may be different from Warsaw Packet 3, etc. So follow your consulate site instructions--don't assume all the consulates' processing are the same. As it seems with NVC no longer providing call-in support for the case number, then the only option is to wait for the Packet 3 from the consulate. If the wait time seems abnormal, I would call the consulate to see if they have received the case (using the USCIS receipt number) and see if the consulate could provide the case number and the Packet 3 notification? With the shortage of workers either at the NVC or the consulates, I would not be surprised if some cases slip through the cracks and the beneficiary/petitioner never gets notified? So I would stay proactive and contact the consulate if needed. But at the same time, I anticipate the K1 process to evolve and these steps may be very different in the future rendering any advice from old K1 applicants to be obsolete.

And the Packet 3 notification can be received about 101 days=48+53, which is about Jan-Feb, 2023. But trends have been increasing so it is very possible that the wait times can be extended. Which embassy/consulate is your requested K1 interview? It would help if you fill out the Timeline which can help improve the Visajourney stats pages. According to the stats pages, a case can take an average of 48 days to go from NOA2 to NVC. https://www.visajourney.com/times/k1-fiance-visa-historical/ Then your case can sit at NVC processing an average of 53 days. All these depends on your consulate processing (backlogs, etc.). You can keep calling NVC to get your case number and invoice ID which you can use for CEAC status, DS-160 and UStravelDocs, but your next notification should be the Packet 3 from the consulate, either by mail or email.

Yes, you can add your I-765, I-485 and I-131 receipt numbers to the USCIS CaseTracker app or in your myUSCIS. You will just have extra statuses in your My Cases--another place to see "Case Is Being Actively Reviewed by USCIS" if it makes you feel better. -

Anyone else get this EAD approval is past due from Visajourney? Regardless, USCIS processing time shows 8.5 months for 80% of the cases completed. Earliest we can submit questions to USCIS about the case is July 2023. Anyone else still waiting like us? -

If you are going to move, then you have no choice but to update your address and your case gets transferred to the new field office. No one really knows how USCIS "queue" cases anyways so it doesn't really matter what position you are in, but not updating your address does have negative consequences. -

I input your NOA date into the USCIS processing site and this is what I get. Notice that for your date, you have a "Service Request online" link. Try that. It won't hurt. -
List your spouse as beneficiary on life insurance, 401K, retirement accounts, trusts, etc. may also help.

After marriage, you can usually update health insurance to cover spouse retroactive to the date of marriage even if you don't have the marriage certificate right away. -
