Have you tried asking Emma about the status of your receipt number, or about if interview is waived? I personally would just wait to see if the GC is produced and maybe call USCIS to confirm no interview is required? -

I can't speak for the I-130. But if the I-485 is approved, then the I-765 is no longer necessary. After you receive the GC in the mail, then you can do pretty much everything a US citizen can except vote. -

Haha. Thanks. Yes. I sent the fax from a FedEx print store. It costs a total not including tax, 43.02=18 pages × 2.39 per page. USCIS gave specific instructions on how to send the requested "additional information". From what I read of others, USCIS instructed them to upload to the myUSCIS or mail-in RFEs. I think it depends on the USCIS worker on your case for what is convenient or reliable for them to receive your correspondence without getting lost in the bureaucracy. -

Thanks @slavaskii !!! Since the wait times have been extending, I'm keeping an eye out on posts about the 2-year vs. 10-year GC. I've seen some different and conflicting cases and advices. And the case approvals may be dependent on which USCIS agent interprets the case? For example if I remember correctly, one case took over 2 years to approve, but the USCIS agent interpreted that since at the time of the filing the marriage was under 2 years so the AOS is only eligible for the 2-year GC. Then the filer appealed, and the appeal was taking another 2 years at which time, they filed for the I-751 anyways. So the total date to I-751 was almost 5 years and they also filed for the N-400. Another case was the marriage was under 2 years when the AOS was approved for the 10-year GC, in which case another form has to be filed to correct the USCIS mistake. If you don't then that could affect the N-400 application later on. But the correction took another 2 years and the filer got the 2-year GC, and at which time the filer was not sure if they are eligible to file for the I-751 or have to wait another 1.5 year or file for the N-400? The prevailing advice for those whose AOS wait time is over 2 years and receive the 10-year GC was that they do not need to file for the I-751, but there were some pointing to cases where USCIS would reject other extensions or applications since they did not file I-751? At which time, the filer had to submit more paperwork to explain there case. As for the 3-year (marriage to US citizen) vs. 5-year rule for the N-400, the 5-year rule requires A LOT less paperwork, whereas, filing for under the 3-year rule requires more proof of bona fide marriage, etc. and more waiting. With the current wait times, the 5-year rule may be more preferable in terms of less wait times and less paper work. When I have more time, I'll try to post links to these cases (visajourney, reddit, facebook, etc.) if this is of interest to anyone, but I don't think this is the right forum to do it? Because of the extending wait times, I can foresee more non-textbook exceptions coming up? If anyone comes across such links, please message me. Thanks much! -

Old March 2021, I-129F filer here. July 2022, AOS filed. No EAD or AOS interview yet. Our local field office is Atlanta which has a 32.5 months wait for AOS. One unknown for us is if our AOS does take 32.5 months or longer, will USCIS give us a 10-year GC or a 2-year GC since we will have been married about 3 years by that time? If we do get the 10-year GC, then do we still need to file for the I-751 Removal of Condition? Or can we just wait for the 5-year rule and file for the N-400 Application for Naturalization? In addition with the current wait time, there are a lot of unknowns for our case that are maybe related to your case? -

Do you mean you filed AOS in December 2022? I've heard of some cases taking 6 weeks to get NOA1. Did you send by FedEx, UPS, DHL or US postal? With signed receipt? Did you check if your payment has been cashed? -

The overseas medical exam form is DS-3025, which was supposedly submitted from the doctor directly to the consulate for the K1 interview. My K1 beneficiary did get a copy of the DS-3025 and the CD of the x-rays from the overseas doctor. We specifically made sure she got a copy of the DS-3025 and even offered to pay for a copy if necessary. And we did include a copy of the DS-3025 with the I-485 AOS filing. A sealed copy of the DS-3025 was supposed to be part of the "brown package" that the K1 beneficiary brings to the POE. https://www.visajourney.com/guides/k1-fiance-visa/ https://www.visajourney.com/guides/adjustment-of-status-k1-k3-visas/ The CBP was supposed to forward the "brown package" to USCIS. For whatever reason, USCIS gave you an RFE for the I-693 because they think the DS-3025 that you have is not sufficient? https://www.visajourney.com/forums/topic/551080-immunizations-ds-3025-or-i-693/ Your only option is to find civil surgeon and do whatever medical exam is necessary to complete the I-693. https://www.uscis.gov/tools/find-a-civil-surgeon For what it's worth, getting an RFE for I-693 at least shows some movement in your case, and that the USCIS has at least seen your case, as opposed to just stuck on "actively reviewing". https://www.visajourney.com/forums/topic/793286-courtesy-notice/?tab=comments#comment-10770859 So I would just follow thru with the RFE for the I-693 with the civil surgeon, and pay whatever the cost to get your case moving again. -
Greetings all, We are K1-to-AOS filers, and currently waiting for EAD and AOS. My former K1 beneficiary worked overseas till about May 2022. She came to the US on a K1 visa in June 2022. Then soon after we filed for her SSN, got married, and filed for AOS/EAD/AP. Since we are still waiting for her EAD and AOS, she has not worked and has no earned income, but she does have unearned income from bank interests as a non-resident alien since June 2022, along with her foreign earnings up till May 2022. I am currently working on filing joint tax return for us that is due in April 2023. My question is do I report my spouse's foreign earnings in our joint tax return, even though that was before she got her SSN? Also is there any special form(s) or process designation or special rules that I need to adhere to since the joint filing is between a US citizen (myself) and a non-resident alien (my spouse)? Any special guidelines? Thanks in advanced for any response.

What the NVC provided in the past was the phone call-in to request your case number (which is different from the USCIS receipt number) and the invoice number (which is like the password for the case number to input to the CEAC tracker) after it was assigned by the NVC, which allows you to use the CEAC tracker for the status update of the case. https://ceac.state.gov/CEACStatTracker/Status.aspx And NVC may even mail or email (to the email address provided in the I-129F) the case number notifying that the case is transferred to the consulate. The case number is then used for the DS-160 and UStravelDocs. In the absence of the NVC providing the case number, the Packet 3 notification would have the case number from the consulate sent theoretically to the K1 beneficiary (either with the email from I-129F or the beneficiary mailing address). Keep in mind that after the NVC stage, theoretically all the steps remaining in the K1 process at the consulate stage are to be completed by the beneficiary (medical exam, MRV fee, interview, etc.), and the only task that the petitioner needs to complete is to send the beneficiary the I-134 affidavit of support, which the beneficiary takes to the interview. All these steps may be specific to the embassy/consulate. So for example, the steps in Packet 3 from Manila Packet 3 may be different from Warsaw Packet 3, etc. So follow your consulate site instructions--don't assume all the consulates' processing are the same. As it seems with NVC no longer providing call-in support for the case number, then the only option is to wait for the Packet 3 from the consulate. If the wait time seems abnormal, I would call the consulate to see if they have received the case (using the USCIS receipt number) and see if the consulate could provide the case number and the Packet 3 notification? With the shortage of workers either at the NVC or the consulates, I would not be surprised if some cases slip through the cracks and the beneficiary/petitioner never gets notified? So I would stay proactive and contact the consulate if needed. But at the same time, I anticipate the K1 process to evolve and these steps may be very different in the future rendering any advice from old K1 applicants to be obsolete.

And the Packet 3 notification can be received about 101 days=48+53, which is about Jan-Feb, 2023. But trends have been increasing so it is very possible that the wait times can be extended. Which embassy/consulate is your requested K1 interview? It would help if you fill out the Timeline which can help improve the Visajourney stats pages. According to the stats pages, a case can take an average of 48 days to go from NOA2 to NVC. https://www.visajourney.com/times/k1-fiance-visa-historical/ Then your case can sit at NVC processing an average of 53 days. All these depends on your consulate processing (backlogs, etc.). You can keep calling NVC to get your case number and invoice ID which you can use for CEAC status, DS-160 and UStravelDocs, but your next notification should be the Packet 3 from the consulate, either by mail or email.

Yes, you can add your I-765, I-485 and I-131 receipt numbers to the USCIS CaseTracker app or in your myUSCIS. You will just have extra statuses in your My Cases--another place to see "Case Is Being Actively Reviewed by USCIS" if it makes you feel better. -

Anyone else get this EAD approval is past due from Visajourney? Regardless, USCIS processing time shows 8.5 months for 80% of the cases completed. Earliest we can submit questions to USCIS about the case is July 2023. Anyone else still waiting like us? -
