I'm thinking of withdrawing pending i-751 since my i-360 has been approved. And when I come back to the U.S I just file I485. ( I just don't know how much time I have).I am not sure if Even should, because when i751 is pending, my I551 stamp in passport says that I'm a conditional permanent resident since 2016. It's complicated. -

The attorney filed both: I-751 waiver and I-360 vawa. I think I didn't mess up i-360 since it's been approved. I guess a Vermont worker was more empathetic and considered my case positively whilst the one in Miami field office who denied I-751 disregarded my evidence. I'm not sure how it works with I-485? How much time do I have to file if I come back to the states in the nearest future? Or maybe I should not file at all? thank you! -

I filed both I-751 vawa (i got conditional green card that expired) and I-360 vawa. I-751 was denied. I filed another one to get my I-551 stamp to travel and work, it's still pending as I filed only few months ago. In a meantime my i-360 was approved, but I am abroad. What are my options? USCIS may deny or approve pending I-751 vawa or maybe I just withdraw it? I still have valid stamp until Uscis denies my application, which can happen soon or in a few years. I'm not sure how it works with I-485? How much time do I have to file if I come back to the states in the nearest future? Or maybe I should not file at all? -

Guys my I-360 has been approved! Yesterday I got a message that my card is being produced and today that my case has been approved and I will receive an approval notice. Question: what card will i receive? I only submitted I-360 vawa. My timeline: November 2019, rfe for good moral character in March 2020. 4 years wait! -

I contacted senator, congressman and Ombudsman many times...no help. Just generic response back from USCIS that the case is still under review. -

I'm waiting for my I-360 adjudication since November 2019. 😕 -
I understand. Thank you. I'm afraid if I find a job in my coutry and work for an american employer, they can check my record or something. I'm not sure how that works. Do you know if I receive NTA and leave before master hearing will the judge still rule in my absence even if I call Uscis that I left?

Hi! I would like to personally thank you all for your excellent guidance. I was accused of marriage fraud. The family court judge stated that I married for a green card and that's not true, so USCIS just ignored my bona fide join evidence and agreed with the family court judge. I met a lawyer for a consultation yesterday and $250 later I found out to pack my bags and leave... he said that even if I file another i751 it will be denied. I did file another one, and still thinking of leaving before receiving NTA . I'm scared of their new policy as I read that they are prioritizing cases with fraud and even if I filed another new I-751 they may still send me NTA. Maybe you few of you, including @mindthegap didn't receive it because your denial reason was different or maybe because they are super backlogged. In the decision letter Uscis stated that I had 33 days to file motion to reopen or reconsider but i didn't do that. So now I dont know if they are going to wait with NTA until they adjudicate my pending i-360 and i751, I know they will be denied but I think I'm not interested in living in limbo, and wait few years for a master and individual hearings. I'm from Miami and the immigration court is the most backlogged in the country. I think I will leave in few weeks and if I don't receive NTA, I can leave just by abandoning my legal status. If I receive NTA I think I still will be leaving but that means the judge will rule in my absentia, put a fraud on my record and ban me for 10 years from entering USA. I'm not planning on coming back but of course I never know. How about if I find a job with an american employer...that will be a big problem. I'm praying that everything will be ok. I will keep you all posted.

Thank you for your reply. I did have an attorney, my ex had a better one. I read master hearing can be set up in few months if not years...I don't want to wait such a long time. Can I just leave before, with I-407 form or they will detain me at the airport? I'm worried that I won't be able to find a job in another country od any employer checks my record.

The family court judge stated in divorce decree that I married for a green card and I didn't cohabitate with my ex. I attached plenty of pictures, join stuff, testified that I married for good reasons...my ex got vindictive as he lost my financial support. He used me in any way possible..I was falsely incriminated. There's no material evidence that I committed a fraud except my ex lies. He sufferes from schizophrenia and is a real psycho. Made up stuff in the court to deport me.

I consulted the attorney and he said I will receive NTA soon for 100% that's why I'm scared. The USCIS also said that I can defend myself ' in front of an immigration judge'. Do you know if I receive NTA can I leave or will have to wait years for judge to grant me voluntary departure? Maybe I should leave before going to court. I dont want to be charged with fraud I'm innocent.

Guys I'm really unwell. I'm scared I will soon receive NTA, despite filing another I-751. Can they deny it right away and still issue NTA? and even if I want to leave the country before the court date I read that I can't? Can somebody confirm that? I think these days the date for the court hearing may be set in few months or years? I prefer to leave by myself than to be deported.
