If you want to come on a ESTA and go home and file for a spousal visa, this is legal. But I would not marry and stay in the US, you may have issues here. You will need to go home and then file.

That is not correct. Coming to the US via ESTA for marriage is perfectly legal. It is fraud to enter the US via ESTA with the intent to stay and adjust status.

As I understand it, I can enter on an ESTA for marriage as long as I return home. This would be the case for anybody doing destination weddings. As long as I don't enter with the intention to stay/AOS

Um, no. Baby born in US is a citizen. There are no “levels” of citizenship unless you want to run for president, which being born here allows you to do regardless parent’s status.

Murphy's law will mean that if your husband does go to the interview the baby will decide to come then (possibly triggered by your stress about it), and if you reschedule the baby will come at a time which would have meant he could have gone.
One thing to think about is that the US is one of the few (maybe only) countries which has 2 levels of citizenship. If your husband was to pass the interview and get a same day oath before the child was born your child would be at the higher level of citizenship. If your husband is not a citizen at the time of birth your child will be on the lower level of citizenship (at least that is my understanding).

Yeah, I am not sure if that was something just with the Detroit Passport Office, or something that was in place back in 2018. When my wife applied for the passport the day after her oath ceremony (only about 90 participants at the oath), the clerk reviewed the application, and the naturalization certificate, made a copy of it, and had a supervisor approve the copy and handed the original back to my wife.

Good evening and Merry Christmas, my wife is applying under the 3 year rule, and her date to apply was tomorrow, the 26th. However, I guess the USCIS website runs on GMT, allowed me to submit and pay. The case showed up on her account and shows as December 26th. Applying in San Antonio, Texas, hopefully this flies by.

When I came to the USA on a K1 visa, got married within 90 days. It took me 2 years to file, because of his income not been enough to support me and we didn't want to involve our co-sponsor anymore. When it came to taxes I got a TIN number. We were able to file together and get a bigger refund. But if you are using a TIN number you have to go into a Tax office and get them to file for you, you cant do it by yourself online. Once I got a SSN, I started using that for the next tax year. I also amended my taxes the year I didn't have the TIN.

Right, with what I read they were thinking about it. That's why I said I would wait. My husband and I have thought about it, doesn't mean were going to do it asap. If she's willing to abandon her GC then that is good. But others would not, as it takes money and time to process, just to give up. And if they changed their mind, and wanted to come back it would be a pain. Citizenship would give her freedom to come back and forth as she pleased.

I would wait till you have had your green card for 3 years, then apply for citizenship. Then if you need to return to USA, you wont have any issues.
This is my plan. I filled for citizenship today! but have been eligible since 2017.
