Not really! Pushbrk is right, I have opted that route for this tax year. ( If you spouse is residing outside the country and has not yet been here yet - you can go for single status and than amend once your spouse comes here.)

You have ONLY the below two options after your spouse joins you here.

It is very dangerouse to follow your advice. If he/she is married she/he MUST state it. otherwise they will be in bad situation.

They have two opptions: Married filing separatly or Married filing jointly.

If a peson is married but he/she claim himself/herself as a single it will create a lot of problem after ...

Looks like you have done all your ground work. Try to have proof of gifts exchanges between you folks (e.g. like jewellery receipts, etc.)

Definitely, letters/affidavits from both family members helps!

Ok so I am hearing more and more that sikhs in Punjab are getting more and more rejected for visas(fiance). Reason is twofold, first that they use common last names(Kaur or Singh) and secondly, they has been a rash of fraud from so called travel agents in that region.

So I was denied the first time.. and reapplied., just got the approval and it is in NVC. Any advice on how to try to persuade them not to deny it this time around.

I plan to actually go for the interview this time. I have already started to get letters of support from both sides of our families. Two congressmen and a senator have been informed and they will submit letters of support and also call into the embassy prior to the interview.

I dont know what else to do.

Someone mentioned that since I went to india 4 timesthat the embassy might question why I didnt get married.

all the trips were for 5-7 days since I can not take more time from work. Also, my entire family lives in the states along with my neices and nephews... hence the reason to get married here..

I just wanted to add that I spoke with a supervisor to confirm it.

Question 13 sould have present address of beneficiary at the timing of filing ds-230. In your case, it could be your mother-in-law's address.

Hello All,

I am currently filling out the "DS-230 Application for Immigrant Visa and Alien Registration" for my Colombian wife as part of the CR1 process.

In question 13 it asks for her present address. We are still living together at the address listed on each of our G-325's. However when they process this application (3 to 4 months from now) we will not be living together at this address as I will be in the US and she will be temporarily living with her mother. Don't I want to put her mother's address as this is where they will send the interview packet? If, not how will they know where to send the interview packet?

fyi - mailed my spouse's DS-230 today using james shortcuts and I am following standard processing after checking with NVC (ds230 form, coversheet and spouse's passport photocopy).

I had the same doubt and I checked with NVC. They asked for passport photocopy along with DS-230. So, its standard processing for now with Mumbai/India (Specifically, questioned about interview process - the reply I got was "consulate would collect all required documents").

You would be submitting all required documents except for I864 to VFS. I would got ahead and just submit ds230 with passport copy, if I were you.

Hi Bacchha!

When you are going through IR1/CR1 process, you won't be receiving packet 3 from consulate in India.

Rather, NVC/Consulate would only mail you packet 4 - which is instructions that comes along with your appointment letter.

Well see NVC required only the DS230 Part 1 and Passport Photocopies, I sent these to NVC as they required also.

While here the Mumbai consulate requires some of the same items additional items like the Checklist Applicant statement and photos.

Thanks Jigi! I specifically asked the person at NVC about the website mentioning different set of supporting documents for DS-230. She replied that "consulate would be collecting them and you just have to send passport biographic page as supporting document". (Whole conversation was with respect to my case).

Good news folks!

I called up NVC today and asked them about required documents for DS-230 form.

NVC needs only photocopy of applicant's passport biographic. Rest of the documents would be collected as usual by Mumbai consulate.

Jigi means NVC has requirements to process DS230 and its changing now for particular for India. Before, one had to send only photocopy of applicant's passport. But recently have included a list of documents that needs to sent example police clearance certificate, etc. (certified/notarized photocopies)

Hope this helps...otherwise consulate appointment process hasn't changed. You still get to go through VFS.

Does the VFS need another I-864 Made out just for them, even though the NVC has been submitted one and been approved? In my case I did a I-864EZ.

This goes against what the Packet 3 PDF from the Mumbai Consulate site says (see under Instructional Packages - Packet 3 Click Here For PDF, which is:

If form I-864 and its supporting documents have already been submitted to the National Visa Center (NVC), the documents will be forwarded to our office by the NVC and will be reviewed by the consular officer during the visa interview.

Usually you would receive Packet 4 from the consulate for IR1/CR1. But, looks like the process at NVC for DS230 has changed where you need to submit more documents than before. This shouldn't impact you.

I was also thinking on the same line.... It is always better to have extra stuff for our peace of mind and to be on the safer side.

Recently one of my friend who went through visa interview, was asked to get 'Spouse name' added to her passport & then to come back for interview!

Is this mandatory at all consulates? People who are approching interview make a note of this to avoid a last minute blocker.

Its usually a good idea to include spouse name or make change....most people go far it.

My case was approved November 26th at USCIS. I called the NVC line today and they told me that the case was processed into NVC on December 11th. So thats 15 days total from USCIS approval to a case number being assigned. In your opinion, how fast or slow is that? 15 days from approval to actually case number assigning and processing into NVC?

yes it takes roughly two weeks for case # to be assigned at NVC, from your approval date.

it has been a long wait and i am now ready to use my james short cut...i have been practicing with my barcodes ...but now i have to another additional waiting on the first set of fees and choice of agent to be generated...waiting...USCIS AND NVC have taught me patience a lot of it

My husband lost the AOS fee bill for 70USD what he only has is the envelope...I know that we have to send the letter back to the them because of the barcode but since it's lost what will we do? Can we just send the check using their envelope? Is this ok? or acceptable? Thanks.

Yes, I would use james shortcut 2.0 (I personally used it, it was pretty straight forward). But, if it makes you feel better talk to NVC agent they should be able to resend the AOS bill again.
