  3. Hello, My grandmother whose only income is retirement from SS would like to sponsor her son for a green card. She has been an LPR since 2005 my uncle had a 10 year ban when he left the USA in 1997 for overstaying a B2 visa for 2 years. My mother is a USC and my grandfather is also an LPR. I know my mother could sponsor him,but then he is F4 instead of F2B. What kind of documentation will they need to file for his green card. We have my uncles passport used to enter the USA, we have his I9 form, we have proof of departure such as entering the EU in August of 1997. No issue with law enforcement here or world wide. Please I have no idea why they did not do this 19 years ago. Thanks!
  4. @Timona & @ROK2USA seems like lawyer will be needed, but I will get that for you ASAP! thank you for the help!
  5. Yea this is what I need to find out if it includes the USCIS fees I agree totally fair price. they made it seem was 10k each, but I’ll clarify with them!
  6. Didn’t mean to come off that way I’m sorry! How did the story change? she’s divorced, I just never said when it happened Mom, ex husband, and daughter come to USA and overstay B2 visa. ex husband decided he’s going back to Brazil mother and daughter stay in USA. mother gets married to USC 2 years ago might be 3 by the time they even have an interview. they get married before daughter was 18. will ask if it’s 10K total or 10k each as I’m not sure. like I said I’m just trying to get all the information to share with them so they don’t get taken advantage off is all. again I’m sorry
  7. They divorced in the states after ~4 years of overstaying. But thank you very much
  8. Thanks - everyone I’ll make sure to pass the information along. is there more scrutiny on the mom or the daughter?
  9. I mean they met here. Mom, daughter and ex husband come to usa on B visa ex husband moves back and mom moves on. Should have included that as well in OG post
  10. That’s what I thought, but how does she show proof of relationship? Her mothers marriage certificate and her birth certificate? Not exactly sure would have to ask Thank you and I’m assuming two separate 765 for employment authorization?
  11. Hello everyone my friend is looking for advice and lawyers want to charge her 10k+ to file what I think should be an easy thing to do, but am looking for advice here! My friend is 19 years old turns 20 September 18. Her mom has been married to a USC for two years. They married before she was 18. They both entered the country on a b2 and overstayed. What would be the process for her to get LPR can she file with her mothers petition since she’s under 21? Does she have to wait until her mom is approved and then file? They’re from Brasil. So they would have to file two petitions both containing the following: Documents Relating to I-130, Petition for Alien Relative Form G-1145 to request notification I-130 Petition for Alien Relative Form I-130A Check for filing fee Petitioner Birth Certificate front Petitioner Passport page Beneficiary foreign passport Beneficiary Birth certificate in original language Beneficiary Birth certificate with English translation Passports style pictures for both with name on back Supporting documents showing bona fide marriage ----- EXCEPT HERE for my friend who would just need a marriage certificate to show it happened before she turned 18? a. 12. Hello - my mother is going to marry her long term boyfriend. My mom is a naturalized US citizen. Her boyfriend came on a B2 and overstayed. He was in political asylum proceedings and in feb 2012 the immigration judge ordered removal. In 2014 the case was dismissed. he never left and has no prior criminal activity besides driving without a license. Do they need any extra forms to do AOS or just the regular? I-130 - petition for alien relative I-130A - I-485 - adjust status I-864 - support I-765 - work authorization I-131- advanced parole I filed for my wife’s AOS and that took 6 months from filing to green card in hand in 2021. Will my mom and my soon to be step dad need a lawyer or any additional forms?
  13. Question states newest issues passport and then refers to expired passport. Question 21.B on I-765. new passport doesn’t have the visa while old one does. Entered on old passport before expired and now have new one!
  14. Hello - when applying for AOS thru marriage should the applicant use current passport that does not have visa stamp or expired passport that has visa stamp. Of course the applicant would bring both to the interview, but what to fill out the forms which would be best?
