In my opinion this hurts his probability to get a visa even more. Sorry for it. As his guardian they will probably think that you as responsible for him will now try to bring him to leave here even this is not your intention. Because his past 6 years without a visa, and was not a problem, this could show for the IO your “clearly “ intention to bring he to live here. Good Luck

Short answer: No. K1/k2 visa are 1 time activation. The goal was for her to come to the US, get married and start the other part of the process. She just throws this visa away when not doing those steps. Or you go and marry and than applied for CR1 or start K1 again. In my opinion CR1 will be the best route. Good luck

The Joke here is if you sign a document that is really important, that could contain a lot of misleading information and you don’t care. Your story does not look real at all. Going from Vietnam to California and then NY? Do you have any idea how far is it?? For a 4 hours code class that you are not even enrolled. As others told here your story looks vage and have a lot of inconsistency and we are not even looking what was in the Form, I cannot image the Officer reaction reading all this. If you apply right now not even knowing what was in the form or trying to use a different excuse you will look super desperate. What’s your really motive to come? How old are you? Are you paying for your on trip? Do you have more tan enough funds for it? Why is your kid not traveling with you? Does not matter if you try today or in a month, if your situation is the same (house or not) the outcome will not change. Maybe for you it’s a nice and consistent story but immigrants seem everyday young simple moms/dads coming to try “luck” or even worse, being use in a lot of horrible trafficking situations. All this is not trying to be rude or anything like that but if you have a legitimate reason to come first read your past DS-160 to make sure that all the information that is 100% correct and read the signature part that says: ” E-Signature I certify under penalty of perjury under the laws of the United States of America that the foregoing is true and correct.“ If you don’t understand what this means and signed any paper without reading you can be in trouble. -
Just FYI the employer will need to petition him. It’s not an easy way and not super fast too. For the siblings visa you need to think that will take at least 12 to 15 years approximately. As others said, just a US Citizen can sponsor a sibling. He cannot come in tourist visa and adjust status. If he is super qualified for a job and a company here want to spend a lot of money to bring him, will be faster than siblings visa but is not easy at all. Good luck

Work visa are filled by the Company. I believe that is enough ESL teacher here in the US so I do not think her job fits to this kind of visa. I don’t know exactly but I think she cannot stay here using the current visa because this one is just a “extension” from her husband’s visa. Work visa are expensive and like I said just a Company can ask for, and does not apply for all jobs. They will need to show proofs that there is not other the US that they can contract because this is a high skilled job, what is not the case. Good luck

Doesn’t matter which Brother in law he will visit. A lot of family members lives here. As others said the reason that he was denied is the one that he need to improve. What changed since the interview? If nothing about his life (not about the visit) the outcome was not just be the same as will also show that he is desperate to come. A visa is not a right and they can denied someone based on anything that make they believe that this person will probably overstay. Does he stayed 1 months visiting Thailand and Singapore? Does he have a lot of family member that immigrate to there? Even so the US is a really different country and have it their own rules. Now, if he wants to try and see the results, he is free to do it. Good luck -

Is this lawyer an Immigration lawyer? That he thinks that you will be fine does not mean or guarantee you that USCIS will think the same. The rule are clear and in your case your I-751 was approved by a information that was not true at the time, and you knew. This can create a lot of problems for you. Now, if you prefer to believe any lawyer instead of the immigration rules, is in you. As @OldUser said, ask him to guarantee you and show successful cases like yours that he worked before because in my own experience, some lawyer say whatever the client wants to hear just to get the money because in the end is your life that will be affect, not his. Be honest is always the best way, nos just on immigration!! Good luck

Why are you so afraid? When I did my visa I was in treatment for anxiety and panic attacks. The only thing they asked me was for a letter of my doctor about my diagnostic, treatment and how I was responding. Just that. The best way to deal with immigration is tell the truth. There is nothing wrong about mental health treatments. Good luck -

No, you cannot do that. Advice, if you have no ideia about the difference between a Permanent resident GC holder and a citizen, please study more about it. Claim to be a US citizen when you aren’t can put you in a lot of problems. It’s still not clear how did you became a GC holder and after citizen (if you really are). Good luck
