  1. U can. Just do lotsa or research. VJ has forums specific for consular processing CR1/IR1. It really depend on ur comfort level. Some people don’t want to deal with it, so they hire law firm etc
  2. anything to show that she has domicile in the US https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-1-submit-a-petition/i-864-affidavit-faqs.html Examples of proof that a sponsor’s trip abroad is temporary and that he or she has maintained a domicile in the United States may include: A voting record in the United States Records of paying U.S. state or local taxes Having property in the United States Maintaining bank or investment accounts in the United States Having a permanent mailing address in the United States Other proof such as evidence that the sponsor is a student studying abroad or that a foreign government has authorized a temporary stay The sponsor does not have to precede the applicant to the United States but, if he or she does not do so, he or she must arrive in the United States concurrently with the applicant. Evidence that the sponsor has established a domicile in the United States and is either physically residing there or intends to do so before or concurrently with the applicant may include the following: Opening a bank account Transferring funds to the United States Making investments in the United States Seeking employment in the United States Securing a residence in the United States Registering children in U.S. schools Applying for a Social Security number Voting in local, State, or Federal elections look under domicile tab when did the last time shes in the US? and for how long?
  3. condolences for your loss. as in the letter, what i read is, you have to show that extra evidences as stated on the letter, so they can approve your petition. submit all quality evidences that you can think of, so there's no room for them to say no
  4. Motion to reconsider is black horse means it can be long to be approved. If I were you, I will just refile everything asap. Probably no need to file I-130 if it’s not denied and just I-485 with the affidavit support + I-765 and I-131
  5. The speed of your approval has nothing to do with your case is being “clean”. USCIS is working on case based on last in first out. Good for you ! The one who gave you realistic input has nothing to be jealous about as they already reached the finished line aka naturalization or received green card. If you don’t like people to make “buzkill” comment perhaps you shouldn’t publish ur “happiness” in public forum. it’s public after all, people can and allowed to comment any post. And I read all the comments, no one is being catty or give you backhanded comments, don’t know why you so crossed about it Let us know when you get the immigrant visa in lightning speed as your case is “clean”
  6. depend on how easy she changed her name on the passport. the immigrant visa will be issue following the name of the passport. some country is easier than other to change from maiden name to marriage name. if i were you, just use her maiden name for application, come to the states, get the GC ( in maiden name) and change the name during naturalization ( if she wants to be US CItizen). that's the cheapest and easiest method. and if she and you really really really want her to take ur name and cant wait that long, once she got the GC you guys can file i-90 for name change and it's gonna cost around $540 there's no red flag to change name, but as u said. It would take time and money to change all the documentation.
  7. i know that's for sure applied for B1/B2 visa, not sure how do they treat for ESTA. probably the same. just no more ESTA i guess? https://www.rnlawgroup.com/esta-extensions-and-what-happens-if-i-overstay-on-esta/
  8. ok here goes : u file i-485, i-765, i-131 the last 2 to be a bridge while you are waiting for ur i-485 to be approved back in the day those 2 will be approved quickly ( within 3 months) so u can work + travel while u still waiting for ur i-485 to be adjudicate. it's called combo card ( 1 card has 2 benefits) nowdays is all over the place, i -765 can be approve in 1 month or 6 months who knows. while most i-131 never been approved. once u got ur GC, u can burn that i-765 and i-131 if you like ( jk) those 2 become obsolete once u got green card and yes, green card = u can travel outside USA any reason why u dont file everything concurrently? most people did that if there's no issue ( for example removal proceeding). means i-130, i-130A ( spouse), i-485, i-765, i-131, i-864, i-693 ( medical have to go to civic doctor). i asked because u said u got i-130 approved just read this to educate urself :
  9. did the lawyer give u copy of the package? even my not great ex lawyer's assistant always give me copy of any application that they did for me. if you have it, take a look what's been submitted. i agree with others, i-824 take forever and costly, if u still in status, just go back and do consular processing. cheaper as well than AOS
  10. i dont see the reason why not since at the moment u dont have to pay for i-765 ( fee is included on i-485) also with i-131. always claim all benefit that you can get. depend on ur local FO, ur i-485 might take long time to be approve, i-765 is the bridge while u are waiting for ur GC. many people said " we dont need it" and turned out later on they really need it for emergency
  11. recent report said gc can be up to 3 months receive in hand. just wait the stamp on passport usually is adit stamp ( i-551) that's valid for 1 year. adit stamp is equal green card (status) you can go to SSA office and request one if u like : https://secure.ssa.gov/poms.nsf/lnx/0110211025 with that adit / i-551 stamp
  12. Usually depend on age. And make sure ur DL can be use the whole time. Most states required the resident to get local DL I think 10-20 days after you reside in the area ? I only exclusively rent from Avis because my partner has some status so we can get basic economy price for $25 ish/day but always 100% got a non basic economy. Smaller car with better gas milage always a better idea
  13. Are you saying u want to rent a car ? Or lease or something else ? Usually rent is short term and lease is longer
  14. it varies. can be days, weeks or months and no exact timeline
  15. they dont need to fly to NY specifically just for GC they can fly to any port of entry and just update it with the officer and hope for the best nothing u can do beside update AR-11 and inform the officer when they land
  16. Nah it just template from them use for various purposes, eg EAD. When did u go to SSA office btw?
  17. definitely wait and make sure ur visa is not expired by then
  18. @INFneed to see the top part of the letter, just blur ur info. the top part is the most important one. i had 2 letters, before and after and the difference is at the top one EDIT : never mind, no need to post another photo. that's the 2nd letter that i got. u should be good
  19. probably this week. already got the letter from local SSA office that said " this letter is a receipt" and wait for ur SSN card in 2 weeks. letter dated same day when my case status changed. i know usually the card itself printed in their HQ in maryland.
  20. i assume it's for consular processing? do u do consular processing in ur home country? usually u need to show the vaccination record to the appointment doctor on approved list in that country they will know what to do. unless u are not in italy right now because i see the ur country is netherland
  21. No dismiss whatsoever on the order. Motion to terminate proceeding granted. That’s it
  22. Motion to terminate proceeding. ( that’s the exact word, no without prejudice ) similar with @Demise sans motion to dismiss. Filed PD twice to OPLA Boston and went black hole. OPLA gone AWOL and never responded. Call, email they ignored all. Saw that Coronado Acevedo on Nov and chased my lawyer for 6 weeks straight before he responded. File motion to terminate proceeding directly to the court on Christmas Eve and got approved Jan 17. Judge is not even in Boston, he’s in Virginia (WebEx) and yeah dismiss = usually joint with ICE, terminate = court. It doesn’t really matter really. Case closed forever
  23. U can use G-1450. Make sure to call the bank and let them now there’s gonna be transaction $1,225 soon. Sometimes G-1450 bounced back. I personally prefer personal cheque
  24. those 2are unrelated. it really depend how busy is ur field office who process the i-485 u dont need i-130 biometric since it filed by the petitioner and not the beneficiary
