  2. i helped someone to file for AOS on January 2024. she was pregnant at that time she did i-693 (december 2023), the surgeon cant/didnt force her to get covid booster and just put a note that she (the beneficiary) is pregnant. file the medical with AOS package, she just got approved in August 2024 without interview. but in ur case ur wife is not pregnant so i dont know how u are going to get away with that. can only file the waiver to find out the result.
  3. what struck me when i read your post, i keep thinking, what do you really want? we can all give input, suggestion, but this is about relationship and feelings and not immigration stuff. all i hear mostly excuses from both of you. cant, cant cant but in fact it seems it's more WONT. if u wanna make things work, then do something, if u wanna give up, then just divorce. noone can tell u what to do. just want to add, IT job is not a piece of cake this past few years (i know because im married to managerial level IT guy) by paper maybe it's easy for him to get one, that's by paper. even for US citizen it's hard to get that kind of job, many2 lay off, even full time job is not secured (again, i know because im married to one and it's a struggle), let alone foreigner who has no experience in the US. if u said if u walk to buy groceries it's gonna take 1 hour? seems not a big city to me. that means less IT job in that area, and most IT job now is not remote. i mean i like ur optimism about he can get a job easily, but what if he cant? have u think about it ? how bout he cant get a job for 14 months ( happened to my husband back in 2020) or 6 months (happened to my husband in 2023/4 and he just got a job literally 3 months ago). the company that he currently work said its a remote job, but in reality he told me he can't do work if he didnt come in person at least 2-3 days a week because need to access something at work (cant be done remotely). he's working in the capital of IT company and not in the middle of nowhere. he kept looking and IT job is not great at the moment. more layoff than hiring. and he's the USC not the immigrant. he always got a good paying job up until few years ago because again, lotsa of layoff. what im trying to say, do u have a back up plan if it happened to ur husband? ( cant find work even with the precious EAD). and i dont understand about need kitchen, dont want studio bla bla bla, at this moment, he has no job, he's not working, but why he has too many conditions right now, dont want this dont want that when he seems broke to me. and u said he ran out of his saving, so dont know why he whined so much. ( maybe because i only hear ur side, and not his side). just being in love without $$$ will strained the relationship. people can say whatever they want, but if u are broke, love will dissapear because when you are hungry, u cant eat love. and the worst part is, seems the love is not there too. good luck
  4. many times expedite request has received no response from USCIS at all. it's unfortunately at their discretion. there's no rule that they have to response. i knew because i did couple of that request myself. yes in the end i succedded for expedite request and got approved for i-485, i-765, i-131 based on that but that's for another story

  7. there's no point for you to move the interview because you are not F1 category anymore (unmarried adult). cant change it to family interview. u are now on F3 category and ur date is not current https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin.html (look for august 2024 visa bulletin to have idea). it still 5 years from now to be current (at the moment)
  8. no one can guarantee u will or wont get an issue. but LPR stand for lawful permanent residence obviously if you asked here on VJ means u do know that is already an issue. just prioritze and use ur judgment. we can only advise, in the end of the day, are you gonna be okay if ur LPR status is revoke? priority ! asking the same question over and over again wont change our answer here

I personally won’t do it because I don’t want to give my money to USCIS. you don’t have to change ur name. So I can’t answer what name should you choose. Only you can answer that question
  10. 1. are you the petitioner or beneficiary? if you are the petitioner, u dont have to use your married name if you dont want to. if you are GC holder, i will suggest to file i-130 with maiden name. easier. if you want to legally change ur name, u have to pay over $500 to get the GC replace with the new name. 2. again, what name do you want to use? there's no rule to use your spouse name for immigration standpoint if you dont want to 3. you dont change ur status. for 2023 tax that you are going to file in 2024, put what is your marital status on dec 31st 2023 when u file it in 2024.
  11. i dont know how u can get ur AP approved when u case still in the court ( on or off docket or admin closed). i can only get AP approved AFTER my motion to terminate has been approved.

  13. do not file i-485 to the court. u are going to be in limbo even when/if your motion has been terminated. file with uscis AFTER ur motion has been terminated. much cleaner and faster. there are plenty of people that i know personally had to file twice because DHS attorney didnt transfer the i-485 from court to USCIS when motion has been terminated. does the indo flag really indo flag? if yes, hello fellow indonesian !
  14. i called 70 lawyers in 2 months !!! LOL and not "considered", i've been back to study since january. took the test in june and tanked, back to study again, and going to retake LSAT in few months. i will go to law school next year !

  17. mixed bag. do i know personally? no. but there's 1 or 2 story on lawfully app and they shared that they got the removal proceeding terminated with pending 130. in the end of the day it really depend on ur lawyer. my lawyer doesnt even want to file motion directly to the court even when i have approved 130 let alone asked him to file to the court with pending 130. my i-130 took 19 months and that was after i shaked USCIS tree numerous time that granted me i-130 interview. if i didnt do that, perhaps still no GC now.

OPLA dont care about my case thats for sure. 8 months wasted, 2 times filing with OPLA Boston, they just dont care. lawyer also piece of #$@ refused to file to the court, and adamant OPLA is the only way ( it is not). he also ghosted me. keep pestering. once a week i sent the same email, with the added subject : resend 1, resend 2, resend 3, and so on. 2 months later that lawyer gave up and called me with excuses. i said i dont need ur excuse, just file the motion to the court. amd when u going to file? tell me the date, and not "soon". FYI, my case is active and not admin closed. it's at the docket. i already wrote my own motion (spouse still adamant for me to find a new lawyer ) and ready to fire him. lawyer filed, 3 weeks later, my motion has been terminated (finito and not admin closed) and dont go with AP especially if u are still in the court. u have been waiting for so long, why do u want to risk it? people on the internet who said " it's ok, just go" cant help u when CBP wont let u in
  20. once u paid the fee for each person (advisable to pay before they entered and not after), and that person has entered USA, it might take few months. few months can be 3-9 months. why? because USCIS can do anytime they want without any exact timeline
  21. what is VPN anything to do with ticket? does ur fiance have K1 visa? if she does, you can buy one way ticket
  22. someone i know literally just got approved i-601 this month June 2024. she filed it 17 months ago after it got requested during interview in US local field office ( not consular processing)
  23. i will keep the e-ticket, ticket, boarding pass etc that shows you are indeed complete ur trip to go to the states on top of going to closest CBP office (usually in big airport). you wont get i-94 since ur visa is immigrants visa. only non immigrant visa get i-94 online
  24. if you have a confirmed ticket and just cant check in on app, it doesnt mean you will be check in by them the last. even if it's full flight, you should have confirmed seat, unless you are on standby which i think u dont. just go there earlier
